About this file

This document is FAR Form 52.204-24, a federal contracting provision requiring offerors to represent their use of covered telecommunications and video surveillance equipment or services.

The provision implements Section 889 of the John S. McCain National Defense Authorization Act for Fiscal Year 2019, which prohibits federal agencies from procuring equipment, systems, or services using covered telecommunications equipment or services as substantial or essential components, or as critical technology, effective August 13, 2019 for direct procurements and August 13, 2020 for contractor use. The prohibition applies to covered telecommunications equipment that can route, redirect, or provide visibility into user data traffic. Exceptions exist for third-party connectivity services (backhaul, roaming, interconnection arrangements) and telecommunications equipment incapable of routing or monitoring user data. Offerors must represent whether they will provide covered telecommunications equipment or services to the Government and whether they use such equipment or services in their operations. If an offeror responds affirmatively to either representation, detailed disclosure is required, including the producer entity information (name, unique entity identifier, CAGE code, OEM or distributor status), equipment descriptions (brand, model number, item description), and explanation of proposed use with factors demonstrating permissibility under the prohibition. Offerors must also conduct reasonable inquiries and review the System for Award Management (SAM) exclusion list for entities barred from federal contracting for covered telecommunications equipment or services. The form must be signed by the offeror or legally authorized representative and returned with the offer.
