FY14 CENTAM AND CARIBBEAN PROCUREMENT

1.0 MISSION OBJECTIVE.

The DoD Counter Narco-terrorism Program Office (CNTPO), currently being managed by the Counter Narcotics and Global Threats (CNGT) Division, was established to create worldwide Counter Narcotics Technology (CNT) networks, infrastructures, and capabilities that are focused on the detection, identification, and disruption of narcotics activities and organizations. This task effort will support the War Fighter in combating narcotics activities globally.

2.0 SCOPE.

2.1 Task Order (T/O) Objective.

The Task Order (T/O) objective is to provide and deliver CN support equipment for Central American (CENTAM) and Caribbean (CARIB) nations to include, but not limited to Belize, Dominican Republic, El Salvador, Guatemala, Honduras, Nicaragua, and Panama. Procurement items include Ford F-450 trucks, Night Vision Devices, and Workshop Tools among others.

2.2 Basic Contract References.

This T/O PWS establishes the requirements for the contractor to provide support in the Basic Contract task areas of 4.3.2 Training, Operations, and Logistics Support, 4.3.2.7 Logistics Support and Equipment, 4.3.2.8 Preservation, Packing and Marking, 4.3.2.9 Training, 4.3.3 Professional and Executive Support, and 4.3.3.4 Material and Equipment Purchase.

3.0 PERFORMANCE REQUIREMENTS.

The contractor shall provide, deliver, and ensure receipt and turn-over acceptance of all equipment set forth in this T/O to the delivery locations specified in the appropriate appendix. The contractor shall propose two separate deliveries per country (where applicable). One delivery shall contain short lead time/non-ITAR equipment, while the next delivery shall contain the long lead time/ITAR-controlled equipment. The contractor shall assume that VAT, and all other taxes, will be waived unless the equipment was procured within the country of final delivery, or from a bonded warehouse within that country.

Ordered items shall be delivered in a single shipment to each delivery location unless the contractor can demonstrate value to the USG for a multiple delivery approach. Partial shipments of ordered items are not authorized unless preapproved or requested by the Contracting Officer (KO). Any change in the FOB address shall be agreed to by the KO and the prime contractor in writing.

3.1 BASE REQUIREMENT – F450s/Thermal Binoculars/Night Vision Goggles (NVGs).

The contractor shall provide, deliver and ensure receipt and turn-over acceptance of all equipment listed in the attached ‘Appendix 1’. Unless specifically stated as ‘Brand Name Only’, items shall be ‘Brand Name or Equivalent’.

3.2 OPTION A – Boat/Tent System/Tire Lift Truck.

The contractor shall provide, deliver and ensure receipt and turn-over acceptance of all equipment listed in the attached ‘Appendix 2’. Unless specifically stated as a ‘Brand Name Only’, items shall be ‘Brand Name or Equivalent’.

3.3 OPTION B – Industrial Equipment.

The contractor shall provide, deliver and ensure receipt and turn-over acceptance of all equipment listed in the attached ‘Appendix 3’. Unless specifically stated as a ‘Brand Name Only’, items shall be ‘Brand Name or Equivalent’.

3.4 OPTION C – 4x4 Utility Trucks/Mobile Phone Accessories.

The contractor shall provide, deliver and ensure receipt and turn-over acceptance of all equipment listed in the attached ‘Appendix 4’. Unless specifically stated as a ‘Brand Name Only’, items shall be ‘Brand Name or Equivalent’.

3.5 OPTION D – 1000 Gallon Fuel Trailers.

The contractor shall provide, deliver and ensure receipt and turn-over acceptance of all equipment listed in the attached ‘Appendix 5’. Unless specifically stated as a ‘Brand Name Only’, items shall be ‘Brand Name or Equivalent’.

