About this file
This is a Construction Agreement for a Stipulated Price Contract between Penn Township (Owner) and a contractor for alterations to the Penn Township Municipal Building. The project includes general construction work such as demolition, sitework, concrete, exterior replacement finishes, storefront glass, and replacement doors, as well as electrical work including heating and lighting for new vestibules and entry points. Herbert, Rowland & Grubic, Inc. and Hex 9 Architects serve as the project engineers and designers. Bids were due by 10:00 AM on September 3, 2026, with the Notice of Intent to Award to be considered by the Township Board of Supervisors on September 14, 2026. The Work must reach Substantial Completion on or before April 12, 2027, with final completion and readiness for payment by April 26, 2027. The contract consists of 15 drawing sheets and includes both general and supplementary conditions, specifications, performance and payment bonds, and work change directives as part of the contract documents.
The contract price is established through the contractor's bid as submitted on the Bid Form. Progress payments are made monthly on or about the second Monday of each month based on the percentage of work completed, with 10 percent retainage applied prior to Substantial Completion. Once 50 percent or more of the work is completed and deemed satisfactory, retainage may be reduced to 5 percent. Upon Substantial Completion, payments increase to 100 percent of completed work less 150 percent of the engineer's estimate for remaining punch list items. The contractor is subject to liquidated damages of $1,000 per day for delays beyond the Substantial Completion date and an additional $1,000 per day for delays in final completion. All payments not made when due accrue interest at 10 percent per annum. The contractor must comply with Pennsylvania prevailing wage requirements, steel products procurement acts, anti-discrimination provisions, workers' compensation insurance, and EPA and PADEP environmental requirements. The contractor must also maintain comprehensive accounting records for three years after final payment and assume all risk and liability for work performance.
