About this file
This is a Bid Bond (Damages Form) document for the 2027 Sewer System Improvements Project, Contract No. 2026-12, issued by Capital Region Water in Harrisburg, Pennsylvania. The bid bond establishes the financial guarantee required from bidders submitting sealed bids for general construction services related to sewer system improvements at Capital Region Water's facilities located at 3003 N. Front Street, Harrisburg, PA 17110. Sealed bids were to be received online through the PennBid Procurement Portal until October 27, 2026, at 10:00 a.m. EST, at which time bids would be opened. The contract is awarded on a unit price basis to the overall lowest responsible bidder as determined by Capital Region Water's Board of Directors. The work encompasses sewer main replacement and installation, service line replacement, surface restoration, and all other work identified in the contract documents, including all materials, equipment, labor, and miscellaneous items as contemplated by the specifications.
The bid bond form establishes the financial obligations and conditions binding both the bidder and surety. In the event of bidder default, the surety is jointly and severally liable for the difference between the bidder's bid amount and the next lowest responsible bid, or the full bond amount if no alternative bidder exists, whichever is less. Default occurs if the bidder fails to deliver the executed agreement and required performance and payment bonds within the time specified in the bidding documents. The bond obligation becomes null and void if the owner accepts the bid and the bidder delivers all required documents timely, if all bids are rejected, or if the owner fails to issue a Notice of Award within the specified timeframe. Payment under the bond is due within 30 calendar days of written default notice, and any legal action must commence no earlier than 30 days and no later than one year after the bid due date. Capital Region Water has adopted a Minority Women and Disadvantaged Business Enterprise Plan to ensure equal opportunity for participation in project-related construction contracts.
