Pre-Proposal Conference RFI's
| RFI Number | Question | Response | Date Submitted | Date Received | Date Answered | |
| 1 | Will the Houlton Land Port of Entry Project require Federal Acquisition Regulation (FAR) and Cost Accounting Standards (CAS) compliance? | Yes, all our projects follow the Federal Acquisition Regulations (FAR) and the General Services Administration Manual Regulations (GSAM/R) Per GSAM 536.7105-3 and FAR Part 30 Cost Accounting Standards. This project is under $50,000,000 so we will follow the Modified CAS Coverage, see below and Reference 48 C.F.R Subpart 9903.2 - CAS Program Requirements, Subpart 9903.201-2. Types of CAS coverage: (b) Modified Coverage: (1) Modified CAS coverage requires only that the contractor comply with Standard 9904.401, Consistency in Estimating, Accumulating, and Reporting Costs, Standard 9904.402, Consistency in Allocating Costs Incurred for the Same Purpose, Standard 9904.405, Accounting for Unallowable Costs and Standard 9904.406, Cost Accounting Standard - Cost Accounting Period. Modified, rather, than full, CAS coverage may be applied to a covered contract of less than $50 million awarded to a business unit that received less than $50 million in net CAS-covered awards in the immediately preceding cost accounting period. (2) If any one contract is awarded with modified CAS coverage, all CAS-covered contracts awarded to that business unit during that cost accounting period must also have modified coverage with the following exception: if the business unit receives a single CAS-covered contract award of $50 million or more, that contract must be subject to full CAS coverage. Thereafter, any covered contract awarded in the same cost accounting period must also be subject to full CAS coverage. | ||||
| (3) A contract awarded with modified CAS coverage shall remain subject to such coverage throughout its life regardless of changes in the business unit's CAS status during subsequent cost accounting periods. | 10/15/24 | 10/15/24 | 10/15/24 | |||
| 2 | Volume III Price Proposal: The contents of the price proposal are listed in the table on pgs. 8-9 include only the SF 1442, Contract Price Form included as part of the SF-1442 and Section II of the Agreement. On pg. 10 item (3) Price Proposal, additional items are listed to be included in the Price Proposal. Some of the items listed on pg. 10 are included in Volume IV Other Information to Submit with Proposals. Please confirm the contents of Volume III Price Proposal and Volume IV Other Information to Submit with Proposals. | TO BE SUBMITTED BY THE PROPOSAL DUE DATE: Sealed Package #1: Volume I "Reps and Certs" Parts 1 -3, and Volume II "Technical Proposal" response to all 6 Evaluation Factors Sealed Package #2: Volume III "Price Proposal" including the completed/signed SF1442 and the Agreement Section II.B "Contract Price Form", pages 8 - 11 completed; Volume IV "Other Information" parts 1 - 6 and Volume V "Requirements of Joint Venture" | 10/15/24 | 10/15/24 | 10/15/24 | |
| 3 | Bid Bond: Please confirm that a bid bond is to be submitted with this proposal. If a bid bond is required at this stage, which volume should it be included in? | A bid bond is required when the Construction Option is elected, well after the contract is awarded. So, it does not need to be submitted by the proposal due date. | 10/15/24 | 10/15/24 | 10/15/24 |

| 1 | Are there any other preliminary drawings that we can access to understand better the design narrative? | Yes, these were posted to SAM.gov in Amendment 0002 on 10/25/2024 | 10/15/24 | 10/15/24 | 10/25/24 |
| 2 | We do not have a DUNS number, I am not sure if I am able to get the scope of work documents from you. I know in the attachments it states that [Offeror] would email you and the Contract Officer for them. We have not because we do not have a DUNS number. Are there documents that we could review to look at the mechanical, piping, and structural scope of work and materials even though we do not currently have this number? | SAM.gov does not require contractors to be registered to get into SAM so you do not need a DUNS number at this time, but contractors need to be registered in SAM prior to submitting proposals | |||
| 10/15/24 | 10/15/24 | 10/16/24 | |||
| 3 | Page 6 of the Concept Development Narrative refers to Exhibits D and D.1 Conceptual Development Desing (sic) Alternatives drawings and visuals among many other exhibits. We can’t seem to locate the exhibits in any of the Public or Controlled (supplied) documents in the solicitation. Could you please direct us as to where these exhibits are? |
