1.0 MISSION OBJECTIVE.

The DoD Counter-Narcoterrorism Program Office (CNTPO) was established to create Counter-Narcoterrorism Technology (CNT) networks, infrastructure, and capabilities worldwide that are focused on the detection, identification, and disruption of narcoterrorist activities and organizations. This task effort will support the War Fighter in the combating of narco-terrorism worldwide.

2.0 SCOPE.

2.1 Task Order (T/O) Objective.

2.1.1 This T/O objective is to procure and deliver towable trailers for the Kazakhstan Border Guard Service (BGS) and Committee on Combating Drug Business (CCD) that are necessary to support ongoing CN training and operations efforts by the Ministry of Internal Affairs in the Republic of Kazakhstan.

2.1.2 Kazakhstan's proximity to Afghanistan, as well as other Central Asian states, has made it a major transit zone for Afghan opiates and heroin. Its porous southern border can be crossed easily in many locations using 4x4 trucks. The Kazakhstan Government is putting a significant amount of effort into strengthening its southern border, improving its legislation, its Tactics Techniques & Procedures and the professionalism of its law enforcement agencies.

2.2 Basic Contract References.

This T/O Performance Work Statement (PWS) establishes the requirements for the Contractor to provide support in the Basic Contract task areas of: 4.3.2.7 Logistics Support and Equipment and 4.3.3.4 Material and Equipment Purchase.

3.0 PERFORMANCE REQUIREMENTS.

3.1 Base Requirement – Towable Trailers for the BGS and the CCDB.

3.1.1 The Contractor shall procure, deliver and ensure receipt and turn-over acceptance to include documented itemized equipment list in the format specified in Appendix G to the BGS and the CCD, of all equipment listed in the applicable appendices as follows:

3.1.1.1 At a minimum the trailers shall be configured to contain the following as part of the proposed design:

· One (1) window per section in the trailer. Window size shall be consistent with the type of trailer proposed.

· One (1) ceiling light with corresponding light switch per section.

· Interior walls shall be of laminated paneling. Color to be light in order to maximize lighting.

3.1.1.2 The BGS requirement consists of three (3) towable trailers, one (1) of which shall be configured in accordance with (IAW) Appendix B, and the remaining two (2) shall be configured IAW Appendix C. The trailers shall have the capability of being towed by a “fifth wheel” trailer hitch assembly (see Figure 2) mounted on a URAL truck (Model 4320-1951-60-type, with KMU IM-240 crane unit (see Figure 1). All items, as described and specified by Appendices A and B shall be delivered in a single shipment to the location specified below, per general delivery details listed under paragraph 3.4. Points of contact for coordination of delivery for this equipment are listed in paragraph 3.4.2. All trailers, trailer contents, and equipment shall be complete and fully functional for immediate operation. The BGS Place of Delivery (POD) is as follows:

Military Unit 2201 Village of Umirzak Aktau, Mangistauskaya Region, Kazakhstan.

3.1.1.3 The CCD requirement consists of four (4) towable trailers, each of which shall have the configuration specified in Appendix D. The trailers shall have the capability of being towed by a KAMAZ truck (Model 43114-015-15) using a “ringfeder” type hitch (see Figure 3). All items, as described and specified by Appendix C, shall be delivered in a single shipment to the location specified below, per general delivery details listed under paragraph 3.4. Point of Contact (POC) for coordination of delivery for this equipment is listed in paragraph 3.4.2. All trailers, trailer contents, and equipment shall be complete and fully functional for immediate operation. The CCDB POD is as follows:

The Committee on Combating Drug Business Tole Bi Village of Shu District of Zhambyl Region, Kazakhstan.

3.2 Option A - Towable Trailers for the BGS.

The Contractor shall procure, deliver and ensure receipt and turn-over acceptance to include documented itemized equipment list in the format specified in Appendix G, to the BGS, of all equipment listed in the applicable appendices as follows:

3.3 Option B - Towable Trailers for the BGS.

The Contractor shall procure, deliver and ensure receipt and turn-over acceptance to include documented itemized equipment list in the format specified in Appendix G, to the BGS, of all equipment listed in the applicable appendices as follows:

3.4 General Delivery.

3.4.1 All items as described and specified within each appendix shall be delivered in a single shipment to the respective delivery location unless the Contractor can demonstrate significant value to the United States Government (USG) for a multiple delivery approach. Partial shipments of ordered items are not authorized unless preapproved by the Contracting Officer (KO). Any change to the POD address shall be approved by the KO via a modification to the T/O.

