DATE: June 14, 2022

SUBJECT: Negotiation Summary – SRP18 Task Assignment (TA) BF01B

Former Slick’s Garage – Site ID # ERIC_7517 Interim Source Removal (ISR) first phase

This TA is intended for conducting the first phase of Interim Source Removal activities at the Former Slick’s Garage site, located at 904 4th Street West, Palmetto, Manatee County.

The services under this task are being conducted using federal funds from the State & Tribal Response Program (SRP) cooperative agreement that is administered by the Department on behalf of the U.S. Environmental Protection Agency (EPA).

Subtask 1: Project Management This subtask is a percentage of the overall project fees and has been negotiated as a contract rate. It includes project management, overhead, general and administrative, and fringe. The agreed upon cost of this subtask is $2,670.00.

Subtask 2: Interim Source Removal Under this subtask, prior to excavation activities, Golder will coordinate utility location at the proposed excavation areas and excavation boundaries will be staked or flagged. The limits of excavation were approximated based on soil analytical data; an approximate 2,438 square-foot area will be excavated to a depth of 2 feet below ground surface, and an approximate 1,451 square-foot area will be excavated to a depth of 4 feet below ground surface. This results in an estimated 396 cubic yards of impacted soil, or an estimated 611 tons of disposal mass.

The excavated soil will be temporarily stockpiled atop plastic sheeting and covered with plastic sheeting when not in use and at the end of each day. Once a sufficient volume of soil has been accumulated, the excavated soil will be transferred to transport trucks provided by the remedial contractor and transported for disposal at Heart of Florida Landfill in Lake Panasoffkee, Florida. The excavation areas will be backfilled with clean fill and the surface will be restored to its original condition. The agreed upon cost of this subtask is $97,912.35.

Summary The Department’s SRP Contract Manager and Golder’s Contract Manager have both agreed to the scope of work and associated costs. The final cost associated with this TA is $100,582.35. Documentation of these costs is included in the Cost Proposal/Level of Effort (CP/LOE) Form and CP/LOE narrative provided by Golder on June 13, 2022, and http://www.floridadep.gov/

Negotiation Summary – Task Assignment BF01B Former Slick’s Garage – Site ID # ERIC_7517 June 14, 2022 www.FloridaDEP.gov the TA Form for BF01B prepared by the Department. The final deliverable for this TA must be received by the Department no later than June 30, 2022.

The original subcontractor bid request was for the completion of ISR activities in Areas 2 and 3. Action Environmental was the lowest bid for this original request. Due to the Department’s SRP budget limitation, the Department could not fully fund the complete ISR in Areas 2 and 3 during this federal fiscal year. The Department approved Golder to request updated rates from Action Environmental, based on the reduced scope of work.

These updated rates are reflected in the Subcontractor Bids attachment. The second phase of ISR will be completed next federal fiscal year in Area 1 and the remainder of Areas 2 and 3, and an ISR Completion Report will be submitted at that time documenting all ISR activities.

RE: COST PROPOSAL FOR INTERIM SOURCE REMOVAL (FIRST PHASE)

FORMER SLICK’S GARAGE

904 4TH STREET WEST

PALMETTO, MANATEE COUNTY, FLORIDA

DEP FACILITY ID NUMBER: ERIC_7517

BROWNFIELDS SITE ID: BF411201004

Dear Ms. Johnson:

Golder Associates USA Inc. (Golder) is providing the Florida Department of Environmental Protection (DEP) with this cost proposal to implement Interim Source Removal (ISR) activities for the above-referenced site. ISR activities will be completed in accordance with Golder’s June 2022 ISR Work Plan. Based on the current DEP fiscal year budget allotment, the DEP has requested that Golder complete ISR activities in two phases. The first phase will be completed during the current DEP fiscal year and will consist of partial ISR Work Plan implementation in Area 2 and Area 3. The second phase will be completed during the next DEP fiscal year and will consist of ISR Work Plan implementation in Area 1 and any remaining ISR activities in Area 2 and Area 3 that were not completed in the first phase. This proposal includes a description of the proposed scope of services, level of effort sheets for each subtask, and a cost estimate form that summarizes the costs of the proposed services. The proposed scope of services is described below.

SUBTASK 1 – PROJECT MANAGEMENT

To facilitate project quality and satisfactory completion of the proposed scope of work, all aspects of this project will be overseen by an experienced project manager. The project manager will be responsible for the schedule, budget, invoicing, project activities, and communications with DEP and the field team. Project management will include coordination of field activities; resource allocation to confirm the work is conducted by qualified professionals in accordance with the project schedule; cost control and tracking of the budget status; and submittal of project invoices in accordance with DEP requirements. The project manager will oversee the work so that it is conducted in a manner that is consistent with the requirements of the DEP-approved task assignment.

