About this file

This is an Agreement between Owner and Contractor for Construction Contract (Stipulated Price) executed by West Manchester Township, Pennsylvania, and the selected contractor for Contract No. 2026-01, a Maintenance & Emergency Contract (Excavation). The contract encompasses indefinite delivery and indefinite quantity of maintenance and emergency work on the Township's sanitary and storm sewer utilities at multiple sites throughout West Manchester Township, including open trench excavation, repairs of existing facilities, and installation of new facilities as directed through Work Orders issued by the Owner. The contractor must commence emergency repair work within eight hours of Owner notification and maintenance work orders within ten days of notification. All work must be completed within a reasonable timeframe as determined by the Owner and specified in individual Work Orders. The contract is binding for an initial three-year period from the effective date, with two optional one-year renewal periods available unless either party provides written cancellation notice at least 30 days prior to contract termination. Sealed bids were submitted by May 20, 2026, with bid documents available through PennBID. No pre-bid conference was held for the project.

Compensation to the contractor is based on unit prices as stipulated in the Bid Form and detailed in Section 01 22 00 - Unit Prices, with the understanding that quantities stated are estimates and payment will only be made for actual quantities furnished and installed. Progress payments are made upon submission and Owner approval of Applications for Payment, with final payment due following completion of work as defined in the General Conditions. All unpaid amounts accrue interest at 10 percent per annum. Liquidated damages are assessed at $1,025.00 per day for delays in work completion beyond specified deadlines, representing the Owner's sole remedy for delay. The contractor must provide a Performance Bond and Payment Bond, maintain detailed accounting records accessible to the Owner during business hours for three years after final payment, comply with all applicable wage and employment laws, and comply with equal employment opportunity regulations. Herbert, Rowland & Grubic, Inc. serves as the Engineer and Owner's representative.
