About this file
This document is a federal contracting form (FAR 52.209-7) requiring offeror representations and certifications regarding responsibility matters.
The provision requires contractors with current active Federal contracts and grants totaling over $10,000,000 to certify that information entered in the Federal Awardee Performance and Integrity Information System (FAPIIS) is current, accurate, and complete as of offer submission. Contractors must disclose any proceedings at the Federal or State level occurring within the past five years related to Federal contract or grant performance that resulted in: (1) criminal convictions; (2) civil findings of fault and liability with monetary payments of $5,000 or more; (3) administrative findings of fault and liability with monetary fines or penalties of $5,000 or more, or reimbursement/restitution/damages exceeding $100,000; or (4) dispositions by consent or compromise with acknowledgment of fault that could have led to the aforementioned outcomes. The form specifies that "principal" includes officers, directors, owners, partners, and persons with primary management or supervisory responsibilities. Contractors must maintain active registration in the System for Award Management (SAM) and post required information in FAPIIS accordingly. The provision applies only to offerors indicating they have Federal contracts and grants exceeding $10,000,000 in total value.
