About this file

This document is a Justification and Approval (J&A) for a brand name sole source procurement of a Plymovent Vehicle Exhaust System for the 3 CO HQ Fire Station at Watervliet Arsenal, NY. The U.S. Army Corps of Engineers (USACE), New York District, is seeking to procure a $15,000 vehicle exhaust system specifically designed to be compatible with existing fire station vehicles' brake pedal activation system. The justification emphasizes the critical need to maintain the current vehicle hardware configuration to avoid potential damage, modifications, and operational disruptions, with no viable alternative manufacturers identified that can meet the specific technical requirements.

The procurement will be part of a design-bid-build construction contract, with funding from Production Based Support (PBS). Market research was conducted through a Sources Sought Notice published on 20 March 2025, which received no responses. The J&A is authorized under 10 U.S.C. § 2304(c)(1) for "Only One Responsible Source," and the Plymovent system must comply with OSHA, EPA, and NFPA standards for vehicle exhaust extraction systems in fire stations. The contract will require offerors to include the Plymovent system as part of their proposals, with the final construction contract to be awarded as a best value trade-off in accordance with FAR Part 15.

JUSTIFICATION AND APPROVAL

FOR OTHER THAN FULL AND OPEN COMPETITION

Plymovent Vehicle Exhaust System For 3 CO HQ Fire Station at Watervliet NY

1. CONTRACTING ACTIVITY:

The U.S. Army Corps of Engineers (USACE), New York District (NAN), Contracting (CT), 26 Federal Plaza, New York, NY 10278.

2. DESCRIPTION OF ACTION:

This Justification and Approval (J&A) supports the use of brand name components to procure a Plymovent Vehicle Exhaust System for the new 3 CO HQ Fire Station at Watervliet Arsenal, NY (Sources Sought Notice ID W912DS25S0029). This system is a critical component of the fire station's infrastructure, ensuring the health and safety of firefighters by effectively capturing and removing hazardous vehicle exhaust emissions. This J&A specifically addresses the selection of Plymovent to maintain compatibility with existing vehicle-mounted hardware and avoid unnecessary modification costs. The government will not purchase the components directly, but rather will require that offerors include equipment, programming, and work necessary to support the installation as part of proposals submitted in response to a design-bid-build solicitation that will lead to the award of a new BVT construction contract. USACE is responsible for the acquisition and administration of the construction of 3 CO HQ Fire Station at Watervliet Arsenal, NY. Funding for this acquisition will be Production Based Support (PBS) (10 U.S. Code § 2805), The FFP construction will be solicited and awarded as best value trade off in accordance with FAR Part 15.

3. DESCRIPTION OF SUPPLIES/SERVICES:

This Justification and Approval (J&A) authorizes the use of other than full and open competition to procure a Plymovent Vehicle Exhaust System for the new 3 CO HQ Fire Station at Watervliet Arsenal.

Plymovent Vehicle Exhaust System, specifically designed and configured to meet the unique layout and operational demands of the 3 CO HQ Fire Station's vehicle bays. Crucially, the system must be fully compatible with the existing brake pedal activation system already installed on the Arsenal Fire Department's vehicles. This system uses a switch on the brake pedal to automatically activate the exhaust fan when the pedal is pressed. The system must be compliant with all applicable OSHA, EPA, and NFPA standards for vehicle exhaust extraction systems in fire stations. The estimated amount of this requirement is $15,000.

4. AUTHORITY CITED:

10 U.S.C. § 2304(c)(1), Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements, as implemented by FAR 6.302-1(c), Application for Brand Name Descriptions. In accordance with FAR 6.302-1(c), the Contracting Officer will specify that all offerors be required to procure an item peculiar to one supplier (Plymovent).

5. REASON FOR AUTHORITY CITED:

A. Background:

The Watervliet Arsenal Fire Department has determined that only the Plymovent Vehicle Exhaust System can meet the specific operational and performance requirements without incurring costs and potential disruption to existing vehicle systems.

B. Justification:

Critical Compatibility with Existing Vehicle Hardware: The Watervliet Arsenal Fire Department's existing fire vehicles are equipped with a brake pedal activation system for their vehicle exhaust fans. When the brake pedal is pressed (typically when starting the vehicle inside the station), a switch on the pedal automatically activates the exhaust fan, drawing fumes directly from the tailpipe.

This system is essential for minimizing firefighter exposure to harmful emissions during vehicle startup.

Procuring a vehicle exhaust system from a different manufacturer would necessitate the removal and replacement of these existing vehicle-mounted switches and wiring with hardware compatible with the new system

Modifying the existing vehicle wiring and electrical systems carries a risk of damage to the vehicles and could result in extended vehicle downtime.

C. Alternatives:

No viable alternatives will be acceptable to meet the mission requirements due to compatibility issues of the Fire Station vehicle equipment from other manufacturers. Any vehicle exhaust system other than a Plymovent will not be able to guarantee operational effectiveness of the Fire Station vehicles during an emergency.

D. Impact:

Delaying the procurement of the Plymovent system to allow for full and open competition would negatively impact the construction schedule of the new fire station and result in the unnecessary expenditure to modify the existing fire vehicles. Plymovent Vehicle Exhaust System is the only system that meets agency's requirements while avoiding unnecessary costs, minimizing potential damage to existing vehicles, and ensuring the continued effectiveness of the fire station, which avoids modification of the existing fire station vehicles.

6. EFFORTS TO OBTAIN COMPETITION:

The brand name product has been published as required by FAR 5.201, a Notice of Intent (NOI) for Brand Name Plymovent Vehicle Exhaust System at Watervliet, NY (W912DS25S0029) to determine sources for this system was synopsized on 20 MARCH 2025 as part of 3 CO HQ Fire Station. The brand name justification and approval will be posted with the solicitation. As stated in paragraph 5 above, a Plymovent Vehicle Exhaust System is the only brand available to ensure compatibility with the existing Fire Station vehicles at Watervliet Arsenal. Plymovent Vehicle Exhaust System is available on the open market for purchase and installation by all offerors.

7. ACTIONS TO INCREASE COMPETITION:

This J&A supports a discrete requirement that will end when the project is complete.

Therefore, there are no planned actions to increase competition for the requirement covered by this J&A.

8. MARKET RESEARCH:

Market Research to determine sources for WVA Fire Station Infrastructure was synopsized on 20 MARCH 2025. The Sources Sought was published for the required 15 days in SAM.gov (W912DS25S0029).

9. INTERESTED SOURCES:
