INSTRUCTIONS AND EVALUATION

A. Basis for Award

The award of this construction contract will be made using a Best Value Trade-Off Process in accordance with FAR Part 15, based on the best overall (i.e., best value) proposal which is determined to be the most beneficial to the Government with appropriate consideration given to the non-price and price factors. The Government intends to engage in the procurement of a firm-fixed-price (FFP) construction contract.

Evaluation of proposals will be based on three (3) non-price factors: (1) Experience; (2) Past Performance; (3) Proposed Technical Approach. These factors are listed in descending order of importance. Price is the final and least important factor. All evaluation factors other than price, when combined, are significantly more important than price. To receive consideration for award, a rating of no less than “Acceptable” must be achieved for Factor 1, a rating of no less than “Neutral Confidence” must be achieved for Factor 2 and a rating of no less than “Acceptable” must be achieved for Factor 3. Offerors should note that the award may not necessarily be made to the lowest price offer.

B. Evaluation Factors

During the evaluation of each proposal, the Government will assign a rating for Factors 1, 2 and 3. Factor 4 (Price) will be evaluated for price reasonableness. The following factors will be used to evaluate each proposal:

Factor 1 – Experience

Factor 2 – Past Performance

Factor 3 – Proposed Technical Approach

Factor 4 – Price

C. Evaluation Approach

The proposals will be evaluated to determine whether the Offerors’ methods and approach have adequately and completely considered, defined, and satisfied the requirements specified in the Request for Proposal (RFP). The proposals will be evaluated to determine the extent to which each requirement has been addressed in accordance with the proposal submission instructions provided in the RFP. All proposals shall be subject to evaluation by the Source Selection Evaluation Board (SSEB) based on the evaluation factors.

For submission requirements designated as “shall” or “must,” failure to provide the requested information will be considered a deficiency and the specified factor will be rated red/unacceptable, and the Offer will be considered un-awardable unless revised. For submission requirements designated as “should,” failure to provide the requested information may result in a lower rating for the specified factor. Offerors will be cautioned that award may be made without discussions, and Offerors may not have the opportunity to submit revised proposals.

Additional instructions on the evaluation approach can be found with each individual factor.

D. Proposal Submission Requirements

1. Instructions For Submitting Electronic Proposals

- All other project examples shall include at a minimum two elements of the following four phases of airfield fueling: [1] offload, [2] transfer (systems of pumps, filters and pipes), [3] aviation fuel storage or [4] fuel delivery to equipment that incorporates refueler truck fillstands or otherwise complies with the direct aircraft fueling systems criteria for Type III, IV, or V hydrant fueling systems as specified in the UFC 3-460-01.

- If the Offeror submits more than five (5) project examples, the Government will only evaluate the first five (5) submitted projects.

c. Evaluation Method for Factor 1:

- Proposals will be evaluated to determine whether the Offeror’s submission meets the requirements of Factor 1. If any of the required information is not provided in the Offeror’s proposal or fails to meet the requirements, the Offeror will be evaluated as “Unacceptable.”

- This factor will be rated using Table 2.

Table 2 – Experience Ratings

Adjectival Rating Description

Acceptable

The proposal clearly demonstrates how at least one of the project examples includes all four phases of airfield fueling {[1] offload, [2] transfer (systems of pumps, filters and pipes), [3] aviation fuel storage or [4] fuel delivery} and at least one other project example includes, at a minimum, two of the four phases of airfield fueling.

Unacceptable

The proposal does not clearly demonstrate how at least one of the project examples includes all four phases of airfield fueling {[1] offload, [2] transfer (systems of pumps, filters and pipes), [3] aviation fuel storage or [4] fuel delivery} and at least one other project example includes, at a minimum, two of the four phases of airfield fueling.

2. Factor 2 – Past Performance

This section shall contain past performance information for each project submitted by the Offeror in Factor 1, Experience. Offerors shall only submit Past Performance Questionnaire (PPQs) for each of the projects included as part of the submission for Volume I, Factor 1: Experience. Past performance information submitted shall include the following:

1) For Federal Government projects completed within the last six years, provide the:

Federal Government agency; physical address; name, email address and telephone number for a point-of-contact familiar with the work performed; contract number, contract place of performance, and CAGE Code and DUNS number of the prime contractor;

2) In the case of Indefinite Delivery type contracts, GSA contracts, and Blanket

Purchase Agreements, include Delivery Order Numbers;

3) For all projects submitted by the Offeror in Factor 1 that do not have a CPARS report (more than six years since completion), a PPQ must be completed and submitted electronically as set forth in Attachment A.