| Yes, these were posted to SAM.gov in Amendment 0002 on 10/25/2024 | 10/15/24 | 10/16/24 | 10/25/24 | ||
| 4 | We tried to review the attachments section in the SAM.gov site for verification of the mentioned exhibits, it seems the site is experiencing issues to display the list of attachments. | On the SAM.gov website, click on Help and type in the questions, "how do I download attachments" and "How do I request access to controlled documents?" | 10/15/24 | 10/16/24 | 10/16/24 |
| 5 | Are there drawings for the existing buildings? | Yes, these were posted to SAM.gov in Amendment 0002 on 10/25/2024 | 10/16/24 | 10/16/24 | 10/25/24 |
| 6 | Can [Offeor] request the documents that were identified to be obtained by request on the SAM.gov website that we could not open as there was no available hyperlink for these attachments when trying to obtain via SAM.gov. We are specifically looking to obtain the documents that outline the scope of work, and are most interested in the mechanical, piping, and structural; but would prefer to review the entire scope of work to understand what subcontractors we would need to schedule work with to prevent rework and ensure that we understood the progression of work. If there is a map or any drawing that shows this or the layout of the planned work, we would like to view that as well. | On the SAM.gov website, click on Help and type in the questions, "how do I download attachments" and "How do I request access to controlled documents?" You should not have a problem downloading all but four documents. Those four require a Form B and CBP authorization letter. We will also be posting additional documents through another Amendment but that will not occur before the site visit. | 10/16/24 | 10/16/24 | 10/16/24 |
| 7 | I received a Meeting Cancellation Email from you yesterday at 1:40 pm. Is the meeting still on for tomorrow? | The Meeting is still on. When I was adding and deleting names, I accidentally hit the wrong button which sent out a cancellation notice to everyone. I recovered that but was informed of the notice. Please plan on attending unless you have already declined. | 10/16/24 | 10/16/24 | 10/16/24 |
| 8 | Is the LPOE facility accessible from I-95 Northbound directly, or must we go to the Canadian crossing facility and turn around to access the US facility? | The Houlton LPOE is a very easy location to arrive at, but it does have a twist. It is located directly on Interstate 95 (I-95), just before you leave the USA and enter Canada. If you miss the turnoff, you will find yourself at Canadian Customs and once you have cleared them, you will have to clear US customs. So, let's see if I can help you avoid both. Houlton LPOE: Northbound on the I-95, as you pass Houlton, Maine, you will drive down the interstate for a couple more miles. Exit 304 is the last exit before the entrance to the Port. As you approach Exit 304, stay on I-95. There is a 40 mph reduced speed and then a 25 mph reduced speed zone on the interstate. As you pass under the overpass for Exit 304 you will begin to see the Port. Stay in the left lane. About 100 yards after you pass under the overpass there is a small entrance into the Port that will have one of several various signs at the entrance. One says "NEXUS OPEN", one says "No Admittance", and one might say Authorized Entrance Only. Enter there regardless of what one of the three signs is up. It is the only place to enter. If they don't, you will find yourself in Canada. You will note that there is a parking lot on the left as you enter. If there is parking there, it is first come first served. The covered parking to the right is utilized by the CBP who are on station. If you chose to park at a less used parking area, proceed between the parking area on the right and the covered parking to your left. As you pull forward you will be crossing I-95 Southbound! Stop at the end of the covered parking area and look to your right to ensure that a car leaving the Port Inspection area sees you before you cross the I95 Southbound. It is 3 lanes wide! There are two buildings beyond the main port building. If you drive between the two buildings you will note that there is a lot of parking all along the path and around the last building to your right. | 10/16/24 | 10/16/24 | 10/16/24 |
