Subject: Scope of Work and Level of Effort Site Assessment Ruperts Cleaners
2320 Jenks Avenue Panama City, Bay County, Florida 32405
FDEP Site ID No. ERIC_4003
Dear Ms. Aduwa, Geosyntec Consultants, Inc. (Geosyntec) has prepared this Scope of Work and Level of Effort (LOE) for site assessment activities at the Ruperts Cleaners site (Site) located in Panama City, Florida (ERIC_4003) based on the Site Assessment Work Plan (SAWP) submitted to FDEP on 10 May 2024. A description of task breakdown for Site assessment field activities and report preparation is provided below.
SUBCONTRACTOR EVALUATION
Geosyntec obtained three bids from licensed and qualified utility locating, drilling, and IDW transportation and disposal firms; a cost comparison is provided in Attachment A. Geosyntec recommends the following subcontractors based on lowest cost among the qualified bidders:
Underground utility locating ProCheck Inspections
Soil sampling, MAGS installation, DPT groundwater sampling, and MW installation Preferred Drilling Solutions (PDS) (7 total field days)
IDW transportation and disposal Erwin Remediation
Southeastern Surveying is recommended for surveying the five (5) monitoring wells. Copies of the bids from each subcontractor are included in Attachment A.
For ease of reference, Table 1 and Figures from the SAWP are attached as a summary of the field activities and samples to be collected.
Ms. Sarah Aduwa 15 May 2024
Subtask 1 Project Management
Blaine Dawson (Jacksonville) will be the Geosyntec Project Manager. His labor hours are directly computed.
Subtask 2 Multi-Media Sampling (Soil, DPT groundwater, soil vapor) and Interior Monitoring Well Installation
Subtask 2 includes labor for field preparation and preparation of a Site Health and Safety Plan.
Geosyntec personnel will mobilize to the Site to observe the first phase of site assessment activities, which includes a private underground utility survey, lithology boring, soil sampling, MAGS well installation and sampling, direct push technology (DPT) groundwater sampling, and interior monitoring well installation.
Utility locating: Geosyntec will observe utility locating at the Site performed by ProCheck.
Identified utilities will be mapped by Geosyntec staff using a Global Position System (GPS) unit following the private underground utility survey.
Lithology boring: Two soil borings (at LSB001 and LSB002 locations) will be advanced using a DPT drill rig to a depth of approximately 50-feet below land surface (ft BLS) or refusal, whichever is encountered first, to characterize the Site-specific lithology. This data will be used to assist in the selection of vadose zone soil and DPT groundwater sampling intervals.
Soil Sampling: Soil sampling will be performed at up to 17 locations (SB001 through SB010, and MAGS001 through MAGS007) as presented on Figure 3 in the SAWP. A concrete core drill will be used to access soil under the building slab (concrete) and driveway/parking lot (asphalt). Based on an assumed depth-to-water (DTW) of 4 ft BLS, a minimum of three soil samples 0-0.5 ft BLS, 0.5-2 ft BLS, and 2-4 feet below land surface [ft BLS] or water table) will be collected from each of the 17 proposed soil sample locations (51 samples total). The soil samples will be screened with a photoionization detector (PID) organic vapor analyzer and will be analyzed for the presence of VOCs via EPA Method 8260 by a National Environmental Laboratory Accreditation Program (NELAP) accredited, fixed-base laboratory. Soil samples. Supplemental soil samples will be collected from each location and depth interval (via Encore samplers) for analysis of VOCs by the synthetic precipitation leaching procedure (SPLP) should VOC concentrations exceed the leachability-based soil cleanup target levels. For budgetary purposes, it is assumed that approximately half of the proposed soil samples (25) will be analyzed by SPLP for VOCs. Exterior soil samples will be surveyed with a GPS and interior sampling locations will be transcribed using as-builts based on Site features.
MAGS well installation: Seven, 2-inch (in.) diameter Schedule 40 polyvinyl chloride (PVC) MAGS wells (MAGS001 through MAGS007) will be installed by hand auger to a depth of approximately 3 ft BLS (or 1-ft above the static water level if the depth to groundwater differs from our estimate). Each MAGS well will be installed with 1-ft of riser and 10-ft of 0.01-in.
slotted well screen extending from approximately 1 to 3 ft BLS. A 20/30 grade environmental sand filter pack will be placed from the bottom of the boring to the top of the well screen. The remaining annular space will be grouted to just below the top of casing.
