About this file
This is a Federal Acquisition Regulation (FAR) provision template titled "52.204-24 Representation Regarding Certain Telecommunications and Video Surveillance Services or Equipment" (October 2020). The provision implements Section 889 of the John S. McCain National Defense Authorization Act for Fiscal Year 2019, establishing prohibitions on federal procurement of covered telecommunications equipment and services.
The provision requires offerors to make two key representations: (1) whether they will provide covered telecommunications equipment or services to the Government in contract performance, and (2) whether they use covered telecommunications equipment or services in their operations, regardless of federal contract performance. Offerors must conduct a reasonable inquiry before responding. The provision defines covered telecommunications equipment or services as those from entities on the System for Award Management (SAM) exclusion list and establishes exceptions for third-party service connections (backhaul, roaming, interconnection arrangements) and equipment that cannot route or redirect user data traffic. Prohibitions are effective August 13, 2019 for equipment provision and August 13, 2020 for contractor use. Offerors responding affirmatively to either representation must provide detailed disclosures including entity information (name, unique identifier, CAGE code, OEM or distributor status), equipment descriptions (brand, model number, item description), and explanations of proposed use with factors supporting permissibility under the prohibition. The provision requires offeror name, date, and signature certification.
