About this file
The document is the standard Federal Acquisition Regulation (FAR) provision 52.212-2 for Evaluation of Commercial Products and Commercial Services, dated November 2021. The provision outlines the government's approach to awarding a contract based on a lowest price, technically acceptable (LPTA) evaluation methodology. The government will select the most advantageous offer by comparing offers that conform to the solicitation, with price being a primary consideration.
Key evaluation details include: the total contract price will incorporate both the base requirement and optional pricing, with the government reserving the right to determine if option prices are unbalanced. The contract can be formed through a written notice of award mailed or furnished to the successful offeror, and the government can accept an offer (or part of an offer) before the specified expiration time. This specific provision is associated with a Department of Veterans Affairs National Cemetery Administration solicitation (QSE--36C78625Q50100) for an office trailer rental at the Roseburg National Cemetery, though the provision itself is a standard evaluation template applicable to commercial product and service acquisitions.

52.212-2 EVALUATION—COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
Lowest price, technically acceptable offer.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