MAGS well testing: Each MAGS well will be tested for a period calculated to remove one, 10 to 15-ft radius of soil vapor volume using a blower. The test duration is expected to be approximately 1 hour. The vacuum and flow rates used at each MAGS well will be based on the results of a step test performed at one interior location. The step test will include a minimum of three steps at increasing vacuums to evaluate optimum airflow rates. Vacuum will be monitored at adjacent MAGS wells at approximate 15-minute intervals, as practical, during MAGS testing. After the completion of the study, the MAGS wells will be left in place, capped, and covered with a flush-mount manhole so that they may be converted into soil vapor extraction wells and resampled as necessary in the future.
During testing, soil vapor will be monitored with an organic vapor analyzer equipped with a photoionization detector (PID) utilizing a 10.6 electronic volt lamp. Soil vapor samples will be collected at the end of each MAGS test using a batch-certified clean Summa canister provided by the analytical laboratory. The soil vapor samples will be sent to a fixed-based laboratory for analysis of VOCs by the TO-15 method.
DPT groundwater sampling: Geosyntec personnel will observe the collection of DPT groundwater samples at up to 10 locations (DPT001 through DPT010), as shown on Figure 3 of the SAWP.
Groundwater samples will be collected at 4-ft intervals approximately every 10 feet (i.e., 5 to 9 ft BLS, 15 to 19 ft BLS, 25 to 29 ft BLS, 35 to 39 ft BLS, 45 to 49 ft BLS), resulting in 5 samples from 10 locations (50 total samples). Sampling intervals may be adjusted based on observed depth to water and Site lithology. Groundwater samples submitted to a NELAP-approved fixed-based laboratory will be analyzed for the presence of VOCs by EPA Method 8260 (full list). No field duplicates will be collected.
Interior monitoring well installation: One monitoring well (MW001) will be installed inside the facility adjacent to the former drycleaning machine. MW001 will be installed manually with a limited access DPT dolly rig. The monitoring well target depth will be approximately 15 ft BLS and will be constructed of 1-inch diameter PVC, screened between 5 and 15 ft BLS. A pre-pack screen will be used for hand auger installations.
Field GPS and Interior Mapping: Exterior sampling locations (e.g., DPT groundwater, soil samples, select MAGS wells) will be surveyed throughout the week with a field GPS by Geosyntec personnel. Interior sampling locations will be transcribed using as-builts based on Site features.
Field Deliverable and Draft Summary Figure: Geosyntec has included costs to manage the data generated during this subtask and to develop the following to facilitate discussion with FDEP:
One figure and table to summarize VOC laboratory analytical results from the DPT groundwater samples;
One figure and table to summarize VOC laboratory analytical results from soil samples;
and
One figure and table to summarize VOC laboratory analytical results from MAGS samples.
These data will be provided to FDEP for evaluation to select the locations of proposed monitoring wells to be installed in Subtask 3; data gaps will be addressed during Subtask 3, if practical. If fixed-based laboratory analytical results of soil and DPT groundwater samples indicate that additional sampling will be required to complete delineation, Geosyntec will propose additional sampling locations and corresponding depths. The data will be managed in a database.
Subtask 2 activities will be performed by 2 Geosyntec staff members assuming 1 day for utility locating and marking the locations of the borings (1 Geosyntec staff), 5 days for drilling oversight, 2 days for MAGS well sampling and testing, and close-out tasks at the Site. Geosyntec has assumed 10-hours on-Site per day.
Subtask 3 Exterior Monitoring Well Installations, Surveying, and Groundwater Sampling
Monitoring well installations: Once the final monitoring well strategy has been established with FDEP, Geosyntec will re-mobilize to the Site to install and sample the monitoring well network.
Geosyntec personnel will observe the installation of up to four (4) additional exterior monitoring wells to evaluate groundwater quality; the tentative locations are presented on Figure 3 of the SAWP. We have assumed the existing utility survey will be sufficient for siting the proposed monitoring well locations; however, should the spray paint be worn away or if there is any uncertainty in utility locations relative to drilling locations, Geosyntec will submit a WCD or TACO to FDEP for focused utility locating at the drilling locations.
Water-table monitoring wells MW002 through MW005 will be installed surrounding the facility using hollow-stem auger drilling method. The wells will be constructed of 2-in. diameter Schedule 40 PVC pipe with 10 ft of 0.010-in. slotted well screen, filter pack consisting of 20/30 silica sand, and at least a 0.5-ft thick, fine sand (30/65 silica sand) seal. The remaining annular space will be grouted to land surface with Portland Cement Type I/II and monitoring wells will be completed at the surface with a flush-mount 8-in. manhole and a locking monitoring well cap.
The monitoring wells will be developed until the discharge is relatively sediment-free and sampled no sooner than 24 hours after development.
Monitoring Well Survey: This subtask includes costs for a Florida professional land surveyor to survey the five (5) newly installed monitoring wells. Cost has been included for Geosyntec to oversee the survey.