3.6 OPTION E – M4/M9 Equipment/Survival Beacons/GPS/Ballistic Helmets/CT-40 Kits.

The contractor shall provide, deliver and ensure receipt and turn-over acceptance of all equipment listed in the attached ‘Appendix 6’. Unless specifically stated as a ‘Brand Name Only’, items shall be ‘Brand Name or Equivalent’.

3.7 OPTION F – Thermal Binoculars/NVGs.

The contractor shall provide, deliver and ensure receipt and turn-over acceptance of all equipment listed in the attached ‘Appendix 7’. Unless specifically stated as a ‘Brand Name Only’, items shall be ‘Brand Name or Equivalent’.

3.8 OPTION G –Workshop Tools.

The contractor shall provide, deliver and ensure receipt and turn-over acceptance of all equipment listed in the attached ‘Appendix 8’. Unless specifically stated as a ‘Brand Name Only’, items shall be ‘Brand Name or Equivalent’.

3.9 OPTION H – Ballistic Flotation Vests/Miscellaneous Equipment.

The contractor shall provide, deliver and ensure receipt and turn-over acceptance of all equipment listed in the attached ‘Appendix 9’. Unless specifically stated as a ‘Brand Name Only’, items shall be ‘Brand Name or Equivalent’.

3.10 OPTION I – Aircrew Survival Vests/Body Armor.

The contractor shall provide, deliver and ensure receipt and turn-over acceptance of all equipment listed in the attached ‘Appendix 10’. Unless specifically stated as a ‘Brand Name Only’, items shall be ‘Brand Name or Equivalent’.

3.11 OPTION J – Pickup Trucks.

The contractor shall provide, deliver and ensure receipt and turn-over acceptance of all equipment listed in the attached ‘Appendix 11’. Unless specifically stated as a ‘Brand Name Only’, items shall be ‘Brand Name or Equivalent’.

3.12 OPTION K – 1000 Gallon Fuel Trailers/Weapons Accessory Equipment.

The contractor shall provide, deliver and ensure receipt and turn-over acceptance of all equipment listed in the attached ‘Appendix 12’. Unless specifically stated as a ‘Brand Name Only’, items shall be ‘Brand Name or Equivalent’.

3.13 OPTION L – Tool Kits/Miscellaneous Equipment/Gear.

The contractor shall provide, deliver and ensure receipt and turn-over acceptance of all equipment listed in the attached ‘Appendix 13’. Unless specifically stated as a ‘Brand Name Only’, items shall be ‘Brand Name or Equivalent’.

3.14 OPTION M –Deleted.

3.15 OPTION N – 1000 Gallon Fuel Trailer.

3.16 OPTION O – 1000 Gallon Fuel Trailer/Water Purification/Ballistic Vests/Diving Supplies/Warrior Kits.

The contractor shall provide, deliver and ensure receipt and turn-over acceptance of all equipment listed in the attached ‘Appendix 16’. Unless specifically stated as a ‘Brand Name Only’, items shall be ‘Brand Name or Equivalent’.

3.17 OPTION P – Ballistic Vests and Helmets/Boat Fenders/GPS.

The contractor shall provide, deliver and ensure receipt and turn-over acceptance of all equipment listed in the attached ‘Appendix 17’. Unless specifically stated as a ‘Brand Name Only’, items shall be ‘Brand Name or Equivalent’.

3.18 OPTION Q – Helicopter Insert/Extract Rope/Helmet Mount/NVG Test Kit/1000 Gallon Fuel Trailer.

The contractor shall provide, deliver and ensure receipt and turn-over acceptance of all equipment listed in the attached ‘Appendix 18’. Unless specifically stated as a ‘Brand Name Only’, items shall be ‘Brand Name or Equivalent’.

3.19 OPTION R – Communications Equipment/GPS.

The contractor shall provide, deliver and ensure receipt and turn-over acceptance of all equipment listed in the attached ‘Appendix 19’. Unless specifically stated as a ‘Brand Name Only’, items shall be ‘Brand Name or Equivalent’.