Ms. Megan Johnson Proposal No. 202208350

Florida Department of Environmental Protection June 13, 2022

SUBTASK 2 – INTERIM SOURCE REMOVAL

Golder recommends excavation of the soil with polynuclear aromatic hydrocarbon (PAH) and arsenic concentrations above the applicable DEP Soil Cleanup Target Levels. Golder used the existing soil analytical data to define the design excavation areas and depths. ISR soil disposal and backfill calculations are shown in Table 6. The proposed excavation areas and depths are shown on Figure 4.

Site Preparation Activities Site Access, Utility Clearance, and Permits

Following authorization to proceed, Golder will coordinate with the real property owner for access to complete the scope of work. Golder will obtain the applicable local, county, and state-required permits prior to implementing the proposed scope of work. The location of underground utilities will be identified and marked. Sunshine State One Call, a utility location service provider, will be contacted at least three working days (72 hours) before any subsurface work begins. Given that work will be conducted on private property, Sunshine State One Call might not be able to provide details regarding specific utilities in the area where site restoration activities will be conducted. Therefore, Golder will use a private utility location company to locate and map shallow subsurface anomalies present within the proposed site restoration areas.

Anomalies will be marked with paint on the ground surface and a scaled drawing will be developed for reference during site restoration activities. The remedial contractor will then, if applicable, uncover sections of the utilities prior to site restoration activities to verify the locations, depth, and direction. Golder or its remedial contractor will contact appropriate companies to have the identified utilities decommissioned prior to site restoration activities, if necessary. Utilities will be restored or repaired after the completion of the site restoration activities, as necessary.

Kick-Off Meeting

Before initiation of soil excavation activities, Golder will conduct a kick-off meeting with the appropriate contractor representatives, the DEP representatives, and the property owner. The purpose of the kick-off meeting will be to:

▪ Review and confirm the health and safety procedures.

▪ Establish lines of communication.

▪ Document preconstruction site conditions by taking photographs and videos of relevant site features.

▪ Plan workflow and scheduling details.

▪ Establish work zones (exclusion zone, contaminant reduction zone, and support zone).

▪ Review any concerns on the conduct of the work.

Excavation Area Demarcation and Horizontal Control

Golder will mark the excavation areas with pin flags or wooden stakes and marking paint using the GPS coordinates (northings and eastings) of the cut-line soil sampling locations established from the soil sampling activities. The topographic elevations will be surveyed by Golder personnel prior to excavation activities and again following completion of backfilling activities to verify the ground surface is returned to its approximate pre-excavation elevation.

Site Security

There are no permanent security features associated with the site. Temporary fencing along with orange safety fence will be used to secure open excavation areas on residential properties during non-working hours. The temporary fencing will be placed around the front and sides of the property boundary during ISR activities to minimize public access to the excavation areas as needed. Warning signs will also be posted during ISR activities.

The remedial contractor will be responsible for providing security for their equipment and roll-off containers, which may include onsite security or transportation to a local storage yard daily.

Erosion and Stormwater Controls

The remedial contractor will be responsible for setting up and maintaining stormwater controls, which may include installing silt fencing, wattle, or hay bales around the perimeter of the proposed excavations areas, as necessary.

The approximate area for the source removal is less than one acre and, therefore, will not require a Stormwater Pollution Prevention Plan and a Notice of Intent to Use Generic Permit for Stormwater Discharge from Large and Small Construction Activities.

Proposed Soil Excavation The first phase of the ISR implementation will consist of excavation of impacted soil from the following areas:

▪ Area 2 – the proposed 2 feet below ground surface (bgs) area (green shading) and the proposed 4 feet bgs areas (yellow shading), as shown on Figure 4. Note: the proposed 6 feet bgs area in Area 2 (orange shading) will be excavated during the second phase.

▪ Area 3 – the proposed 2 feet bgs area (green shading), as shown on Figure 4

Based on the soil analytical results, an approximately 2,438 square-foot area will be excavated to a depth of 2 feet bgs, and an approximately 1,451 square-foot area will be excavated to a depth of 4 feet bgs. The estimated total volume of impacted soil is approximately 396 cubic yards in-place. Using a conversion factor of 1.4 tons per cubic yard and a 10 percent contingency factor, the estimated disposal mass is 611 tons. The estimated disposal tonnage calculations are shown in Table 6. The proposed excavation areas and depths for each area are shown on Figure 4.