Groundwater sampling: Geosyntec personnel will collect groundwater samples from the five (5) Site monitoring wells. Depth-to-water measurements (DTW) will be collected from the monitoring wells to evaluate groundwater flow direction. The monitoring wells will be sampled using a peristaltic pump in general accordance with FDEP Standard Operating Procedures (SOPs), assuming the DTW and drawdown do not exceed the suction limit of the peristaltic pump. The samples will be stored on ice and shipped to a NELAP approved, fixed-based analytical laboratory under chain of custody for analysis under standard turnaround times. The groundwater samples will be analyzed for VOCs by EPA Method 8260 (full list).
Subtask 3 activities will be performed by 1 Geosyntec staff member assuming 1 day for drilling oversight, 1 day for surveying oversight, and 1 day for well sampling, IDW sampling, and close out tasks at the Site. Geosyntec has assumed 10-hours per day.
Field Deliverable and Draft Summary Figure: Geosyntec has included costs to generate one figure and table that summarize VOC laboratory analytical results from groundwater monitoring well samples. These data will be provided to FDEP for evaluation. The deliverable will include the final surveyor report, monitoring well installation field forms, and groundwater sampling forms.
Subtask 4 IDW Management
IDW Sampling: The IDW will be sampled prior to profiling. One composite liquid and one composite soil sample will be collected and analyzed for VOCs and metals using the Toxic Characteristic Leaching Procedure. Geosyntec will review the generation of a waste characterization profile as well as the preparation of IDW manifests. Geosyntec will coordinate disposal arrangements for up to 20 drums of assumed non-hazardous IDW. Analytical costs are included to establish the soil and groundwater profiles required by the selected waste hauler. We have assumed field oversight of the drum pickup is not necessary.
For this cost estimate, we have assumed the IDW will not be impacted by PFAS (screening to be performed under separate task assignment) and Geosyntec will submit a WCD or TACO to FDEP for any change of scope.
Subtask 5 Site Assessment Report
Following completion of field activities, Geosyntec will proceed with the preparation and submittal of a Site Assessment Report (SAR) documenting assessment activities and summarizing analytical results. This subtask includes costs to generate a SAR that summarizes the analytical results of the assessment activities outlined above and complies with the requirements of Chapter 62-780.600, FAC. The costing included in the CEF/LOE includes the following figures:
USGS Site Topographic Map
Potable Well Survey

TERMS AND CONDITIONS
ACCEPTANCE & CONSIDERATION& TERM: By authorizing Jim Stidham & Associates, Inc. (JSA) to commence work, Client agrees to these terms and conditions and JSA agrees to perform work and/or extend credit in exchange.
PAYMENT & INTEREST: Invoices will be submitted by JSA once a month with payment due from Client within 30 days of the invoice date. At JSA’s discretion, interest at the rate of 1½% per month (18% per annum) will be charged on the principal amount owing after the due date.
DISCLAIMER OF WARRANTY: JSA will exercise reasonable skill and judgment in performing its work. All express or implied guarantees, representations and warranties, including, without limitation, any implied warranty of merchantability, fitness for a particular purpose, whether written or oral, are hereby excluded and are expressly disclaimed by JSA. JSA does not warrant any specific results of any kind. To the extent an implied guarantee, representation, or warranty, cannot be excluded, JSA’S LIABILITY, IF ANY, IS LIMITED TO THE AMOUNT PAID BY CLIENT TO JSA, AND SHALL IN NO EVENT EXCEED THAT AMOUNT.
LIMITATION OF LIABILITY: JSA shall not be liable to Client or any other party for damages of any type, including, but not limited to, indirect, consequential, incidental, special, or punitive damages, whether arising out of contract, negligence, tort, warranty, strict liability or any other legal theory. JSA’S LIABILITY, IF ANY, IS LIMITED TO
THE AMOUNT PAID BY CLIENT TO JSA, AND SHALL IN NO EVENT EXCEED THAT AMOUNT.
NOTICE OF CLAIM: Any and all claims related to or arising from JSA’s work shall be made in writing to JSA within one (1) year after JSA’s completion of its work. Any subsequent claims are waived.
DELAYS/CONDITIONS BEYOND JSA’S CONTROL: JSA shall not be liable for delays in performance beyond JSA’s control, including, but not limited to, acts of third parties, inability to obtain permits, fire, earthquake, flood, windstorm or other natural disasters, labor stoppages, lockouts, strikes or other differences with employees, war, riot, embargoes, or stoppages created by any government agency or authority. JSA’s liability, if any, is limited as provided in the limitation of liability provision.
