The contract covers indefinite delivery and indefinite quantity maintenance and emergency work on the Borough's sewer utilities at multiple sites, including open trench excavation, repairs to existing facilities, and installation of new facilities through issuance of work orders. The contractor must commence emergency repair work within eight hours of notice and maintenance work orders within ten days of notice. Completion timelines are determined by the Owner and specified in individual work orders. The agreement is binding for an initial three-year period from the effective date, with options to renew for two additional one-year periods unless either party provides written cancellation notice at least thirty days prior to termination. A mandatory pre-bid conference was scheduled for Wednesday, September 3, 2025, at 10:00 AM at the Elizabethtown Borough Building, with sealed bids to be opened on Monday, September 15, 2025, at 10:00 AM. Bidding documents are available exclusively through PennBid at https://pennbid.bonfirehub.com/.
Compensation is stipulated based on unit prices specified in the bid form and detailed in Section 01 22 00 of the contract documents. Progress payments are made upon submission and Owner approval of applications for payment, with final payment issued upon completion of work for each work order. Unpaid amounts accrue interest at 10 percent per annum. Liquidated damages are assessed at $1,500 per day for delays beyond completion dates specified in work orders. The contractor must provide performance and payment bonds and maintain detailed accounting records subject to Owner audit for three years following final payment. Herbert, Rowland & Grubic, Inc. serves as the Engineer and Owner's representative. The contractor represents that it has examined contract documents, visited the site, understands applicable laws and regulations, and certifies it has not engaged in corrupt, fraudulent, collusive, or coercive practices.
