PERFORMANCE WORK STATEMENT (PWS)

USNORTHCOM FY13 Customs and Border patrol (CBP) procurement Motorola radios 17 September 2013

1.0 MISSION OBJECTIVE.

The DoD Counter Narcoterrorism Program Office (CNTPO) was established to create Counter Narcoterrorism (CN) networks, infrastructure, and capabilities worldwide that are focused on the detection, identification, and disruption of narcoterrorist activities and organizations. This task effort will support the War Fighter in the combating of Narcoterrorism worldwide.

2.0 SCOPE.

2.1 Objective:

The objective is to procure and deliver specific equipment and the associated training for Motorola Radios to Customs and Border Patrol (CBP).

2.2 Basic Contract References.

This PWS establishes the requirements for the contractor to provide support in the Basic Contract task area(s) of: 4.3.2 Training, Operations, and Logistics support; 4.3.2.7 Logistics Support and Equipment; 4.3.3.4 Material and Equipment Purchase.

3.0 PERFORMANCE REQUIREMENTS.

The Contractor shall procure, ship, and deliver all parts and equipment specified in this PWS and provide the associated training for the equipment. The Contractor is responsible for International Traffic in Arms Regulation (ITAR) compliance, customs clearance, value added tax (VAT), and any associated taxes and fees. The Contractor shall ensure that the appropriate Technical Assistance Agreements (TAAs) and/or applicable export licenses are in place and all required documentation and approvals have been obtained before conducting any delivery that require such approval and documentation. All equipment and training will be transferred to Mexico. The Contractor shall provide all labor, materials, equipment, travel, DBA insurance, and other required actions to satisfy the requirements set forth in this PWS. All parts and equipment shall be delivered to the following United States addresses as specified for each location:

The Contractor is responsible for procuring export licenses and any associated technology transfer agreements for transfer to Mexico regardless of delivery location. Export Licenses and ITAR compliance are required by the freight forwarders in order to export the equipment to Mexico. The equipment will be delivered to CBP, San Diego and Tucson. It is CBP’s responsibility to get the equipment to the Comision Nacional De Seguridad (CNS) Mexican Federal Police in Mexico. These radios will be used along the northern Mexican border region.

3.1 Base Procurement - Motorola APX 7000 Multi-Band Portable Radio (Brand Name Only, Black) (Quantity 15 Tucson and 15 San Diego) The contractor shall procure, ship, and deliver thirty (30) sets of handheld portable, two-way, securable, IP-enabled voice radios (Motorola APX 7000 multi-band portable radio) for the CNS Mexican Federal Police. These radios will be used along the northern Mexican border region, where the Mexican State of Sonora and the U.S. State of Arizona border meet. The items (without quantities) listed in the table below are items that make up the radio system.

Training: The Contractor shall provide a one (1)-day New Equipment training session, to include course of instruction (CDRL A00E, PWS Para 10.10), and manuals (CDRL A00E, PWS Para 10.7) for up to thirty (30) students per session. Training shall be conducted at the San Diego Sector and the Tucson Sector in facilities provided by the CBP within four weeks of equipment delivery. These courses shall be designed to teach the customer how to operate the APX 7000 radios with the features programmed on the radio. In addition, the customer will be taught how to use Motorola Interactive End User Toolkits (iEUTK) to customize their end user training presentations for individual agencies. The course of instruction shall be delivered forty-five (45) days prior to the training in both English and Latin American Spanish (CDRL A00E, PWS Para 10.10). All training and manuals shall be provided in both English and Latin American Spanish.

Training: The Contractor shall provide a one (1)-day New Equipment training session, to include course of instruction (CDRL A00E, PWS Para 10.10), and manuals (CDRL A00E, PWS Para 10.7) for up to thirty (30) students per session. Training shall be conducted at the San Diego Sector and the Tucson Sector in facilities provided by the CBP within four weeks of equipment delivery. These courses shall be designed to teach the customer how to operate the APX 7000 radios with the features programmed on the radio. In addition, the customer will be taught how to use Motorola Interactive End User Toolkits (iEUTK) to customize their end user training presentations for individual agencies. The course of instruction shall be delivered forty-five (45) days prior to the training in both English and Latin American Spanish (CDRL A00E, PWS Para 10.10). All training and manuals shall be provided in both English and Latin American Spanish.

4.0 Warranties And Warranty Process

The contractor shall provide all OEM standard warranties (nothing above or beyond the warranties that come with the initial purchase) of all equipment required by the T/O on behalf of the U.S. Government.

Contractors shall offer the USG at least the same warranty terms, including offers of extended warranties, offered to the general public in customary practice. The OEM warranty is typically some form of materials and workmanship guarantee. Some items may be able to be repaired in-country if the OEM has representation in-country, others will have to be shipped back to the OEM facility that is designated in the respective warranties.

The time for repairs and the individual warranty terms are specific to each item’s OEM warranty and may vary widely. The warranty extended to the Government shall be specific and clearly indicate the terms of the warranty.

The contractor shall provide a Warranty Plan as specified in the Task Order Deliverables section.