JOB SITE SAFETY: JSA is not responsible for providing safety monitoring for the site on behalf of Client or any other trade on site. If JSA observes that safety monitoring is not being performed in strict compliance with the site-specific health and safety plan, applicable federal, state or local laws, and/or as contractually required, JSA may cease operations and go on standby until safety monitoring is resumed. JSA shall be entitled to an equitable adjustment in its contract price, including standby time, and for time to perform its work.
INFORMATION: Client has superior knowledge of the job site, site history, access routes to the job site, known or suspected contaminants, surface and subsurface conditions, etc. The Client is obligated to advise JSA of all or any conditions that may affect JSA’s work. Client agrees to provide JSA with such specifications, plans, site history information, reports, studies or other information on surface and subsurface conditions as will be reasonably required by JSA for safe, proper and timely performance of its work. Client shall locate all underground utilities and structures. Client shall obtain all necessary permits and rights-of-way and indemnify, defend, and hold JSA harmless for its failure to do so and for claims of trespass or damage to property, including underground utilities or structures, which arise out of the performance of JSA’s work.
DISPOSAL: JSA is not, and has no authority to act as a generator, operator, treater, storer, transporter or disposer of hazardous waste, substances, pollutants or contaminants found or identified at the site. JSA shall have no responsibility for the transportation, storage, treatment or disposition of contaminated or potentially contaminated waste materials of any kind which are directly or indirectly generated from JSA’s performance of work, other than hazardous wastes, substances, pollutants or contaminants brought to the work site by JSA. Client or its agents shall be responsible for the disposal of any such waste materials.
CHANGED CONDITIONS: The discovery of any hazardous waste, substance, pollutant, contaminant, underground obstruction, condition or utilities on or under the job site which were not brought to the attention of JSA prior to JSA commencing work, and which create health and safety risks, or requires JSA to perform work outside the original scope or beyond its capabilities, will constitute a materially different site condition entitling JSA to immediately terminate its work (and to receive payment for all work performed up to and including the date of termination). If JSA elects to continue its work, it is entitled to receive an equitable adjustment in its contract price, including standby time, and for time to perform its work.
REMEDIATION TERMS: JSA is not responsible for the remediation design and bears no responsibility for the remediation results or impact to existing conditions.
Notwithstanding anything contained here within this agreement to the contrary, Client indemnifies, holds harmless and shall defend JSA and its affiliates, directors, officers, employees, agents and Subcontractors against any claims or actions, including third party claims or actions, arising from any remediation design, results or impact to existing conditions.
INDEMNIFICATION: Client agrees to indemnify, defend, and hold JSA and its agents harmless from and against any and all claims, demands, causes of action (including third party claims for contribution or indemnification), liability and costs (including attorneys’ fees and other costs of defense) which result from (i) any release or threatened release of any substance (whether hazard or not); (ii) any claim that JSA, or any of its subcontractors was a “generator” or “transporter” of hazardous waste or an “operator” of the job site (as such terms are used or defined under local, state or federal laws or regulations); or (iii) any negligent or wrongful act or omission of Client or others under Client’s control, except the duty to indemnify, defend, and hold harmless shall not apply to the extent any demand or cause of action results solely from JSA’s negligence or willful misconduct.
INCORPORATION CLAUSE: All work performed by JSA is subject to these terms and conditions. All terms and conditions contained in JSA’s bids, proposals, and invoices, as now exist and as may be modified, are expressly incorporated herein by this reference and made a part of the terms and conditions.
INTEGRATION: The terms and conditions stated herein constitute the entire understanding of the parties relating to JSA’s work. All previous proposals, offers, and other communications relative to the work, oral or written, are hereby superseded. Any additional or conflicting provision(s) contained in any purchase order, acknowledgment, contract, or other form of the Client is hereby expressly objected to by JSA and shall not modify these terms and conditions.
ATTORNEYS’ FEES & COSTS: The prevailing party shall be entitled to recover all of its costs, fees and expenses incurred in any dispute regarding collecting the balance due, enforcing the terms and conditions, or pertaining to JSA’s work. Such fees and expenses shall include attorneys’ fees, recording fees, and title report fees whether or not legal proceedings are instituted, and if instituted, shall include all other costs, fees expenses and, including without limitation, court costs and expert witness fees incurred in the trial/arbitration, appellate proceedings, and post-judgment.
APPLICABLE LAW/JURISDICTION & VENUE: Any lawsuit to collect the balance due, enforce the terms and conditions, or that pertains to JSA’s work shall be governed by the laws of the State of Florida, USA. Client agrees that if a lawsuit or action is necessary that it shall be brought in Superior Court for Leon County, Florida. In the event that such lawsuit or action includes enforcement of a real property lien, such action shall be brought in the county and state in which the real property is located.
SEVERABILITY: If any of these terms and conditions are determined to be invalid or unenforceable, such determination shall not affect the validity and enforceability of the remaining terms and conditions.
