About this file

This document is FAR 52.212-2, the evaluation criteria provision for Solicitation W900KK-26-R-A023, an Agile Professional Services (APS) contract for the Capability Program Executive Simulation, Training, Test and Threat (CPE ST3) enterprise. The Government will award the contract to the responsible offeror whose proposal represents the best value using a three-phased evaluation approach, with award based on the lowest Total Evaluated Price among offerors rated Acceptable on all non-price factors.

The solicitation employs a sequential multi-phase source selection requiring offerors to submit cumulative deliverables across three phases. Phase I evaluates the written Agile Implementation Plan, Key Personnel qualifications, Cybersecurity Compliance (NIST SP 800-171 Revision 2 with a mandatory 110-score requirement), and Organizational Conflict of Interest Mitigation Plan. Phase II includes oral presentations addressing implementation alignment with the SOO and scenario injects demonstrating real-time triage and continuity of operations capabilities. Phase III evaluates the proposed Performance Work Statement, Contract Data Requirements Lists, Quality Assurance Surveillance Plan, Transition Plan, and price proposals. A single Unacceptable rating on any subfactor renders the entire submission Non-Compliant. The evaluation requires offerors to demonstrate executable operational approaches to Agile implementation across multiple dimensions, including cultural change management, dynamic resource allocation, backlog prioritization, manpower efficiency, and commercial business model translation. Key Personnel must have minimum five years' program management experience leading Agile teams, current advanced Agile certifications, hands-on Jira experience, and eligibility for Top Secret/SCI clearances. The QASP must establish specific Acceptable Quality Levels for workforce availability with 20-calendar-day backfill requirements, live dashboard surveillance capabilities, 95% financial accuracy standards, and formal corrective action procedures. The Transition Plan must address 90-day phase-in schedules, workforce clearance procedures, knowledge transfer methodologies, and risk mitigation strategies for 24/7/365 operations at Redstone Arsenal, Alabama.

52.212-2 Evaluation—Commercial Products and Commercial Services.

As prescribed in 12.301(c), the Contracting Officer may insert a provision substantially as follows:

Evaluation—Commercial Products and Commercial Services (Nov 2021)

(a) The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The Government intends to evaluate proposals and select the best-value Offeror using a Three-Phased evaluation approach under the commercial services procedures of FAR 52.212-2

“Evaluation – Commercial Products and Commercial Services”.

Volume 1 - Factor 1 – Technical

Subfactor 1.a – Agile Implementation Plan

Subfactor 1.b – Key Personnel

Subfactor 1.c – Cybersecurity Compliance Gate

Subfactor 1.d - Technical Presentation and Agile Scenarios –

• Part 1 - Implementation and Alignment with Subfactor 1.a – Agile

Implementation Plan and SOO Oral Presentation Slides

• Part 2 - Oral Presentation with Government provided Scenario Injects

Subfactor 1.e - Proposed Performance Work Statement (PWS), CDRLs and Quality Assurance Surveillance Plan (QASP)

Subfactor 1.f – Transition Plan

Compliance Matrix (Not Evaluated)

Volume 2 - Factor 2 – Organizational Conflict of Interest (OCI) Mitigation Plan

Volume 3 - Factor 3 – Cost/Price

Evaluation Procedures: The evaluation phases are structured as follows:

To receive an overall Acceptable rating for the Agile Professional Services Source

Selection, an Offeror must submit all three sequential phases and receive an

Acceptable rating on every single factor and subfactor. A single Unacceptable rating at any point renders the entire technical submission Non-Compliant.

Multi-Phased Source Selection Procedures: The Government will utilize a multi-phased source selection procedure for the Agile Professional Services Source

Selection. Offerors must submit sequential deliverables where each subsequent phase https://www.acquisition.gov/far/12.301#FAR_12_301

Attachment 03: FAR 52.212-2 Evaluation Criteria for Agile Professional Services Solicitation W900KK-26-R-A023 directly builds upon the previous submissions. A complete submittal consists of cumulative submissions from Phase I, Phase II, and Phase III.

During the evaluation, each individual subfactor assessed throughout these phases will receive a rating of either Acceptable or Unacceptable.

At the conclusion of Phase III, the Government will roll up all individual subfactor ratings to determine the final overall rating for each Factor under the Agile Professional

Services Source Selection. To achieve an overall rating of Acceptable at the Factor

Level, an Offeror must receive an Acceptable rating in every underlying subfactor. If any single subfactor is rated as Unacceptable at any point in the process, the entire Agile

Professional Services Source Selection rating will be deemed Non-Compliant.

• Phase I: Evaluates the written Agile Implementation Plan (Subfactor 1.a), Key

Personnel (Subfactor 1.b), Cybersecurity Compliance Gate (Subfactor 1.c)

(including the National Institute of Standards and Technology Special Publication

(NIST SP) 800-171 Rev 2 gate), and the OCI Mitigation Plan (Factor 2) on an

Acceptable/Unacceptable basis.

• Phase II: Evaluates the Technical Presentation and Agile Scenarios – Part 1 -

Implementation and Alignment with Subfactor 1.a – Agile Implementation Plan and SOO Oral Presentation Slides (Subfactor 1.d); and Part 2 - Oral Presentation with Government provided Scenario Injects (Subfactor 1.d) on an

Acceptable/Unacceptable basis.

• Phase III: Evaluates the proposed PWS, CDRLs, QASP (Subfactor 1.e), and the

Transition Plan (Subfactor 1.f) on an Acceptable/Unacceptable basis, and the

Price Proposal (Factor 3) in accordance with FAR 15.404 – Proposal Analysis.

*NOTE: “Advisory Down-Select notification”: The Government will contact those who are “unlikely to be a viable competitor and recommend they withdraw” after Phase I, and subsequently after Phase II, to recommend that they withdraw their proposal from the competition. No formal down-select will be conducted. All applicable Offerors may compete in all Phases if they choose to do so.

Award will be made to the responsible Offeror whose proposal conforms to the solicitation requirements, is rated "Acceptable" across all non-price factors and subfactors and represents the best value to the Government.

Relative Order of Importance:

The prospective awardee shall be determined to be the Offeror with the lowest Total

Evaluated Price (as calculated in the provided APS Pricing Workbook) that has received an “Acceptable” rating under all other non-price Factors (Factor 1 (Technical), and

Factor 2 (OCI Mitigation Plan)).

Attachment 03: FAR 52.212-2 Evaluation Criteria for Agile Professional Services Solicitation W900KK-26-R-A023

(b) PHASE I EVALUATION

The Government will contact those Offerors who do not achieve an “Acceptable”

Rating on all elements under Phase I and are determined “unlikely to be a viable competitor and recommend they withdraw” before proceeding to Phase II.

The OCI Mitigation Plan must specifically address and provide comprehensive mitigation strategies for the following three OCI categories as well as the information in Section 8 of the APS_Combined

Synopsis :

1. Unequal Access to Information: Occurs when a contractor has access to non-public, sensitive, or proprietary information as part of its performance of a Government contract, and that information provides the contractor with an unfair competitive advantage in a later competition.

Attachment 03: FAR 52.212-2 Evaluation Criteria for Agile Professional Services Solicitation W900KK-26-R-A023

2. Biased Ground Rules: Occurs when a contractor, in the course of performance, drafts or influences specifications, Statements of Objectives

(SOOs), Statements of Work (SOWs), Program Objective Memorandum

(POM), or acquisition plans for a future procurement, thereby biasing the competition in favor of its own capabilities, tools, or those of an affiliate.

3. Impaired Objectivity: Occurs when a contractor’s work under one

Government contract requires it to evaluate its own products, services, or performance (or those of a competitor, teammate, or affiliate) on another

Government contract, thereby impairing its ability to render impartial, objective advice.

i. To be rated Acceptable: The Offeror’s plan provides a complete and logical identification of all potential or actual OCIs relevant to the requirement. The Offeror’s plan addresses all three required OCI categories: Unequal Access to Information, Biased Ground Rules, and Impaired Objectivity. The Offeror’s plan provides comprehensive and feasible mitigation strategies for each category that demonstrate the offeror’s ability to avoid, neutralize, or mitigate conflicts. The

Offeror’s plan clearly explains processes, controls, firewalls, organizational structures, staffing approaches, or other mechanisms used to prevent OCI risks. The Offeror’s demonstrates that the mitigation strategies are consistent with FAR Subpart 9.5. The

Offeror’s plan adequately incorporates all required information referenced in Section 8 of the APS Combined Synopsis Solicitation.

The Offeror’s plan contains no internal contradictions or missing elements that would prevent successful execution of mitigation measures.

ii. To be rated Unacceptable: The Offeror’s plan fails to identify potential or actual OCIs associated with this requirement. Omits one or more of the three required OCI categories (Unequal Access to

Information, Biased Ground Rules, Impaired Objectivity). Provides mitigation strategies that are incomplete, infeasible, or inconsistent with FAR Subpart 9.5. Does not demonstrate adequate measures or controls to avoid, neutralize, or mitigate OCI risks. Fails to include the required information described in Section 8 of the APS Combined

Synopsis Solicitation. Presents conflicting, vague, or insufficient mitigation mechanisms that leave residual OCI concerns.

Demonstrates that the offeror would be unable to perform without creating an unmitigated OCI.

Attachment 03: FAR 52.212-2 Evaluation Criteria for Agile Professional Services Solicitation W900KK-26-R-A023
