About this file
This document is a source selection and evaluation criteria addendum to FAR 52.212-2 for commercial products and services acquisition. The Government will award a firm fixed price (FFP) contract on a Lowest Price Technically Acceptable (LPTA) basis to the responsible quoter whose quotation conforms to solicitation requirements, is determined technically acceptable, and offers the lowest total evaluated price.
Quoters must meet all solicitation requirements including terms, conditions, technical specifications, and pricing instructions, or face removal from contract consideration. Technical evaluation will be binary—Acceptable or Unacceptable—based on compliance with Performance Work Statement (PWS) requirements outlined in paragraphs 2.1, 2.1.1, 2.1.1.1 through 2.1.1.8, and 2.2 with subparagraphs 2.2.1 through 2.2.4. Only technically acceptable quotations will be considered for award. Price will be evaluated separately through reasonableness analysis per FAR 12.203 and applicable DFARS Part 212 class deviations, with total evaluated price calculated as the sum of all quoted prices across all identified CLINs. Quoters must submit pricing for both the base period and all option periods; significantly unbalanced option pricing may render an offer unacceptable. The Contracting Officer may exercise options by written notice within 30 days of contract expiration, with total option extensions not exceeding six months. Additionally, all proposed Information and Communication Technology (ICT) items must be compliant with Section 508 accessibility standards, with the Government reserving the right to conduct pre-acceptance testing to validate conformance claims.

FAR 52.212-2, ADDENDUM to EVALUATION OF COMMERCIAL PRODUCTS AND
COMMERCIAL SERVICES (NOV 2021)
1. QUOTE EVALUATION:
To be eligible to receive a contract, Quoter’s are required to meet all solicitation requirements, such as terms and conditions, and technical and pricing instructions. Failure to comply with all solicitation requirements and instructions may result in the Quoter being removed from further contract consideration.
The Government intends to award a firm fixed price (FFP) contract resulting from this solicitation to the Quoter whose quote provides the best value to the Government in accordance with Federal Acquisition Regulation (FAR) Part 12 (Acquisition of Commercial Products and Commercial Services). To make the award decision, the Government will consider two evaluation factors: (1) Technical approach, and (2) Price.
Note: Section 508 Acceptance:
1. Prior to acceptance, the Government reserves the right to perform testing on required ICT items to validate the Quoter’s Section 508 conformance claims. If the government determines that Section 508 conformance claims provided by the Quoter represents a higher level of conformance than what is actually provided to the agency, the government shall, at its option, require the Quoter to remediate the item to align with the Quoter’s original Section 508 conformance claims prior to acceptance.
2. Quoter may be ineligible for contract award if proposed ICT products or services are not compliant with Section 508 standards.
2. EVALUATION CRITERIA:
Basis for Award: A FFP award will be made on a Lowest Price Technically Acceptable (LPTA) basis to the responsible quoter whose quotation conforms to the solicitation requirements, is determined technically acceptable, and offers the lowest total evaluated price. Technical acceptability will be evaluated on an Acceptable/Unacceptable basis. Only quotations determined technically acceptable will be considered for award, and award will be made to the technically acceptable quoter with the lowest total evaluated price.
. Evaluations will be conducted in accordance with the evaluation criteria below:
1. Factor 1 – Technical Approach
The Government will evaluate the technical capability of each quote by reviewing the extent to which the proposed solution demonstrates compliance with the requirements of the Performance Work Statement (PWS). As part of this assessment, the Government will evaluate each Quoter’s proposed web-based solution for compliance with the requirements outlined in paragraphs 2.1; 2.1.1; 2.1.1.1 through 2.1.1.8; and 2.2, including subparagraphs 2.2.1 through 2.2.4, of the Performance Work Statement (PWS)
The ratings used for Factor 1 are defined as follows
Adjectival Rating Description Acceptable Quote meets the requirements of the solicitation Unacceptable Quote does not meet the requirements of the solicitation
2. Factor 2 – Price
Price will be evaluated separately from technical factors. Quoter’s total quoted price will be evaluated for reasonableness in accordance with FAR 12.203 and applicable DFARS Part 212 class deviations. The Government will establish a total evaluated price based on the sum of all prices quoted. The Government may use one or more price analysis techniques. Incomplete pricing submissions may result in rejection.
Quoter shall complete the pricing information on all CLINs identified under this solicitation in Attachment 4 – Pricing. Each CLIN will be evaluated separately.
OPTIONS. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the base period. The Quoter shall submit pricing for the base period and all option periods. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).”
FAR 52.217-8. The Government may require continued performance of any services within the limits of, and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to the prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 30 days of contract expiration.
