About this file
This is a Substitution Procedures specification document for the 2027 Sewer System Improvements Project administered by Capital Region Water (CRW) in Harrisburg, Pennsylvania. The document establishes the framework for contractors to request approval to substitute products from those specified in the contract documents. Substitution requests are permitted except where otherwise specified, but all substitutions require prior written approval from the Engineer and Owner. Requests must be submitted during the bidding period as specified in Document 00 21 13 - Instructions to Bidders, and substitutions may only be considered when a product becomes unavailable through no fault of the Contractor. The Engineer will evaluate substitution requests based on ten specific conditions, including whether the substitution offers the Owner substantial advantage in cost, time, or energy conservation; does not require extensive revisions to contract documents; maintains schedule integrity; obtains necessary approvals from authorities having jurisdiction; and proves compatible and coordinated with other work.
Contractors must submit complete documentation with each substitution request, including manufacturer information, point-by-point comparative data, cost analysis, maintenance and parts availability, certified test data demonstrating performance compliance, similar project references, and a certification of compliance. The contractor making the substitution request bears the burden of proof and must reimburse the Owner for all Engineer evaluation costs, redesign charges, and any increased costs incurred by the Owner resulting from the substitution. By submitting a request, the Contractor represents that the proposed product meets or exceeds the quality of the specified product, provides equivalent warranty, will coordinate installation at no additional cost to the Owner, and waives claims for additional costs or time extensions if the substitution fails to perform as indicated. Requests submitted on the provided form must be limited to one substitution per submission, and the Engineer will notify the Contractor in writing of acceptance or rejection.

1. Engineer’s Cost Reimbursement: Engineer will record costs in evaluating a substitute proposed or submitted by Contractor pursuant to this Section and the
General Conditions. Whether or not Engineer approves a substitute item submitted by Contractor, Contractor shall reimburse Owner for the charges of Engineer for evaluating each such proposed substitute. E. The Contractor shall document each request with complete data, substantiating compliance of proposed substitution with Contract Documents, including:
1. Manufacturer's name and address, product, trade name, model, or catalog number, performance and test data, and reference standards.

11. Certification that proposed substitution complies with requirements in the Contract
Documents and is appropriate for applications indicated.
12. Contractor's waiver of rights to additional payment or time that may subsequently become necessary because of failure of proposed substitution to produce indicated results.
F. A request constitutes a representation that the Contractor:
1. Has investigated proposed product and determined that it meets or exceeds quality level of specified product.
2. Will provide same warranty for substitution as for specified product.
3. Will coordinate installation and make changes to other Work that may be required for the Work to be complete with no additional cost to Owner.
