HW683_DC012B

This Task Assignment authorizes Geosyntec to conduct annual groundwater monitoring and Revise RAP Mod 3 in accordance with the Geosyntec scope of work, cost estimate, and schedule received on March 31, 2023.

Geosyntec confirmed on March 31, 2023, that subtask 1 consists of the calculated project management labor, based upon 13% of the direct labor costs in this proposal, and includes fringe, overhead, other direct costs (ODCs) and completion fees.

Subtask 2: Subtask 2 includes effort to obtain a signed Access Agreement for the source property.

Subtask 3: This subtask includes costs associated with annual groundwater monitoring activities from 35 Monitoring Wells for 2023 sampling. Purge water generated during sampling activities will be containerized in two 55-gallon drums for transportation off-Site for disposal as non-hazardous waste by Erwin Remediation

Subtask 4: Geosyntec will prepare a revised Remedial Action Plan (RAP) Modification documenting the results of the annual groundwater monitoring event. The report will contain tables summarizing field/laboratory groundwater data, figures showing groundwater flow direction(s), and a summary of the 2023 groundwater monitoring event. A final signed waste manifest for IDW transport and disposal. The RAP Modification will include updated well layout figures; mass calculations; design details; injection dosing calculations; groundwater results figures; groundwater elevation contours; RAP checklist; and engineering cost estimate based on the layout discussed during the November 2021 teleconference between Geosyntec and

FDEP.

Prior to preparation of the RAP Modification, Geosyntec will schedule a call with the FDEP to discuss the 2023 monitoring results and proposed layout to be included in the revised RAP Modification.

The FDEP Project Manager agrees to the scope of work and final cost associated with this Task Assignment. The final cost for this Task Assignment is $20,357.59 with 124 labor hours.

Subtask 2 – Site Access Agreements

As part of SOW/LOE preparation, access agreements were evaluated to determine (i) what agreements are in place and (ii) that the existing owners associated with each agreement are current. Geosyntec reviewed available information on OCULUS and the Orange County Property Appraiser’s Website on 1 February 2023. An Access Agreement for the Source Property (Parcel ID 13-23-28-4150-01-000) was located on OCULUS, but executed with Turkey Lake Shopping Center, LLC on 12 October 2000, and entity that dissolved in 2010 according to Sunbiz.org. No property sales are recorded on the Property Appraiser’s website; however, the listed owner of the parcel is Equity One (Florida Portfolio), Inc. and a new Access Agreement will be required.

Subtask 2 includes effort to obtain a signed Access Agreement for the source property.

Additionally, effort has been included to discuss conditional closure options with the Site owner prior to report submittal.

Subtask 3 – Annual Groundwater Monitoring

This subtask includes costs associated with annual groundwater monitoring activities tentatively scheduled for May 2023. Activities will be completed following receipt of the executed Access Agreement.

Geosyntec will collect depth to water (DTW) measurements and groundwater samples from select, accessible monitoring wells in the Site-wide network. Geosyntec will measure the DTW from the 35 monitoring wells listed below over a 24-hour period, including 10 not proposed for sampling. The DTW measurement will be used to generate groundwater elevation contour maps to evaluate groundwater flow directions in the upper surficial (screened less than 30 ft BLS), lower surficial (screened between 47 to 55 ft BLS), and intermediate aquifers (screened between 63 to 75 ft BLS).

Each monitoring well is flush mount in either a paved or vegetative area (with overgrown vegetation observed during more recent sampling events), and the manholes will require bailing of water to access the wells.

Groundwater samples will be collected in accordance with FDEP Standard Operating Procedures and submitted for laboratory analysis of volatile organic halocarbons (VOHs) by Environmental Protection Agency Method 8260B. The samples will be stored on ice and shipped to the analytical laboratory under chain of custody for analysis under standard turnaround times.

Purge water generated during sampling activities will be containerized in two 55-gallon drums for transportation off-Site for disposal as non-hazardous waste. Bid costs for 2022 prepared by the waste disposal companies are summarized in the following table and included in Attachment B.

It has been assumed that these costs will apply for this Task Assignment. Based on the bids, Geosyntec recommends selecting Erwin Remediation to haul and dispose of IDW generated during monitoring activities. We have assumed no oversight is required for drum pickup.

Subtask 4 – Revised Remedial Action Plan Modification

Geosyntec will prepare a revised Remedial Action Plan (RAP) Modification documenting the results of the annual groundwater monitoring event. The report will contain tables summarizing field/laboratory groundwater data, figures showing groundwater flow direction(s), and a summary of the 2023 groundwater monitoring event. The RAP Modification will include updated well layout figures; mass calculations; design details; injection dosing calculations;

groundwater results figures; groundwater elevation contours; RAP checklist; and engineering cost estimate based on the layout discussed during the November 2021 teleconference between Geosyntec and FDEP.

Prior to preparation of the RAP Modification, Geosyntec will schedule a call with the FDEP to discuss the 2023 monitoring results and proposed layout to be included in the revised RAP Modification. Effort has been included to prepare for and conduct this teleconference.

The RAP Modification will be signed and sealed by a Florida-licensed professional engineer. A final signed waste manifest for IDW transport and disposal will also be included in the RAP Modification, assuming no scheduling delays occur.

Any variance in these conditions is considered a change in the scope of work unless expressly otherwise stated in Hull’s proposal. If any of the waste contains materials which do not conform to the descriptions provided by Customer and/or in the Waste Profile Sheets ("non-conforming waste"), Hull’s may, at its option, properly dispose of it, return it to Customer or require Customer to remove and dispose of the non-conforming waste at Customer's expense and reimburse Hull’s for any expenses that it has incurred. Customer is expressly prohibited from allowing any other carrier to move Hull’s equipment without the prior written consent of Hull’s. The equipment that Hull’s furnishes to Customer will remain on its property until moved by Hull’s. Customer will be responsible for any loss or damage resulting from its handling of the equipment, except for normal wear and tear. Customer will not overload by weight or volume, move or alter the equipment and will take reasonable precautions to prevent others from doing the same. Customer will use the equipment only for its intended purpose. If the equipment is inaccessible or overloaded by weight or volume, Hull’s service will be subject to an additional charge as outlined in Hull’s then current Rate Schedule or other unit rates as applicable. Hull’s will not be responsible for damage to Customer's driving surfaces resulting from weight of vehicles or equipment.

Invoicing and Payment: Customer shall make payments due under each invoice within fifteen (15) days of the invoice date. Interest shall begin to accrue on the invoice due date for payments not received by such date at the smaller of (i) the maximum lawful interest rate or (ii) one and one-half (1½%) percent per month. The individual signing the proposal incorporating these terms personally guarantees payment of any charges incurred thereunder. All payments will be first applied to interest, if any. In the event payment is not timely made and Hull’s files a lien or bond claim on Customer’s account, Customer will be assessed an administrative charge of $500.00 plus any applicable costs provided for in paragraph 6. However, Customer expressly agrees that Hull’s is a beneficiary to, and may impose a lien on, any and all of Customer’s insurance policies and/or proceeds. Customer expressly acknowledges that its obligation to pay all amounts incurred hereunder is absolute and is not conditioned upon availability of funding, insurance, or any other reasons.

Disputes and Waiver of Rights: In the event that Customer disputes any portion of any invoice, Customer shall provide Hull’s written notice of the disputed items within fifteen (15) days of the invoice date.