3.4.2 Final delivery of equipment and material shall be Free on Board destination. All equipment and material shall clear customs prior to delivery. Use of an in-country broker is highly encouraged to guarantee proper customs clearance and delivery.

3.4.3 The Contractor shall procure, deliver and ensure receipt and turn-over acceptance of all equipment and materials required by this T/O no later than 365 days after T/O award. The Contractor shall seek delayed delivery authorization from the KO should long-lead time items prevent meeting the required delivery deadline. The request for delayed delivery authorization shall be submitted to the USG as soon as the Contractor becomes aware of the potential delay.

3.4.4 Delivery Points of Contact (POC). The POCs for delivery coordination will be provided at the Kick-Off Meeting..

3.4.5 Compliance with Kazakhstan Permits & Licenses and Documentation. The company manufacturing the trailers shall be an authorized company licensed by the Government of Kazakhstan to manufacture and transport towable trailers on wheeled chassis on Kazakhstan roadways. The Contractor shall demonstrate that all delivery drivers are properly licensed and permitted to drive commercial vehicles in Kazakhstan. Costs associated with failure to be in compliance with Kazakhstan laws and have appropriate permits shall be the sole responsibility of the Contractor. It is strongly recommended, the Contractor partner with local vendors to mitigate this risk.

3.4.6 Life Support Services during Delivery. The Contractor shall be responsible for providing life support services (lodging and air/ground transportation) while in country for delivery.

3.4.7 Diplomatic Notice (DIP Note). To coordinate with Kazakhstan agencies, the USG must deliver the coordination in a DIP Note to the Kazakhstan government. The process requires 30 days. For instructions on the process see paragraph 10.6.

4.0 WORK HOURS AND LOCATION.

The principal places of performance shall be at the Contractor’s discretion for successful performance and delivery in the Mangistauskaya Region, Zhambyl Region, and District of Zhambyl Region, as well as the Town of Boralday in the Republic of Kazakhstan.

5.0 OTHER PERFORMANCE REQUIREMENTS.

5.1 Defense Base Act (DBA) Insurance. The Contractor shall provide DBA insurance for all personnel performing duties outside the continental United States (OCONUS).

5.2 Taxes and Fees Agreements.

5.2.1 Value Added Tax (VAT), Customs, Duties. The Contractor shall be responsible for all associated taxes (e.g. Value Added Tax (VAT)), duties and customs fees, and other related charges. Historically Kazakhstan has had very high (est. 20%) customs fees and taxes for the importation and delivery of material that is not accepted as locally or regionally produced. At this time, waivers or exemptions are not available to preclude the payment of the VAT tax. Waivers or exemptions shall be documented before shipment if they become available

5.2.2 Arms Export Control Act and International Traffic in Arms Regulations (ITAR). The Contractor shall also be responsible for all aspects of export compliance, including compliance with the Arms Export Control Act and ITAR.

5.2.3 Technical Assistance Agreements (TAA). The Contractor shall ensure the appropriate Technical Assistance Agreements (TAAs) and/or applicable export licenses are in place before conducting any activity under this task order that requires such approval and documentation.

5.2.4 Equipment. All equipment and materials shall be new and of good quality and durability according to commercially accepted quality standards for similar products. Trailers shall be stabilized after detaching from towing truck (model/types provided in Figure 1, 2 & 3).

5.3 Meetings.

5.3.1 Kick-off Meeting. The Contractor shall participate in a Kick-off meeting to be coordinated by the USG after contract award.

5.3.2 In Country Meeting. The Contractor shall plan for a possible in country meeting to be determined at the Kick-off meeting.

5.3.2.1 The Contractor shall have preliminary designs and be prepared to coordinate the delivery locations of the trailers.

5.3.2.1.1 The Contractor shall provide the presentation equipment as well as no less than six (6) hard copies of the presentation in both Russian and English.

5.3.2.2 The Contractor shall provide professional translator services capable of speaking Kazakh, Russian, and English for this meeting.

5.4 Human Rights Vetting. Before any services are provided to foreign counterdrug personnel, the contractor shall ensure that any personnel who will or may interact with USG personnel:

5.4.1 Are vetted for human rights violations through the Department of State (DoS) IAW the Leahy Vetting Process;

5.4.2 Documentation is maintained by the contractor and made available to the USG upon requests.

6.0 TEMPORARY DUTY TRAVEL (TDY).

The Contractor shall coordinate all travel with the PM or COR per CN&GT procedures. Only travel pre-approved by the COR/PM will be reimbursed under this T/O. See Appendix E.