The anticipated list of significant equipment to be used during ISR activities is as follows: excavator (CAT 320 or similar), compact track loader (CAT 249 or similar), wheel loader (CAT 930 or similar), bulldozer (CAT D5 or similar), vibratory drum roller (44-inch diameter), trailer-mounted water wagon for dust control, support truck with a fuel cell, support trailer, and an equipment trailer. The exclusion zone, contaminant reduction zone, and support zone will be marked prior to the initiation of excavation activities.

Excavated soils will be placed into the bucket of the compact track loader (skid-steer) or wheel loader, which will then transport the soil to the proposed stockpile area shown on Figure 4. The soil will be temporarily stockpiled atop plastic sheeting and covered with plastic sheeting when not in use and at the end of each day. Once a sufficient volume of soil has been accumulated, the excavated soil will be transferred from the stockpile to transport trucks provided by the remedial contractor. Golder anticipates that the trucks can be directly loaded along 4th Street West.

The trucks will be loaded atop plastic sheeting on the asphalt surface to prevent excavated soil from coming in contact with the surface. Unless required, the transport trucks will not enter grass, excavation, or stockpile areas during the entry, loading, or exit process. Transport truck tires will be visually inspected for the presence of excavated soil prior to departure. If observed, the excavated soil present on the tires will be removed from the plastic sheeting and transferred back to the stockpile.

Excavation work will be conducted in accordance with the Florida Trench Safety Act, Sections 533.60 – 533.64, Florida Statutes and Underground Facility Damage Prevention and Safety Act, Sections 556.101 – 556.111.

Proposed Soil Disposal The results of soil sampling analyses confirmed that the impacted soils are suitable for transportation and disposal as non-hazardous waste at an approved facility. Once loaded, the soils will be transported to Heart of Florida Landfill in Lake Panasoffkee, Florida. The remedial contractor will provide weigh tickets from a local scale along with weigh tickets from the landfill. Waste handling, storage, transportation, and disposal will be performed in accordance with Chapter 62-730, FAC (Updated Investigation Derived Wastes Best Management Practices).

Traffic controls will be in place along 4th Street West during ISR activities and will include appropriate signage and safety cones or barricades. Trucks traveling on city streets will not exceed the posted speed limits and may reduce speeds if dust is observed.

Backfill and Site Restoration The excavation areas will be backfilled with clean fill and the surface will be restored to its original condition. Prior to site mobilization, Golder or the remedial contractor will collect a sample of the proposed backfill. One soil sample will be collected from the fill source (borrow pit) and analyzed in accordance with Rob Cowdery’s memo dated

June 4, 2009. The representative backfill sample will be collected and analyzed for the presence of volatile organics, base/neutral compounds, acid extractables, RCRA metals, pesticides, and total recoverable petroleum hydrocarbons. The results of the backfill analysis will be submitted to the DEP for approval prior to use.

Once approved, the backfill will be placed in one-foot lifts. Golder will test the backfill material to verify that the compaction was completed to at least 95 percent of the modified Proctor maximum dry density. The frequency of the testing will be at least three tests per 5,000 square feet, which will result in approximately six testing locations.

For safety purposes, compaction testing will start at four feet bgs in the areas excavated below four feet. Golder anticipates that the backfill will be directly loaded into the excavation areas upon arrival and will not be stockpiled onsite. If a stockpile area is required, Golder will notify the DEP and agree on an appropriate location.

Once the compaction requirements have been met, the excavation area will be seeded, unless otherwise directed by the DEP.

Health and Safety The site activities will create health and safety concerns for both site workers and the general public. Measures will be implemented to address exposure risks and health and safety hazards for both groups. In general, the threats to the health and safety of the general public will be addressed by controlling access to the site, preventing public vehicular and pedestrian access to the work area, and controlling dust. Golder will provide a health and safety specialist on-site during the excavation to monitor the safety procedures and dust levels.

Site work will be completed in accordance with Golder’s safety rules and procedures and applicable local, state, and federal regulations, including the Occupational Safety and Health Administration (OSHA) and the US Department of Transportation regulatory requirements. Engineering controls, personal protective equipment, and personal monitoring will be used to control risk to site worker health and safety. In accordance with OSHA’s 29 CFR

1910.120 regulations, a site-specific Health and Safety Plan will be prepared for the soil excavation work. The HASP will include Chemical Safety Data Sheets; maps and directions to the nearest hospital; project personnel and emergency contact information; general safety procedures; and control measures for the potential physical, chemical, and biological hazards at the site.

During construction or maintenance operations, the maximum sound level during daytime hours at the property lines will be 75 decibels. Hearing protection may be required in the vicinity of the work areas.

