About this file
This is a federal contracting representation form (FAR 52.204-24) that requires offerors to disclose their use of covered telecommunications and video surveillance equipment or services.
The form mandates that offerors represent whether they will or will not provide covered telecommunications equipment or services to the Government in contract performance. Offerors must also represent, after conducting reasonable inquiry, whether they use covered telecommunications equipment or services as substantial or essential components of any systems they offer. The definitions of key terms—including backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component—are referenced in FAR 52.204-25. The prohibition, established by Section 889(a)(1)(A) and (B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019, restricts executive agencies from procuring or contracting for covered telecommunications equipment or services as substantial or essential components on or after August 13, 2020. Offerors must review the System for Award Management (SAM) exclusion list at https://www.sam.gov for entities prohibited from receiving federal awards for covered telecommunications equipment or services. If the offeror represents that it will provide such equipment or services, or if it uses such equipment or services, detailed disclosure information is required, including entity name, CAGE code, equipment or service descriptions, brand and model numbers, and explanations of proposed use and compliance with prohibitions. The form requires signature by the offeror or legally authorized representative.
