About this file

This is a Supplementary Conditions document (EJCDC C-800, 2018 edition) for the Alterations for Penn Township Municipal Building project located in Pennsylvania. The document outlines amendments and supplements to the Standard General Conditions of the Construction Contract and applies to two separate contracts: Contract #1 for General Construction (demolition, sitework, concrete, alterations, exterior finishes, storefront glass, and replacement doors) and Contract #2 for Electrical Construction (heating and lighting for new vestibule, rear entry, and side entry). Bids are due online via the PennBid Program by 10:00 AM on September 3, 2026, with the Notice of Intent to Award to be considered by the Township Board of Supervisors on September 14, 2026. The contract specifies regular working hours of 7:00 AM to 6:00 PM Monday through Friday, with Township Office Building access limited to 7:00 AM to 5:30 PM Monday through Thursday. Contractor progress payments are due within thirty-five days of submission. The document references weather data from the NOAA Lancaster Airport monitoring station and establishes foreseeable bad weather days by month, with abnormal weather conditions only relieving the Contractor of schedule obligations when they exceed these established thresholds.

The Supplementary Conditions establish comprehensive insurance requirements including workers' compensation limits of $1,000,000 per occurrence and employee, commercial general liability of $1,000,000 per occurrence with a $2,000,000 general aggregate, automobile liability of $1,000,000 combined single limit, and umbrella/excess liability of $5,000,000 per occurrence. Performance and payment bonds are required in forms specified in the contract documents. Builder's risk insurance must be maintained on an all-risk basis covering the work, temporary structures, materials, equipment, and spare parts until substantial completion. Herbert Rowland & Grubic, Inc. and Hex 9 Architects must be named as additional insureds on liability policies. The Owner is exempt from Pennsylvania sales and use taxes on materials incorporated into the work, with tax exemption certificates to be provided by the Owner. Equipment rental rates are governed by the most current Equipment Rental Watch rate book, and small tools and hand tools are defined as items with a new retail price under $500. Unit price adjustments are available when a single item represents 25 percent or more of the contract price and actual quantities vary by more than 25 percent from estimated quantities. The contract establishes Lancaster County Court of Common Pleas as the exclusive jurisdiction for dispute resolution, eliminating arbitration as an option, and provides that the prevailing party in final resolution proceedings is entitled to recover its attorneys' fees.