A. The Offeror shall complete Blocks 1-4 of the PPQ and send it to the non-Federal project or commercial project client. The client shall complete Blocks 5-8 along with the two page questionnaire and return to the Offeror. The Offeror shall submit electronically with its proposal (Volume I) to the USACE Contracting Specialist.

If the Offeror is unable to obtain a completed PPQ from a client for a project(s) before the proposal closing date, the Offeror should complete and submit, with the proposal, the first page of the PPQ, which will provide contract and client information for the respective projects(s). The Government may make reasonable attempts to contact the client noted for that project(s) to obtain the PPQ information.

However, Offerors should follow-up with clients/references to help ensure timely submittal of questionnaires. The Government's inability to contact any of the Offeror's references or the references' unwillingness to provide the information requested may affect the Government's evaluation of this factor.

Alternatively, Offerors may submit a copy of the client’s signed PPQ (in the form required in Attachment A) for a completed contract or task/delivery order that they have submitted under Factor 1. The Offeror may retain PPQs in its files for submission on future procurements. In cases where the validity of the completed PPQ is questioned, Contracting personnel may contact the reference for verification or additional information. USACE does not intend to create or maintain a database of PPQs submitted by Offerors. Therefore, it will be the Offeror’s responsibility to ensure the submission of PPQs in its proposal that are relevant to the solicitation.

If an Offeror has CPARs evaluations available for Federal Government projects completed within the past ten (10) years, the CPARS evaluations may be submitted in lieu of a PPQ.

4) New Corporate Entities. New corporate entities may submit data on prior contracts involving its officers and employees. However, in addition to the other requirements in this section, the Offeror shall discuss in detail the role performed by such persons in the prior contracts cited. Information on their proposed roles should be included in the project descriptions submitted in response to the solicitation requirements.

The Government reserves the right to verify statements the Offeror makes regarding its past performance to determine whether they are substantiated.

c. Evaluation Method for Factor 2:

- There are three aspects to the past performance evaluation: recency, relevancy, and quality of performance which are combined to establish one performance assessment for each Offeror.

- Recency: projects provided must be completed within the past ten (10) years, as of the issue date of this RFP, to be considered recent.

- Relevancy will be determined by projects that demonstrate completion of projects similar in scope, complexity, size, and cost or price to the solicitation project. When determining the relevancy of projects submitted for experience, the role performed by the Offeror or its subcontractor will be considered for consistency with the proposed role to be performed by the Offeror or subcontractor on the project. Failure to provide agreements or letters of commitment, as applicable, may result in a lower rating for this factor.

- The proposal review will only consider the experience or past performance of an offeror's parent or affiliated companies where the firm's proposal demonstrates that the resources of the parent or affiliated company will affect the performance of the offeror. The relevant consideration is whether the resources of the parent or affiliated company - its workforce, management, facilities or other resources - will be provided or relied upon for contract performance, such that the parent or affiliate will have meaningful involvement in contract performance. The proposal must demonstrate a connection between the affiliate’s proposed role on the project and the role of the affiliate on the past performance submitted in order to receive credit for the affiliate’s past performance.

- If an Offeror is utilizing experience of affiliates, subsidiaries, parent, LLC, LTD member companies (i.e., Offeror’s name is not exactly as stated on the SF1442), the proposal should clearly demonstrate that the resources of the affiliate/subsidiary/parent firm will affect the performance of the Offeror. The relevant consideration is whether the resources of the parent or affiliated company.

– Its workforce, management, facilities, or other resources – will be provided or relied upon for contract performance, such that the parent or affiliate will have meaningful involvement in contract performance. The proposal must demonstrate similarity of the parent or affiliate’s proposed role on this procurement and the parent or affiliate’s role in the project submitted for experience submitted in order to receive credit for the affiliate’s experience.

- The first aspect is to evaluate the recency of the offeror’s past performance. Recent past performance will be determined by similarity of projects where the construction had been completed within the last 10 years. Recency is not separately rated;

however, the following criteria will be used to establish what is recent. Table 3 will be used to evaluate the recency ratings.

Table 3 – Past Performance Recency Ratings

Very Recent Construction was completed within the last 3 years.

Recent Construction was completed within the last 4 to 7 years.

Somewhat Recent Construction was completed within the last 8 to 10 years.

Not Recent Construction was completed earlier than the last 10 years.

