DATE: June 24, 2024

SUBJECT: Negotiation Summary – BIL22 Task Assignment (TA) Change Order #2 – TA BIL01B C2 Pelican Harbor Seabird Station – Site ID # ERIC_18138 Site Assessment and Permitting activities

This Task Assignment Change Order (TACO) rectifies a work change directive, which was requested to cover costs associated with temporary monitoring well installations, sampling, and reporting; rectifies actual field staff and usage of equipment, vehicles, per diem, and lab samples; and extends the Task Assignment completion date and the interim and final deliverable due dates. Specific changes are detailed below:

Subtask 1: Project Management There was an overall decrease in Project Management hours for this project. This resulted in a cost actual decrease of ($477.74).

Subtask 2: Site Assessment and Permitting Activities Under this subtask there was a change in field personnel, hotel, and per diem. There was also a reduction in equipment usage and lab samples. There were changes associated with permit fees, including NPDES and Certificate to Dig. This resulted in a cost actual decrease of ($17,877.64).

Subtask 3: Monitoring Well Installation and Groundwater Sampling A Work Change Directive dated April 19, 2024, authorized WSP to complete the installation and sampling of two new monitoring wells and related reporting to the Department and to DERM for assessment of arsenic impacts in groundwater. This resulted in a cost actual increase of $8,828.66.

Summary The Department’s BIL Contract Manager and WSP USA Inc’s Contract Manager have both agreed to the above changes. All changes noted above represent a total overall cost decrease of ($9,526.72), as shown in the Cost Actual LOE. The changes were noted in the TACO Request received from WSP on June 18, 2024. The final cost associated with this TA decreased from $39,711.30 to $30,184.58. Documentation of the changes is included in the attached TACO Request, the Delta LOE spreadsheet and the Cost Actual LOE spreadsheet, and the TACO form for BIL01B C2 prepared by the Department.

Additional work is not authorized without prior FDEP approval as indicated by an approved Work Change Directive Form or Task Assignment Change Order Form. It is the Contractor's responsibility to ensure that additional costs associated with this WCD are resolved by a Task Assignment Change Order (TACO) prior to the completion date of the original Task Assignment or subsequent TACOs completed prior to the execution date of this WCD. Failure to do so will result in a loss of reimbursement for work associated with this WCD.

EXTERNAL MESSAGE

This email originated outside of DEP. Please use caution when opening attachments, clicking links, or responding to this email.

Megan, WSP has attached the files necessary to complete TACO #2 for TA BIL01B. The attached TACO #2 rectifies work change directive WCD #1, which was requested to cover costs associated with temporary monitoring well installations, sampling, and reporting. The TACO #2 also rectifies actual field staff and usage of equipment, vehicles, per diem, and lab samples.

As discussed previously, Pelican Harbor is communicating with DERM with regards to any remaining assessment or remediation associated with the right-of-way. As a result, WSP collected less soil samples than originally proposed as part of this task assignment. WSP recommends closing TA BIL01B upon review and approval of the associated deliverables. If additional soil sampling is required, WSP will discuss the associated costs with DEP under a new task assignment.

WSP is requesting time extensions for the deliverables and TA as follows:

Subtask 2 – E-mail deliverable to include field documentation, laboratory analytical reports, tables, and figures for soil sampling activities - July 5, 2024 Subtask 1 & 3 (new) – Supplemental Groundwater Monitoring Report – July 12, 2024 (Note: this report was submitted via e-mail on April 26, 2024. Please let us know if you need a new copy.)

TA Completion Date – August 30, 2024

Please let us know if you have any questions or comments.

Thanks, Brandon K. Poiencot, PE
