About this file
This is a Justification and Approval (J&A) document authorizing the use of other than full and open competition for a federal construction contract.
The Naval Facilities Engineering Systems Command, Mid-Atlantic (NAVFAC MIDLANT) is conducting a Design-Bid-Build construction project for solicitation N4008526R0001 at the USCG Offshore Patrol Cutters (OPC) Homeport Pier, Naval Station Newport, Newport RI. The project involves demolishing an existing U.S. Navy pier and constructing a new pier to accommodate four Offshore Patrol Cutters, along with associated infrastructure including stormwater management, fire/potable water, electrical, telecommunications, and compressed air utilities. The J&A authorizes the use of a brand name specification for a Ground Detection System Line Insulation Monitor (Bender ISOMETER iso685) from manufacturer Bender. The statutory authority for this single-source acquisition is 10 U.S.C. 3204(a)(1), permitting use of limited suppliers when essential to government requirements and only one responsible source exists. The rationale is that the USCG Electrical Shore Ties Configuration Standard Technical Order (CSTO Rev B) requires ungrounded delta 450V, three-phase power with a Line Insulation Monitor to comply with National Electrical Code Article 250.21, and the USCG has specified the Bender ISOMETER iso685 device as the required product. A sources sought notice was published on SAM.gov on 11 March 2026 with a response date of 26 March 2026, and no responses were received. The Contracting Officer will determine fair and reasonable pricing using one or more techniques including comparison of proposed prices, Independent Government Cost Estimate analysis, historical pricing comparison, or market survey results. The project is funded by FY22 Major Acquisition Systems Infrastructure (MASI) and FY25 One, Big Beautiful Bill Act (OBBBA) Department of Homeland Security, Coast Guard funding, with contract completion required within 918 calendar days after award.

JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity.
The contracting activity is Naval Facilities Engineering Systems Command, Mid-Atlantic (NAVFAC
MIDLANT)
2. Description of the Action Being Approved.
This Justification and Approval (J&A) authorizes the use of brand name specifications for a Ground Detection System Line Insulation Monitor (LIM) (Bender ISOMETER iso685) from manufacturer Bender in solicitation N4008526R0001, Design-Bid-Build, USCG Offshore Patrol Cutters (OPC) Homeport Pier, Naval Station Newport, Newport RI.
3. Description of Supplies/Services.
The intent of solicitation N4008526R0001, Design-Bid-Build, United States Coast Guard (USCG) Offshore Patrol Cutters (OPC) Homeport Pier, Naval Station Newport, Newport RI is to demolish an existing stormwater management, fire/potable water, electrical, telecommunications & compressed air utilities, etc.
The solicitation includes the requirements for a Ground Detection System Line Insulation Monitor. The solicitation will include brand name specifications for a Ground Detection System Line Insulation Monitor (Bender ISOMETER iso685) from manufacturer Bender.
This acquisition will solicit proposals as an unrestricted full and open, stand-alone construction solicitation as authorized by the approved DD2579 on 18 February 2026. The estimated value of the work included in the construction solicitation is approximately , of which is estimated for the Ground Detection System Line Insulation Monitor. The project will be funded by FY22 Major Acquisition Systems Infrastructure (MASI) and FY25 One, Big Beautiful Bill Act (OBBBA), Department of Homeland Security, Coast Guard funding. The work under this contract is required to be completed within 918 calendar days after contract award.
4. Statutory Authority Permitting Other Than Full and Open Competition.
The statutory authority for this acquisition permitting other than full and open competition is 10 U.S.C.
requirements, as implemented by Revolutionary Federal Acquisition Regulation (RFO) 6.103-1, Only one responsible source and no other supplies or services will satisfy agency requirements.
5. Rationale Justifying Use of Cited Statutory Authority.
Configuration Standard Technical Order (CSTO) (Rev B) (SILC-CSTO-36-11 21 27 11-04) requires ungrounded delta 450V, three-phase power.
National Electrical Code (NEC 2023) Article 250.21 requires ungrounded systems to have ground detection systems. To monitor for ground faults on the ungrounded system the CSTO requires a Line Insulation Monitor (LIM), which monitors the insulation resistance of the feeder cables as close as possible

to where they receive their supply on the secondary side of the shore-tie substation transformer. By monitoring the cable resistance, it allows the cabling at elevated risk to be replaced before a fault occurs and will alarm if a ground fault occurs. If a ground fault occurs the monitor will go into alarm.
USCG indicated that the CSTO information for the Line Insulation Monitor system is based on the Bender series of ground fault monitoring systems, with the more recently released ISOMETER iso685 device being the required product going forward. Therefore, the above brand name item is required.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
A sources sought notice was published on Sam.gov on 11 March 2026 detailing the requirements for a Ground Detection System Line Insulation Monitor. The notice sought commercially available products that could meet the same requirements. The response date was 26 March 2026, and no responses were received.
A solicitation notice will be publicized on SAM.gov, in accordance with the requirements of RFO Part 5.
The approved J&A will also be made publicly available as required by RFO 6.301.
7. Determination of Fair and Reasonable Cost.
The Contracting Officer will determine if the price for this acquisition is fair and reasonable in accordance with RFO Part 15 prior to contract award. Analysis will be performed by one or more of the following techniques: (1) Comparison of proposed prices received in response to the RFP; (2) Comparison of proposed prices with the Independent Government Cost Estimate (IGCE); (3) Comparison of proposed prices with available historical information; and/or (4) Comparison of market survey results. The fair and reasonable determination will be made based on the total price of the project. This proprietary item is not an individual line-item price in the solicitation.
8. Actions to Remove Barriers to Future Competition.
For the reasons set forth in Paragraph 5, NAVFAC Mid-Atlantic has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, NAVFAC Mid-Atlantic will assess whether competition for future requirements is feasible.