7.0 GOVERNMENT FURNISHED EQUIPMENT, INFORMATION, MATERIAL OR SERVICES (GFE/GFI/GFM/GFS).

The USG will not provide equipment, information, material or services in support of this effort.

8.0 SECURITY.

All work performed under this T/O shall be Unclassified.

9.0 BASIC CONTRACT DATA REQUIREMENTS LIST (CDRL).

3. Unless specified otherwise, calendar days will be used.

9.1 Contractor’s Progress, Status and Management Report (CDRL A002). The Contractor shall provide a monthly report summarizing all tasks performed, projected tasks scheduled (to include procurement and delivery) and any issues encountered. The report shall, at a minimum, contain an overall schedule, the current status of funding on the T/O, accomplishments completed, any potential problems, and any lessons learned. These reports shall be delivered IAW CDRL A002 Expenditure Report of the Basic Contract and Data Item Description DI-MGMT-80227.

9.2 Licenses, Export Agreements & Certifications. (CDRL A00H). The Contractor shall provide Licenses, Export Agreements and Certifications in response to the T/O Requirement Plan (TORP). These documents shall be provided prior to final delivery unless otherwise directed by the KO. At a minimum, the Licenses, Export Agreements and Certifications shall include the following:

· Cover letter describing purpose or submission, POC, contract/TORP number#; description of each attachment/enclosure; Original Documents(s) Nomenclature (if revision)

· Attachment should be originals or certified originals and be dated, signed by cognizant authority, and indicate specific agreement terms

· English translation of foreign language documents is required

10.0 UNIQUE DATA REQUIREMENTS LIST.

10.1 T/O Quality Control Plan (QCP). The Contractor shall provide a draft T/O QCP with their response to the TORP. The final plan delivery as stated in the above table. At a minimum, the T/O QCP shall address the following:

· Quality Control (QC) Execution: The plan shall not be cursory, but discuss specifically how the prime Contractor shall execute its QC responsibilities with respect to this T/O. The T/O QCP shall include a clearly defined QC process, key performance indicators, QC schedules, and QC personnel (by name), to include those that shall be performing sub-contractor oversight and oversight of activities in-theater. The plan shall address how QC trend analysis and tracking of corrective actions shall be accomplished. The T/O QCP shall discuss the Prime Contractor’s management activity that shall provide oversight and involvement in the QC process. QC personnel should not be buried in the organization, but should have a direct line to upper management.

· Reporting: Monthly status reports shall specifically discuss QC activities over the reporting period and planned activities for the next period. Information shall specifically address WHO conducted the QC, WHEN was the QC executed, HOW was the QC executed and WHAT the findings and corrective actions were. Trends over time shall be identified and discussed thoroughly.

· Invoice Quality Control and Review: The Contractor shall discuss how invoice reviews shall be conducted, to include discussion on how the Prime Contractor, sub-contractor, and supporting data will be reviewed for consistency with T/O requirements and the Contractor’s approach to execute the T/O.

10.2 Warranty Plans. The Contractor shall provide a Warranty Plan for each delivery to each End User (EU) that clearly addresses the following:

· All items normally provided with a warranty shall be provided with standard OEM warranties. The terms of the warranties shall be clearly presented in the name of EU. The effective start date of the warranty shall coincide with date of acceptance of the equipment and materials by the USG.

· As prescribed in FAR 12.404, the Contractor agrees that the supplies or services furnished under this contract shall be covered by the most favorable commercial warranties the Contractor gives to any customer for such supplies or services and that the rights and remedies provided herein are in addition to and do not limit any rights afforded to the Government by any other clause of this contract.

· All utilization of commercially available OEM warranties associated with the equipment shall be the responsibility of the EU upon receipt of the material from the USG.

· All Warranty Plans shall be in Russian, English and the OEMs language for clarity.

· Warranty Plan shall contain (as a minimum):

· OEM POCs;

· List of items by OEM with part numbers, registration/serial numbers, and warranty terms (i.e., length of warranty, start date, type (limited, extended, standard));

· Instructions for product registration with each OEM;

· Requirements to keep the warranty valid;

· How to execute a warrant call

10.3 OEM Use and Maintenance Manuals. The Contractor shall provide OEM use and maintenance manuals for all equipment when available. Manuals shall be delivered in the Russian language.

10.4 Inventory Listings. The Contractor shall provide an inventory listing, per example sheet in Appendix G, to COR/PM for each delivery. The inventory sheet shall contain a detailed item description, quantity, model number, serial number, and cost in country’s currency per item and by total cost per item. These documents shall be provided in both Russian and English.