3.20 OPTION S – Miscellaneous Equipment/Gear.

The contractor shall provide, deliver and ensure receipt and turn-over acceptance of all equipment listed in the attached ‘Appendix 20’. Unless specifically stated as a ‘Brand Name Only’, items shall be ‘Brand Name or Equivalent’.

3.21 OPTION T – Miscellaneous Equipment/Tools/Camera/Gear.

The contractor shall provide, deliver and ensure receipt and turn-over acceptance of all equipment listed in the attached ‘Appendix 21’. Unless specifically stated as a ‘Brand Name Only’, items shall be ‘Brand Name or Equivalent’.

3.22 OPTION U – Heavy Duty Pick-up Truck.

The contractor shall provide, deliver and ensure receipt and turn-over acceptance of all equipment listed in the attached ‘Appendix 22’. Unless specifically stated as a ‘Brand Name Only’, items shall be ‘Brand Name or Equivalent’.

3.23 OPTION V – NVGs.

The contractor shall provide, deliver and ensure receipt and turn-over acceptance of all equipment listed in the attached ‘Appendix 23’. Unless specifically stated as a ‘Brand Name Only’, items shall be ‘Brand Name or Equivalent’.

3.24 OPTION W – Miscellaneous Marine Equipment/Camera.

The contractor shall provide, deliver and ensure receipt and turn-over acceptance of all equipment listed in the attached ‘Appendix 24’. Unless specifically stated as a ‘Brand Name Only’, items shall be ‘Brand Name or Equivalent’.

3.25 OPTION X – Outboard Engines.

The contractor shall provide, deliver and ensure receipt and turn-over acceptance of all equipment listed in the attached ‘Appendix 25’. Unless specifically stated as a ‘Brand Name Only’, items shall be ‘Brand Name or Equivalent’.

3.26 OPTION Y – Weather Radar System.

The contractor shall provide, deliver and ensure receipt and turn-over acceptance of all equipment listed in the attached ‘Appendix 26’. Unless specifically stated as a ‘Brand Name Only’, items shall be ‘Brand Name or Equivalent’.

3.27 OPTION Z – JPAT Guatemala Vehicle.

The contractor shall provide, deliver and ensure receipt and turn-over acceptance of the vehicle listed in the attached ‘Appendix 27’. Unless specifically stated as a ‘Brand Name Only’, items shall be ‘Brand Name or Equivalent’.

3.28 The contractor shall be responsible for all associated taxes, duties and customs fees, and other related charges.

3.29 The contractor shall also be responsible for all aspects of export compliance, including compliance with the Arms Export Control Act and International Traffic in Arms Regulations (ITAR).

3.30 The contractor shall ensure the appropriate Technical Assistance Agreements (TAAs) and/or applicable export licenses are in place before conducting any activity under this task order that requires such approval and documentation.

3.31 All materials shall be of good quality and durability according to commercially accepted quality standards for similar products. All equipment shall be new. All equipment shall be supplied with OEM use and maintenance manuals in Latin American Spanish language when available.

3.32 The contractor shall obtain provide approval to transfer license, maintenance, and warranties from the US Government to the Government in which the equipment will be delivered in accordance with the manufacturer End User Agreement (EULA); (A00E).

4.0 WORK HOURS AND LOCATION.

The principal place of performance for this T/O shall be Central America and the Caribbean. The contractor may be required to provide labor hours in excess of 40 hours per work week to include holiday and weekends, and/or during irregular times and shifts based upon CNTPO operations and exercises.

5.0 OTHER PERFORMANCE REQUIREMENTS.

5.1 Defense Base Act (DBA) Insurance.

DBA insurance is required for all personnel performing work OCONUS under this task order.

