About this file
This is a Federal Acquisition Regulation (FAR) clause template requiring offeror representations regarding covered telecommunications and video surveillance services or equipment. The clause implements Section 889 of the John S. McCain National Defense Authorization Act for Fiscal Year 2019, which prohibits federal agencies from procuring equipment, systems, or services that use covered telecommunications equipment or services as substantial or essential components or as critical technology. The offeror must complete two representations: first, whether it will provide covered telecommunications equipment or services in performance of the resulting contract; and second, whether it uses covered telecommunications equipment or services in its own operations. If the offeror responds affirmatively to either representation, detailed disclosure is required including the entity that produced the equipment, complete product descriptions with brand and model numbers, and explanation of the proposed use and its permissibility under the prohibition.
This is a template document that requires the offeror's name, date, and signature. The clause applies to solicitation W91RUS26QA69 for Electronical IPC PDS Maintenance issued by the Department of the Army Materiel Command Army Contracting Command Aberdeen Proving Ground. Offerors must complete and sign this clause along with another FAR clause and return both documents with their quote. The solicitation closes on September 25, 2026 at 8:00 AM Arizona Time, with questions due by September 23, 2026 at 5:00 PM Arizona Time.
