E.5 FAR 52.212-2 EVALUATION – COMMERCIAL – SIMPLIFIED ACQUISITION PROCEDURES
EVALUATION OF QUOTES
(a) Evaluations will be conducted in accordance with FAR Part 13 – Simplified Acquisition Procedures. The Government will award a purchase order resulting from this solicitation to the responsible offeror (see FAR 9.104-1) whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The award decision will be based on lowest-priced technically acceptable (LPTA) basis. The following factors shall be used to evaluate offers:
1. Technical
0. Brand Name: Brand Name items listed in the solicitation will be evaluated to verify the items meet the salient characteristics identified in the solicitation. This evaluation will be based on documentation the offeror provides with the quote. The Government is under no obligation to seek out information other than what the offeror provides with the quote. Quotes that do not provide sufficient information to determine an item meets the salient characteristic requirements will be considered technically unacceptable and ineligible for award. Partial quotes will not be considered. The government intends to award one purchase order for this requirement. Therefore, all items in the offer must meet the technical requirements for the offer to be considered for award.
0. Authorized distributor (or similar) documentation is provided with the quote to verify the OEM’s commercial warranty and warranty services will be honored (e.g. authorized distributor letters, teaming agreements, or similar verifiable documentation). Quotes that cannot be determined to include OEM commercial warranty coverages for the items will be determined to be technically unacceptable. The offeror is responsible for providing this documentation with the quote. The Government is under no obligation to seek out additional information over and above what is submitted with the quote.
1. Past Performance
1. SDVOSB/VOSB Credit
1. Price
(b) All Offerors are advised that, in the interest of efficiency, the Government reserves the right to conduct the evaluation in the most effective manner. Specifically, the Government may first evaluate the total proposed price of all Offerors. Thereafter, the Government may evaluate the technical quotation of the lowest priced Offeror only. If the lowest priced Offeror’s technical quotation is determined to be rated as Acceptable and the offeror is determined to be responsible, the Government may make award to that Offeror without further evaluation of the remaining Offerors’ technical quotations. If the lowest priced Offeror’s technical quotation is determined to be rated as Unacceptable or cannot be determined responsible, then the Government may evaluate the next lowest priced technical quotation, and so forth and so on, until the Government reaches the lowest priced technical quotation that is determined to be rated as Acceptable. However, the Government reserves the right to evaluate all Offerors’ technical quotations should it desire to conduct discussions, or otherwise determine it to be in the Government’s best interest.
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