5.2 Meetings, Briefing, Publications.

The contractor shall participate in technical interchange meetings, to be scheduled upon request of the responsible Contracting Officer or written designee, to discuss and to informally evaluate the contractor’s efforts and accomplishments in direct relation to specific T/O’s. During the meetings, the contractor shall present necessary data to enable a joint review of its various assigned tasks, attendant schedules, and resource expenditures. The contractor shall present and participate in technical discussions and shall inform, in a timely fashion, the Program Manager (PM), the Contracting Office Representative (COR) and the Contracting Officer (KO) of any problems with contract execution and any proposed solutions. The contractor shall attend and participate in other meetings, as scheduled by the responsible Contracting Officer or written designee.

6.0 TEMPORARY DUTY TRAVEL (TDY).

The contractor shall perform TDY non-local travel, as required in the performance of this T/O, as directed by the TM. The Contractor shall provide the performance of this task order Outside the Continental United States (OCONUS). Specific countries include, but are not limited to, Panama, Belize, Nicaragua, Honduras, El Salvador, Peru, Guatemala, and the Dominican Republic. All travel required and approved under this T/O will be paid IAW the Basic Contract by reimbursement to the contractor. The contractor shall ensure that all OCONUS travelers have a country approval to enter the country for this mission as well as a Letter of Authorization (LOA) approved by the KO prior to travel. Only required travel previously approved by the KO/COR/PM will be reimbursed under this T/O.

7.0 GOVERNMENT FURNISHED EQUIPMENT OR SERVICES (GFE/GFS).

None

8.0 SECURITY.

All work performed under this T/O shall be unclassified.

9.2 DATA REQUIREMENTS.

The contractor shall ensure that all employees in the SPOT database have a current DD Form 93, Record of Emergency Data Card, on file with both the contractor and the designated Government official.

9.3 Master Schedule (CDRL A00G).

The contractor shall provide a Master Project Schedule for Government approval. The contractor shall create, maintain and report the schedule in conjunction with the progress report after initial delivery. The schedule shall cover all phases of the project from kick off to task order close out. The contractor’s Master Schedule shall include; but not be limited to, the following information:

· Timeline for providing proposed staffing

· Timeline for procurement of equipment

· Timeline for development of the Integration and Implementation Plan (if applicable)

· Timeline for Installation and Integration (if applicable)

· Timeline for system Test and Acceptance (if applicable)

· Timeline for Training (if applicable)

· Repair Concept and Turn Around Schedule

· Milestones for T/O Deliverables

9.4 T/O Quality Control Plan (CDRL A00G).

The contractor shall provide a draft T/O Quality Control (QC) Plan with its response to the TORP. The final plan shall be provided within thirty (30) calendar days after the date of the task order award. At a minimum, the T/O QC Plan shall address the following:

· QC Execution: The plan shall not be cursory, but discuss specifically how the prime contractor shall execute its QC responsibilities. The T/O QC Plan shall include a clearly defined QC process, key performance indicators, QC schedules and QC personnel, by name, to include those that will be performing subcontractor oversight and oversight of activities in-theater. The plan shall address how QC trend analysis and tracking of corrective actions will accomplished. The T/O QC Plan shall discuss the prime's management activity that will provide oversight and involvement in the QC process. QC personnel should not be buried in the organization, but should have a direct line to upper management.

· Reporting: Monthly status reports shall specifically discuss QC activities over the reporting period and planned activities for the next period. Information shall specifically address WHO conducted the QC, WHEN was the QC executed, HOW was the QC executed and WHAT the findings and corrective actions were. Trends overtime shall be discussed.

· Invoice Quality Control and Review: The contractor shall discuss how invoice reviews will be conducted, to include discussion on how the primes, subcontractor and supplier supporting data will be reviewed for consistency with task order requirements and the contractor's approach to execute the task order.

