About this file
This is a federal contracting representation provision (FAR 52.204-26) requiring offerors to certify their use of covered telecommunications equipment or services. The provision mandates that offerors review the System for Award Management (SAM) exclusion list at https://www.sam.gov to identify entities barred from federal awards for providing covered telecommunications equipment or services. Offerors must make two distinct representations: first, whether they provide covered telecommunications equipment or services as part of their offered products or services to the Government; and second, after conducting a reasonable inquiry, whether they use covered telecommunications equipment or services or any equipment, system, or service incorporating such covered items. The definitions of "covered telecommunications equipment or services" and "reasonable inquiry" are cross-referenced to FAR clause 52.204-25.
The provision requires offerors to execute the representation by checking appropriate boxes for each statement and providing their name, date, and signature. This is a template document used in federal solicitations to enforce restrictions on certain telecommunications and video surveillance equipment, particularly items sourced from entities subject to procurement prohibitions under federal security regulations.