Personnel working in potentially impacted areas will have completed 40 hours of Hazardous Site Health and Safety Training as required by OSHA 29 CFR 1919.120 (f) regulations, and annual eight-hour refresher training within one year prior to working at the site. Golder anticipates the field activities can be completed in Level D personal protective equipment.

Site contractors will be provided a copy of the HASP for information and guidance. The excavation contractor will be responsible for preparing its own project-specific HASP; complying with all applicable safety rules, procedures, and regulations; and providing for the safety of its employees and any other party retained by the contractor. Spill kits and fire extinguishers will be kept on-site throughout the duration of the project.

Site workers will attend daily job safety briefings at the beginning of each field day to discuss upcoming site activities.

Additional job safety briefings will be completed as required by changes in site conditions and/or activities. Qualified personnel will be provided to coordinate traffic control and workplace logistics throughout the completion of the project.

Dust Control Golder personnel will monitor dust levels in the work area and along the property boundary throughout the ISR activities. Work may be suspended if conditions of high dust generation cannot be controlled. A TSI DustTrak DRX Aerosol Monitor, or equivalent will be used to measure dust levels at a minimum of one upwind and one downwind location. The meters will be mounted on the surveyor’s tripods approximately 5 feet above the ground surface.

Dust meters will collect real-time data, which will be downloaded via USB daily. The location of the monitors will be determined by site conditions and Golder. The locations can be adjusted throughout the day based on wind direction data. The action level for the project will be based on a 4 milligrams per cubic meter differential between upwind and downwind monitoring stations. If the action level is exceeded for a period greater than 30 minutes, work operations will cease until adequate dust mitigation measures can be implemented. During dry periods, a water truck may be used to minimize dust generation.

COST AND SCHEDULE

The estimated cost to complete the scope of work is $100,582.35. Golder has scheduled the first phase of ISR activities for the week of June 20, 2022 (5 days). Golder proposes to submit an interim deliverable following the completion of the first phase. The interim deliverable will include, at a minimum, field documentation, daily reports, weigh tickets and disposal manifests, backfill tickets, and compaction test results. Matt Crews, P.E.

WSP Golder 9428 Baymeadows Road, Suite 400 Jacksonville, Florida 32256

Re: Former Slick’s Garage Interim Source Removal (ISR)

Dear Mr. Crews:

In accordance with your request for accost estimate, Action Environmental is pleased to provide the following proposal for the removal of arsenic-impacted soils at the Former Slicks’ Garage site in Palmetto, Florida.

Based on your emails on May 25th, 2022, we understand the scope of work to include the following:

SCOPE OF SERVICES:

• Perform pre-excavation waste characterization and obtain approval from the landfill

• Call in public utility location services (WSP Golder to conduct private utility location survey).

• Mobilize personnel and equipment to the site to excavate soils as shown on Figure 4- Proposed ISR

Activities as Area 2 and Area 3. Area 1, we understand, is still being delineated and will likely be excavated in October.

• Site preparation including 6’ temporary construction fencing around excavation area.

• Excavated, load, transport and dispose of arsenic impacted soils.

• Backfill in 1’ lifts and compact to 95% modified proctor (Action to provide proctor results of backfill material – WSP Golder to conduct density testing in the field).

• Hydroseed backfilled areas

• Remove temporary fencing and demobilize equipment and crew from the site.

CONDITIONS and ASSUMPTIONS:

• No interfering utilities.

• Excludes permitting.

• Assumes no waiting on confirmation sample results in the field.

• Unit Rates are based on the assumption that the confirmation lab results are “clean” and no additional excavating is required.

• Assumes analytical reports provided by WSP Golder Construction will be adequate for waste characterization and that no additional samples will be required.

• Assumes soils to be disposed of will be accepted as non-hazardous.

• Provide OSHA 40hr trained equipment operators and labor.

• Excludes density testing (WSP Golder to conduct)

• Excludes dewatering.

• Proposal is based on 10 working days with a 2-3 man crew working up to 8-hour days (8 hours onsite plus 2 hour drive time each day).

• Excludes construction of stone or other entrances – tires to be dry brushed if warranted.

• Silt fencing to be removed by others when vegetation has been established as determined by others.

• Assumes site is accessible for tractor trailers for hauling contaminated soil to landfill

• Action will hydroseed the disturbed areas. Hydroseed is applied with water and that will be considered the initial watering event. Subsequent watering is not included in our cost proposal.

• Assumes water source onsite is available for water control if needed.

• This cost estimate is valid for up to 30 days.

ESTIMATED COSTS:

Please find the following attachment to this proposal following the Acceptance Page:

• Interim Source Removal Bid Summary Area 2 and Area 3

Thank you for the opportunity to provide this cost estimate.

Respectfully Submitted, Action Environmental