9.5 Management Plan (CDRL A00G).

The contractor shall provide a management plan that shall define a management system to plan and control this T/O effort. The management plan must delineate how the contractor plans to accomplish the effort supporting the specific T/O, to include a breakout of Direct Productive Person Hours (DPPHs), travel, material, ODC, DBA Insurance, a milestone schedule, and a schedule for the planned expenditure of funds. The final plan shall be provided within forty-five (45) calendar days of the contract award.

9.6 Licenses, Export Agreements, and Certifications (CDRL A00H).

The contractor shall provide a cover letter describing the purpose of their submission, POC, Contract/TORP number, description of each enclosed attachment and should include original document(s) nomenclature (if revised). The attachments shall be originals or certified originals and be dated, signed by a cognizant authority and indicate specific agreement terms. The contractor shall provide an English translation of foreign language documents when applicable.

9.7 Contractor’s Progress Report (CDRL A002).

A comprehensive progress report shall be delivered monthly to the Program Manager (PM) and Contract Officer Reprehensive (COR). The report shall, at a minimum contain an overall schedule, the current status of funding on the T/O, accomplishments completed, any potential problems, and any lessons learned. These reports shall be delivered in accordance with CDRL A002 Expenditure Report of the Basic Contract. These reports are due no later than the seventh (7th) calendar day of each month.

9.8 Status Meetings (CDRL A003).

The contractor shall provide a status review either in person via teleconference or via electronic mail within ten (10) calendar days of a request by the KO, COR or PM. This will include a PowerPoint presentation which will address current status of the T/O, including a technical/management review, a financial review (at a minimum the status of invoicing), anticipated risks/risk mitigations, delivery status including anticipated dates, status of any export compliance/ITAR issues, Technical Assistance Agreements (if required), country clearance issues for personnel traveling OCONUS, anticipated modifications, etc.

9.9 Program Reviews (CDRL A004).

The contractor shall support Program Reviews (commonly called Program Management Reviews [PMR]) in support of CNTPO which will occur twice per calendar year, but may be scheduled as necessary. Formats for PMRs will be provided by the COR ahead of PMRs. In addition, the dates and locations will be announced well in advance of the meetings. In some cases, time will be allotted for the contractor to meet individually with representatives from CNTPO to discuss contractual issues.

9.10 Product Support Plan (CDRL A00E).

The contractor shall provide a Product Support Plan forty-five (45) calendar days prior to delivery/shipment. The plan shall describe a clear process that explains the acquisition, delivery, transfer, and end user product support for all items procured IAW this Task Order. Include:

· Roles and responsibilities of all entities involved in the acquisition, delivery, transfer and end user product support

· How items will be moved/transferred, from the manufacturer, through other parties, to the end user; include method of delivery (ex. ground, air, electronically) and delivery location(s). Identify documentation required to complete the movement/transfer of items and items that require an export license.

· Product/Equipment List; see example at Annex 1. Identify items that have a shelf life or expiration date.

· Warranty, maintenance agreement, software, software license, and software maintenance agreement details; see examples at Annex 2 and 3. Details shall include product/item covered (ex. make, model, lot number, serial number, key, etc); date coverage begins and ends; coverage period; where coverage is applicable (specify geographical location); type of warranty/license/agreement; registration process; and how to obtain service/support. Details shall be submitted for each coverage type (warranty, maintenance agreement, software, software license, and software maintenance agreement).

· Process for renewing coverage.

9.10.1 Warranty.

The contractor shall provide standard Original Equipment Manufacturer (OEM) warranties (noting above or beyond the warranties that come with the initial purchase) for all items procured IAW this Task Order. Warranties issued shall be the same warranty offered to the general public. Warranties shall become effective upon date of delivery to and acceptance by the US Government and upon signing the Form DD250. Upon delivery and acceptance it is the responsibility of the end user to register all warranties and follow the warranty process for communication, servicing, and/or exchange. All requirements for shipping a product to the OEM for warranty analysis or repair will be the responsibility of the End User. Include warranty details IAW PWS paragraph 9.10 Product Support Plan and Annex 2.
