About this file
This is an addendum to FAR 52.212-2 that establishes the evaluation criteria and award methodology for a commercial items solicitation issued by the Department of Veterans Affairs Veterans Health Administration Veterans Integrated Service Network 9 for an Audio Visual Console Upgrade (Solicitation Number 36C24C26Q0023). The Government will award the contract to the responsible offeror whose conforming offer provides the best overall value, evaluated through a comparative analysis of quotations in accordance with FAR 12.203. Award will not necessarily be made to the lowest-priced offer, and the Government reserves discretion to interact with only the best-suited offeror(s) regarding remaining issues. Missing or incomplete information will count against offerors in award determination.
The evaluation approach comprises three primary criteria: Technical (including understanding of the problem, feasibility of approach, required certification or authorized distributor documentation, and completeness of response); Past Performance (including Contractor Performance Assessment Reporting System data and other sources); and Price (using firm fixed price analysis with comparative price analysis to determine fair and reasonable pricing). For pricing evaluation, the Government will sum all line-item prices for the basic requirement and add option period pricing, including pricing for a potential 6-month extension option under FAR 52.217-8 and term extension options under FAR 52.217-9, to calculate the Total Evaluated Price. Significantly unbalanced option pricing may render an offer unacceptable. The evaluation and exercise of options will not obligate the Government to exercise the option periods.

?.## ADDENDUM to FAR 52.212-2 EVALUATION--COMMERCIAL ITEMS
Provisions that are incorporated by reference (by Citation Number, Title, and Date), have the same force and effect as if they were given in full text. Upon request, the Contracting Officer will make their full text available.
The following provisions are incorporated into 52.212-2 as an addendum to this solicitation:
(a) Basis of Award
The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government.
The Government will perform a comparative evaluation of offers in accordance with Federal Acquisition Regulation (RFO) 12.203 – Evaluation of Quotations or Offers. The Government will evaluate all quotes, compare them to one another, and will award a contract to the responsible Offeror (see RFO 9.104-1 General Standards) whose offer conforms to the solicitation and is most advantageous to the Government. Considering several factors, the offer shall represent the best overall value to the Government at a price that can be determined reasonable. The Government is not required to identify the relative weight of the evaluation factors, hold discussions, or use other FAR Part 15 procedures. Reference RFO 12.203 Evaluation of Quotations or Offers. The Government Project Leads, Contracting Officer’s Representative (COR), and Contracting Officer (CO) will select for award the quote determined to represent the best benefit to fulfill the Government’s requirement.
Options. The Government will evaluate for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
A written notice of award or acceptance of an offer, mailed or otherwise, furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are interactions after its receipt, unless a written notice of withdrawal is received before award.
Offerors are cautioned that the award may not necessarily be made to the lowest price offered or the most highly rated technical package. The Government reserves the right to select a response that, in providing the benefit to the Government, exceeds the minimum requirements, but is not required to do so. While responses may exceed the requirements, the Government is not requesting or accepting alternate quotes, as each response must respond to the Statement of Work (SOW)/Performance Work Statement (PWS) requirements.
Once the Government determines there is(are) a contractor(s) that can provide the items that meet the requirements of this RFQ/RFP, the Government reserves the right to interact with only the identified offeror(s) providing the best-suited quote to address any remaining issues, if any.
Please note, missing or incomplete information shall count against the Offeror in determination of award.
(a) Evaluation Approach
The Government’s comparative evaluations will be based on the following criteria:
1. Technical
Part 1: Technical Technical evaluations will be based on the information contained in the SOW/PWS and will include, but not necessarily limited to: the Offeror’s demonstration of its ability to meet the requirements, the degree to which the technical submission describes a detailed technical/management approach for accomplishing each task and addresses all aspects associated with the tasks, and whether the Offeror’s solution meets the certification requirements.
a) Understanding of the Problem: The quote will be evaluated to determine the extent to which it demonstrates a clear understanding of all features involved in solving the problems and meeting the requirements presented in the solicitation and the extent to which uncertainties are identified and resolutions proposed.
b) Feasibility of the Approach: The quote will be evaluated to determine the extent to which the proposed approach is workable and the end results achievable. The quote will be evaluated to determine the level of confidence provided the Government with respect to the Offeror’s methods and approach in successfully meeting and/or exceeding the requirements in a timely manner.
c) Certification/Authorized Distributor Letter: The Offeror shall include a copy of the authorization from the manufacturer that provides acknowledgement the Offeror is an authorized distributor/dealer of the equipment or products if the Offeror is not the Original Equipment Manufacturer (OEM), see Grey Market in Technical content (above).
d) Completeness: The quote will be evaluated to determine whether the Offeror’s methods and approach have adequately and completely considered, defined, and satisfied the requirements specified in the solicitation. The quote will be evaluated to determine the extent to which each requirement has been addressed (i.e., met and/or exceeded) in accordance with the quote submission instructions of the solicitation.
2. Past Performance: This may include reviewing performance information reported to the Contractor Performance Assessment Reporting System, as well as other sources of information.
3. Price: Firm Fixed Price: The Offeror's price quote for each task identified in the attached pricing schedule will be evaluated with respect to the quoted/proposed price for each line item to determine ability to fully meet the solicitation’s requirements. The Government will evaluate offers by adding the total of all line-item prices. The total evaluated price will be that sum. Comparative price analysis will be used to determine that the prices are fair and reasonable and realistic in accordance with RFO 12.204. The Government will determine if the quoted/proposed price is fair and reasonable.
FAR 52.217-8, Option to Extend Services applies to this solicitation. As such, evaluation of options under RFO 52.217-8 will also include using the prices offered for the last ordering period to determine the price for an additional 6-month option period in the event an extension is issued under RFO 52.217-8. The Offeror’s total quoted/proposed price for all option periods and the additional 6-month option period price will then be added together to arrive at the Offeror’s Total Evaluated Price. The Total Evaluated Price will be that sum. In addition, RFO 52.217-9, Option to Extend the Term of the Contract applies to this solicitation. As such, evaluation of options under RFO 52.217-9 will be used to evaluate the total price. NOTE: Evaluation of options will not obligate the Government to exercise the option(s).