10.5 Quality Inspection Sheets. All commercially procured OEM items shall be accompanied by quality documentation, in English, for review purposes by the COR/PM prior to final inspection.

10.6 DIP Note. (Return to Paragraph 3.4.7) The Contractor shall provide delivery coordination notices, for each delivery (if not available as one notice), to the PM/COR to be used to execute a DIP Note. The minimum information required shall be date of delivery, POD, Host Nation End User, Bill of Laden, item description, and value of item. All official coordination must be executed with a DIP Note in the timeline listed in the above table.

10.7 Technical Interchange Meetings. The Contractor shall participate in technical interchange meetings, to be scheduled upon request of the responsible KO or written designee, to discuss and to informally evaluate the Contractor’s efforts and accomplishments in direct relation to specific T/O requirements. During the meetings, the Contractor shall present necessary data to enable a joint review of its various assigned tasks, attendant schedules, and resource expenditures. The Contractor shall attend and participate in technical discussions and shall inform, in a timely fashion, the COR and/or PM, as applicable, of any problems with contract execution and any proposed solutions. The Contractor shall attend and participate in other meetings, as scheduled by the responsible KO or written designee. Unless noted elsewhere, all meetings will be scheduled as teleconferences normally not to exceed one hour, each instance. For planning purposes, the Contractor shall plan to participate in teleconferences on a monthly basis until all requirements have been satisfied. The frequency shall be adjusted based on the current status and issues of this requirement.

APPENDIX B

TOWABLE TRAILER - BGS Requirements

BASE, OPTION A, OPTION B

Towable trailer for the BGS with 3 sections (classroom (working tables and projector screen), office room (desk, cabinet, safe) with kitchenette (sink, refrigerator, microwave, table and stove), sleep room (security cabinet, bunk-beds) and a 5th wheel type hitch (see Figure 2). All electrical outlets, sockets, wiring, equipment shall be in compliance with the Kazakhstan electrical system of 220 Volt (V) and 50 Hertz (Hz).

Specifications:

· Dimensions: external length – 12 meters (m); external width – 2.7 m; external height – 2.8 m with a minimum of three (3) point supports. Internal height shall not be less than 2.4 m.

· The towable trailer shall be on the wheeled chassis with all necessary vehicle connection mechanisms and cables for towing by truck referenced in the Base, Option A and Option B.

· All metallic parts of trailer shall be made of stainless metals or covered with anti-corrosion substances.

· The lighting and signs in the back of the trailer shall be in accordance with Kazakhstan’s national traffic regulations.

· Floor and walls insulation shall consist of 5 cm thick basalt (mineral) slabs with water-repellant treatment with density of 50kg/m³ plus polyethylene cover on both sides.

· Ceiling material shall be the same as floor and walls, insulation shall be 10 cm thick.

· Internal lighting shall be from luminescent lamps; external lighting shall be in dome lights with energy-saving bulbs.

· The light switches and electrical outlets shall have grounding. There shall be a circuit breaker panel for all electrical outlets with automatic surge protectors.

· The electrical wiring shall be placed in conduits outside the internal paneling; the wiring shall be made of copper and it shall be double insulated; the wiring for lighting shall meet Kazakhstan electrical code

· Internal outlets (sockets) as well as one (1) covered outlet adjacent to the entry door shall be Kazakhstan standard type outlet/socket, wired to current Kazakhstan electrical code.

· External prime coating and painting: white color, with light blue edging/trim. Internal color of the walls shall be beech/tan; ceiling shall be white.

· Walls and ceilings shall be made of medium density fiberboard (MDF) panels; the floor shall be covered with tear-proof linoleum.

· The trailer shall have an insulated metal entry door of 2mm of steel covering thickness, sufficiently designed for both security and heat-loss.

· The windows shall be no smaller than 1m x 1.2m and shall be metal framed, double pane insulated glass. Window(s) shall be type that can open and lock when closed. All windows shall be equipped with insect screens and external window guards that can be opened from inside the trailer.

· The trailer shall have an entrance awning/cover (removable/retractable) and secured for travel consistent with the trailer design. The purpose of the cover is to prevent snow and rain from entering the trailer and prevent icicle formation over the entrance that may pose a safety hazard. Color shall be consistent with color scheme of proposed design.

· External lighting above the entrance door.

APPENDIX B

TOWABLE TRAILER - BGS Requirements

BASE, OPTION A, OPTION B