5.0 OTHER PERFORMANCE REQUIREMENTS.

5.1 Meetings, Briefings, and Publications.

The Contractor shall participate in technical interchange meetings, to be scheduled upon request of the responsible Contracting Officer or written designee, to discuss and to informally evaluate the contractor’s efforts and accomplishments. During the meetings, the contractor shall present the necessary data to enable a joint review of its various assigned tasks, attendant schedules, and resource expenditures. The Contractor shall present and participate in technical discussions and shall inform, in a timely fashion, the COR/Technical Monitor of any problems with contract execution and any proposed solutions. The Contractor shall attend and participate in other meetings, as scheduled by the responsible Contracting Officer or written designee.

6.0 TEMPORARY DUTY (TDY) TRAVEL.

The contractor shall perform TDY non-local travel and OCONUS travel, as required. The contractor shall provide the performance of this task order within the Continental United States (CONUS).

All travel required and approved will be paid IAW the Basic Contract by reimbursement to the contractor. Only required travel previously approved will be reimbursed.

7.0 GOVERNMENT FURNISHED EQUIPMENT OR MATERIAL (GFE/GFM).

Training shall be conducted at Government provided CBP Sector facilities:

*Copies are to be submitted electronically whenever possible. Recipients at a minimum shall include the Contracting Officer (KO), Contracting Officer’s Representative (COR) and Technical Monitor.

10.0 DATA REQUIREMENTS:

10.1 Master Schedule (CDRL A002).

The contractor shall provide a Master Schedule for Government approval within 45 calendar days of award. The contractor shall create, maintain, and report the schedule in conjunction with the progress report after initial delivery. The schedule shall cover all phases of the project from kick off to close out. At a minimum include the following information:

· Timeline for procurement of equipment, if required;

· Timeline for development of the Courses of Instruction

· Timeline for Training

· Milestones for Deliverables.

In the event of any changes or delays regarding the timeline for procurement of equipment or milestones for deliverables, the Contractor shall update the Master Schedule and submit for Government approval within ten (10) calendar days.

10.2 Progress Report (A002).

A comprehensive progress report shall be delivered monthly within ten (10) business days from the end of the previous month. The report shall, at a minimum contain an overall schedule, the current status of funding, accomplishments, any potential issues, and any lessons learned.

10.3 Management Plan (A00G).

The contractor shall provide a management plan within 45 calendar days of award defining a management system to plan and control this effort. The management plan shall delineate how the contractor plans to accomplish the effort, to include a breakout of Direct Productive Person Hours (DPPHs), travel, material, ODC, DBA Insurance, a milestone schedule, and a schedule for the planned expenditure of funds.

10.4 Quality Control Plan (A00G).

The contractor shall provide a draft Quality Control (QC) Plan with their Proposal. The final plan shall be provided within 30 calendar days after award. At a minimum, the QC Plan shall address the following:

· QC Execution: The plan shall not be cursory, but discuss specifically how the prime contractor shall execute its responsibilities. The plan shall include a clearly defined process, key performance indicators, schedules and personnel, by name, to include those that will be performing subcontractor oversight. The plan shall address how trend analysis and tracking of corrective actions will be accomplished. QC personnel shall not be buried in the organization, but shall have a direct line to upper management.

· Reporting: Monthly status reports shall specifically discuss activities over the reporting period and planned activities for the next period. Information shall specifically address WHO conducted the QC, WHEN was the QC executed, HOW was the QC executed and WHAT the findings and corrective actions were. Trends overtime shall be discussed.

· Invoice Quality Control and Review: The contractor shall discuss how invoice reviews will be conducted, to include discussion on how the primes, subcontractor and supplier supporting data will be reviewed for consistency with requirements and the contractor's approach to execution.

10.5 Status Meeting (CDRL A003).

The contractor shall provide a status meeting report within ten (10) calendar days after a meeting.

10.6 Program Reviews (CDRL A004).

The contractor shall support Program Reviews (commonly called Program Management Reviews (PMR)). Formats for PMRs will be provided by the COR. In addition, the dates and locations will be announced well in advance of the meetings. In some cases, time will be allotted for the contractor to meet individually with Government representatives to discuss contractual issues.

10.7 Radio Manual (CDRL A00E).

The contractor shall provide a Biometric Manual in English and Latin American Spanish upon equipment delivery with the equipment and to the U.S. Government.

10.8 Warranty Plan (CDRL A00E).

The contractor shall provide a Warranty Plan within thirty (30) calendar days after task order award that clearly addresses the following:

· Warranty POC;

· List of items with registration/serial number, and their warranty terms (i.e., length of warranty, start date, type (limited, extended, standard)

· Warranty approach;

· Customer process for warranty process

· Questions

· Registration process

· defects,

· problems,

· repetitive issues

10.9 Export Control Documentation (CDRL A00H).

The contractor shall provide a cover letter describing the purpose of their submission, POC, Contract/TORP number, description of each enclosed attachment and should include original document(s) nomenclature (if revised). The attachments shall be originals or certified originals and be dated, signed by a cognizant authority and indicate specific agreement terms. The contractor shall provide an English translation of foreign language documents when applicable.

10.10 Course of Instruction (CDRL A00E).

The contractor shall develop and provide course of instruction forty-five (45) days prior to the training in both English and Latin American Spanish.
