About this file

This is a federal contracting representation form (FAR 52.204-24, Representation Regarding Certain Telecommunications and Video Surveillance Services or Equipment) effective November 2021.

The form requires offerors to make representations regarding their use and provision of covered telecommunications equipment or services as defined in Section 889(a) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019. Offerors must represent whether they will provide covered telecommunications equipment or services to the Government in contract performance, and whether they use covered telecommunications equipment or services as a substantial or essential component or critical technology in any system. The prohibition applies to procurements on or after August 13, 2019 for equipment provision and August 13, 2020 for contractor use. Exceptions exist for third-party services such as backhaul, roaming, and interconnection arrangements, and for telecommunications equipment that cannot route, redirect, or provide visibility into user data traffic. Offerors must conduct reasonable inquiries and review the System for Award Management (SAM) exclusion list for entities barred from federal awards for covered telecommunications equipment or services. If an offeror responds affirmatively to either representation, detailed disclosure is required including the producing entity name and identifier, equipment brand and model numbers, service product service codes, and explanations of proposed use and permissibility under the prohibitions. The form requires signature by the offeror or legally authorized representative with complete contact information and date.