- The second aspect of the past performance evaluation is to assess the Offeror’s past performance to determine how relevant a recent effort accomplished by the Offeror is to the effort to be acquired through this source selection. Relevancy is not separately rated; however, the following criteria will be used to establish what is relevant. The criteria used includes the similarity of the scope of the constructed project, complexity, and square footage renovated or constructed, dollar value. Relevancy will be evaluated using the ratings in Table 4.

Table 4 – Past Performance Relevancy Ratings

Very Relevant Present/past performance effort involved essentially the same scope and magnitude of effort and complexities this solicitation requires.

Relevant Present/past performance effort involved similar scope and magnitude of effort and complexities this solicitation requires.

Somewhat Relevant Present/past performance effort involved some of the scope and magnitude of effort and complexities this solicitation requires.

Not Relevant Present/past performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires.

- In addition, Factor 2 will examine the quality of projects reviewed for this factor. A separate quality assessment rating is not required; rather, the past performance confidence assessment rating is based on the Offeror’s overall record of recency, relevancy, and quality of performance.

- The Government will evaluate the record of past performance for the Offeror and each proposed subcontractor to ascertain the probability of successfully performing the requirements under this solicitation. The Government will review all past performance information collected and determine the quality of the Offeror’s performance, general trends, and usefulness of the information and incorporate these into the performance confidence assessment. The overall performance confidence assessment will be evaluated using Table 5.

Table 5 – Performance Confidence Assessments Rating Method

Substantial Confidence Based on the Offeror’s recent/relevant performance record, the Government has a high expectation that the Offeror will successfully perform the required effort.

Satisfactory Confidence Based on the Offeror’s recent/relevant performance record, the Government has a reasonable expectation that the Offeror will successfully perform the required effort.

Neutral Confidence No recent/relevant performance record is available or the offeror’s performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned. The offeror may not be evaluated favorably or unfavorably on the factor of past performance.

Limited Confidence Based on the offeror’s recent/relevant performance record, the Government has a low expectation that the offeror will successfully perform therequired effort.

No Confidence Based on the offeror’s recent/relevant performance record, the Government has no expectation that the offeror will be able to successfully perform the required effort.

- Absent any recent and relevant past performance history, or when the performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned, the Offeror will be assigned a “Neutral Confidence” rating.

3. Factor 3 – Proposed Technical Approach

a. The Offeror shall demonstrate their clear and complete understanding of this project by providing a Project Narrative which outlines the means and methods proposed for this particular project, including, but not limited to, the plan for commissioning and performance testing the system.

b. The Offeror shall also submit a Project Schedule, broken down to the feature of work level and including the number of days for each feature. The Project Schedule should show relationships and predecessor / successor tasks. The Project Schedule should also demonstrate the Offeror’s proposed approach to manage the phasing of the construction work.

c. In the event the Offeror is awarded this contract, nothing in the submitted narrative or schedule will be considered an approved contract modification in the event there are elements of the narrative or schedule which are not in accordance with either the solicitation’s drawings or specifications.

d. Evaluation Method for Factor 3:

- The Offeror’s Proposed Technical Approach will be evaluated for completeness, reasonableness, and level of risk to the Government. The Government will evaluate the degree to which the plan:

1) Includes all the elements described in the solicitation;

2) Is reasonable and logical in relation to the anticipated project; and,

3) Describes a comprehensive and viable strategy to execute the anticipated project as described in the solicitation.

- This factor will be rated using Table 6.

Table 6 – Combined Technical/Risk Ratings

Color Rating Description

Blue Outstanding Proposal indicates an exceptional approach and understanding of the requirements and contains multiple strengths, and risk of unsuccessful performance is low.

Purple Good Proposal indicates a thorough approach and understanding of the requirements and contains at least one strength, and risk of unsuccessful performance is low to moderate.

Green Acceptable Proposal meets requirements and indicates an adequate approach and understanding of the requirements, and risk of unsuccessful performance is no worse than moderate.

Yellow Marginal Proposal has not demonstrated an adequate approach and understanding of the requirements, and/or risk of unsuccessful performance is high.

Red Unacceptable Proposal does not meet requirements of the solicitation, and thus, contains one or more deficiencies, and/or risk of unsuccessful performance is unacceptable.

Proposal is un- awardable.

4. Factor 4 – Price:

a. Submission Requirements for Factor 4:

- The Offeror should provide a table of contents and should number all pages consecutively. Volume II should be submitted in a separate file from Volume I. Volume II should be broken down into sections as defined below:

Section 1: The name(s) and title(s) of the person(s) authorized to negotiate and sign a contract.

