December 15, 2023 Proposal No. 202208350
Ms. Megan Johnson Florida Department of Environmental Protection 2600 Blair Stone Road, MS 4520 Tallahassee, FL 32399-2400
RE: COST PROPOSAL FOR SITE ASSESSMENT AND PERMITTING
PELICAN HARBOR SEABIRD STATION
399 NE 82ND TERRACE
MIAMI, MIAMI-DADE COUNTY, FLORIDA
DEP FACILITY ID NUMBER: ERIC_18138
Dear Ms. Johnson:
WSP USA Inc. (WSP) is providing the Florida Department of Environmental Protection (DEP) with this cost proposal to complete site assessment activities and obtain relevant permits at the above-referenced site. This proposal includes a description of the proposed scope of services, level of effort sheets for each subtask, and a cost estimate form that summarizes the costs of the proposed services. The proposed scope of services is described below.
RECENT SITE HISTORY
Following review of WSP’s August 2023 ISR Work Plan, Miami-Dade County Division of Environmental Resource Management (DERM) issued comments to WSP and Pelican Harbor Seabird Station (Pelican Harbor) that required revisions to the ISR Work Plan. Specifically, the comments required revisions to the proposed engineering controls in areas around the tree driplines and the City of Miami right-of-way (ROW), as well as modifications to the air and dust monitoring plan. As a result, additional assessment and planning is needed between WSP and Pelican Harbor’s arborist to approve backfill methods around the tree root systems. If additional assessment reports arsenic levels below the applicable standard, then excavation and backfill around the onsite trees can be avoided altogether.
WSP will also be required to coordinate with the City of Miami to allow the proposed remediation work within City of Miami ROW and the installation of the proposed engineering controls. WSP also proposes to perform additional soil assessment within the tree driplines onsite and the City of Miami ROW to further delineate the arsenic impacts before finalizing a plan and agreement with the City of Miami.
SUBTASK 1 – PROJECT MANAGEMENT
To facilitate project quality and satisfactory completion of the proposed scope of work, all aspects of this project will be overseen by an experienced project manager. The project manager will be responsible for the schedule, budget, invoicing, project activities, and communications with the DEP and the field team. Project management will include coordination of field activities, resource allocation to confirm the work is conducted by qualified professionals in accordance with the project schedule; cost control and tracking of the budget status; and submittal of project invoices in accordance with DEP requirements. The project manager will oversee the work so that it is conducted in a manner that is consistent with the requirements of the DEP-approved task assignment.
Ms. Megan Johnson Proposal No. 202208350
Florida Department of Environmental Protection December 15, 2023
SUBTASK 2 – SITE ASSESSMENT ACTIVITIES
Site Access, Utility Location, and Permitting Following authorization to proceed, WSP will coordinate with the City of Miami for access to complete the scope of work. WSP will obtain the applicable local, county, and state-required permits prior to implementing the proposed scope of work. The location of underground utilities will be identified and marked. Sunshine State One Call, a utility location service provider, will be contacted at least three working days (72 hours) before any subsurface work begins.
The project site lies within DERM jurisdiction and requires DERM approval prior to implementation. The City of Miami also requires a National Pollutant Discharge Elimination System (NPDES) permit, a Certificate to Dig, due to the discovery of archaeological materials onsite, and City of Miami ROW agreements and permitting for proposed remediation work within City of Miami ROW.
As discussed in the ISR Work Plan, a shovel test was performed at the site by Archaeological and Historical Conservancy, LLC (AHC) and results indicated the presence of archaeological material. The City of Miami requires the preservation of this material through a Certificate to Dig. The certificate requires a city public works permit for the proposed work (City of Miami NPDES Permit) and a plan and agreement in place between Pelican Harbor, WSP, and an archaeologist to monitor and direct excavation operations within archaeologically sensitive areas.
WSP will meet with AHC and the City’s Historic Preservation Planner to determine the requirements for monitoring the excavations proposed in the ISR Work Plan. Additional effort and permitting fees remain to complete the Certificate to Dig submittal, prior to work plan implementation. The NPDES permit requires a $595 application review fee, $2,000 for an initial inspection and $750 for a final inspection while the Certificate to Dig requires a $75 application fee.
Soil Sampling WSP will mobilize to the site and collect soil samples every 20 feet along the ROW of NE 82nd Terrace and NE 4th Avenue, excluding areas proposed with impervious cover, totaling 34 soil boring locations. WSP will also collect samples from tree driplines onsite for trees included in the final proposed site layout, totaling an additional 59 soil boring locations. At each of the soil boring locations, WSP will use a decontaminated stainless-steel hand auger to collect discrete soil samples from 0 to 0.5 feet below ground surface (bgs) and 0.5 to 2.0 feet bgs, resulting in a total of 186 soil samples. WSP will submit the soil samples to a fixed-base laboratory for arsenic analysis using EPA Method 6010. The proposed soil sampling locations are shown on the attached Figure 1.
Interim Deliverable for Subtask 2 Upon receipt of the analytical results, WSP will prepare and submit an e-mail deliverable to the DEP. The deliverable will include field documentation, laboratory analytical reports, and updated data tables and figures. The deliverable will include recommendations for reduced excavation and backfill or further sampling, if necessary.
WSP will then meet with the City of Miami to determine the best course of action when excavating around trees and archaeological artifacts within the ROW. Beyond the tree areas and archaeological artifacts, WSP proposes to excavate to the impacted depth as dictated by the soil sampling results and replace the area with clean fill. The excavated material will be retained onsite as proposed in the ISR Work Plan or transported and disposed of at a DEP-approved landfill.
HEALTH AND SAFETY
Site work will be completed in accordance with WSP’s safety rules and procedures and applicable local, state, and federal regulations, including the Occupational Safety and Health Administration (OSHA) and the US Department of Transportation regulatory requirements. Engineering controls, personal protective equipment, and personal monitoring will be used to control risk to site worker health and safety. In accordance with OSHA’s 29 CFR 1910.120 regulations, a site-specific Health and Safety Plan will be prepared for the soil assessment work. The HASP will include Chemical Safety Data Sheets; maps and directions to the nearest hospital; project personnel and emergency contact information; general safety procedures; and control measures for the potential physical, chemical, and biological hazards at the site.
Personnel working in potentially impacted areas will have completed 40 hours of Hazardous Site Health and Safety Training as required by OSHA 29 CFR 1919.120 (f) regulations, and annual eight-hour refresher training within one year prior to working at the site. WSP anticipates the field activities can be completed in Level D personal protective equipment.
COST AND SCHEDULE
WSP anticipates the soil sampling activities can be completed in three days in December 2023. The level of effort sheets and cost estimate form are included in Attachment A. The following table summarizes the proposed costs and deliverable schedule.