Also, provide a Certificate of Corporate Authority or other applicable documentation of authorized signature(s) for each authorized individual.

Section 2: The Offer (the SF1442) duly executed with an original signature by an official authorized to bind the company.

Section 3: Acknowledgement of all amendments to the solicitation in accordance with the instruction on the Standard Form 30 (amendment form).

Section 4: The completed Section 00600 of the solicitation (i.e., Representations, Certifications, and Other Statements of Offerors). All cost and pricing data supplied by Offerors will represent data other than certified cost or pricing data as defined by FAR 2.101.

Section 5: Each Offeror is required to complete (in entirety) the bid schedule provided in the solicitation and provide a completed price proposal in MS Excel using the template provided with this solicitation titled “Supplemental Price Breakdown to the Bidding Schedule.”

ORIGINAL Bid Guarantees in accordance with FAR 52.228-1 must be submitted no later than the date and time for proposal submission.

b. Evaluation Method for Factor 4:

- The contract will be a Firm-Fixed-Price construction contract. The Government will evaluate the price for price reasonableness.

- A price reasonableness analysis will be performed by the Government to determine that the proposal prices offered are fair and reasonable, and that there is no unbalanced pricing.

- Price reasonableness will be determined in accordance with FAR 15.305(a)(1). Normally, competition established price reasonableness. Comparison of the proposed prices is expected to satisfy the requirement to perform a price analysis; however, the Government may, if necessary, analyze the Offeror’s price breakdown to establish reasonableness of an otherwise successful Offeror’s price.

- For purposes of award, the total evaluated price will include all unit prices for the base and any options as identified in the Bid Schedule. Offerors must submit pricing for all line items. The total evaluated price for purposes of the Best Value Tradeoff and award will be determined by the total sum of the line items in the Bid Schedule, to include all options.

- The spreadsheet titled “Supplemental Price Breakdown to the Bidding Schedule” will be used to compare proposal prices to the Independent Government Estimate.

F. Discussions:

The Government intends to award without discussions. Therefore, the Offeror’s initial proposal should contain the Offeror’s best terms from a technical and price standpoint. Proposals will be analyzed to determine which is most advantageous to the Government based upon information provided in response to evaluation factors.

The Government reserves the right to conduct discussions if the Source Selection Authority (SSA) later determines them to be necessary. If the SSA determines that a number of the proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the SSA may limit the number of proposals in the competitive range that will permit an efficient competition among the most highly rater proposals. If the Government does conduct discussions, these will be done in writing.

The Contracting Officer will award a contract to the responsible Offeror whose proposal, as determined by the Source Selection Authority (SSA) conforms to the solicitation, is fair and reasonable, and offers the best overall value to the Government, all factors considered.

The Government will award a contract resulting from this solicitation to the firm selected in accordance with the above procedures. The Government may reject any or all offers if such action is determined to be in the best interest of the Government. In the course of evaluating Offerors' proposals, the Source Selection Team (SST) may contact references submitted by the Offerors. The SST may also check past performance information obtained from sources other than those identified by the Offerors. All gathered information will be used to evaluate the Offerors’ overall past performance.

At no time during this process, or during the debriefing, or after award, will the names of individuals providing reference information about an Offeror's past performance be revealed to the Offerors or to any other party.

RATING DEFINITION NOTE

(E) Exceptional Performance meets contractual requirements and exceeds many to the Government/Owner’s benefit.

The contractual performance of the element or sub-element being assessed was accomplished with few minor problems for which corrective actions taken by the contractor was highly effective.

An Exceptional rating is appropriate when the Contractor successfully performed multiple significant events that were of benefit to the Government/Owner. A singular benefit, however, could be of such magnitude that it alone constitutes an Exceptional rating. Also, there should have been NO significant weaknesses identified.

(VG) Very Good Performance meets contractual requirements and exceeds some to the Government’s/Owner’s benefit. The contractual performance of the element or sub-element being assessed was accomplished with some minor problems for which corrective actions taken by the contractor were effective.

A Very Good rating is appropriate when the Contractor successfully performed a significant event that was a benefit to the Government/Owner. There should have been no significant weaknesses identified.

(S) Satisfactory Performance meets minimum contractual requirements. The contractual performance of the element or sub-element contains some minor problems for which corrective actions taken by the contractor appear or were satisfactory.

A Satisfactory rating is appropriate when there were only minor problems, or major problems that the contractor recovered from without impact to the contract.