| 9 | The price proposal spreadsheet, 20. CLIN Sheet 2024 08 24 0044, has a tab for “Design Phased Services”. Based on the scope of work, it appears that the intent of this tab is for the CMc to provide Preconstruction Services during the course of design. Please confirm that the CMc will not be required to provide Design Services. | Please refer to the Pre-Construction Phase Services, i.e., Design Phase Services in the Statement of Work. | 10/23/24 | 10/23/24 | 10/28/24 |
| 10 | The Concept Development Narrative has insufficient data to quantify the Estimated Cost of the Work as required by the solicitation and the bid form. If this information is contained in the report Exhibit can those be made available? What other documents can be shared to permit establishment of the definable target ECW at award? | Refer to RFI 1 - Other preliminary drawings were posted to SAM.gov in Amendment 0002 on 10/25/2024. | 10/23/24 | 10/23/24 | 10/28/24 |
| 11 | The solicitation calls for the CMc Contingency Allowance to be fixed at 3%. At this early phase of design development this level of contingency, in our experience, is too low. Is the 3% to be fixed for the proposal target ECW or is it intended for the Final ECW at GMP? | The CMc Contingency Allowance (CCA) cannot exceed 3% of the ECW per GSAM 536.7105-2 Guaranteed Maximum Price. | 10/23/24 | 10/23/24 | 10/29/24 |
| 12 | In reviewing the list of documents in the Presolicitation and documents available on sam.gov, there are several documents we have been unable to locate including 33. A.7 GSA P-100 2021 with 2022 Addendum Final (326), 35. D.4 P100 Submittal Matrix v10 CMc 2021 , 58. GSA Program Development Study 100% PDS Report 2021 02 08 (559), and 69. Roof Moisture Analysis Report Houlton 2020 06 23 (22). Would it be possible to share these documents? | Yes, these were posted to SAM.gov in Amendment 0003 on 11/1/2025 | 10/23/24 | 10/23/24 | 10/25/24 |

| vii. II.D. Price Proposal - No percentage is listed for the price proposal implying that this item has zero value at this juncture. Please confirm this pricing can be waived and is not required for the solicitation response? | A Price Proposal is mandatory. Lack of a Price Proposal would deem the entire proposal as non-responsive. The Price Proposal is evaluated separate from the Technical Proposal. The Technical Proposal is deemed to be more important than Price. | 11/8/24 | 11/12/24 | 11/22/24 | ||
| 3 | The basis for these questions is as follows: The Statements of Work documents provided do not match the solicitation. | Follow the Statement of Work (SOW) dated August 02, 2024 under Attachment 26 - A.0 SOW CMc Houlton LPOE Final 2024 08 02. | 11/8/24 | 11/12/24 | 11/22/24 | |

| 6 | The basis for these questions is as follows: o The information provided is not clear or consistent. The documents list conflicting options, incomplete scopes descriptions and it is not possible to determine an actual scope of work to provide budgetary pricing at this time. | Submit in accordance with the Statement of Work (SOW) dated August 02, 2024 under Attachment 26 - A.0 SOW CMc Houlton LPOE Final 2024 08 02. | 11/8/24 | 11/12/24 | 11/22/24 | |
| 7 | The basis for these questions is as follows: We are requesting that the pricing proposal component in The Solicitation be waived and completed as part of the preconstruction / Design Phase Services as the team can work together to develop scope of work and formatting that can be budgeted during the process. | Request denied. GSA requires a separate Price Proposal be submitted by the due date or the entire proposal will be considered non-responsive. | 11/8/24 | 11/12/24 | 11/22/24 | |
| 8 | The solicitation lists a breakdown summary of Design Phase Services, Base Bid and Bid Options 1 Thru Bid Options 7. a. If a pricing proposal is required, please confirm it is budgetary only and non-binding with modifications to occur during the preconstruction process and scope development? We ask this because the presentation of scope and details are vacant leaving many items up for interpretation and we don’t feel a budget at this juncture will be equitable for the actual project or provide any value. | CLIN 1 Design Phase Services can be awarded without negotiations and will be award as a firm fixed price contract. Provide a price for each option shown based on available information. Do not provide any exceptions or exclusions. If during evaluations, the Government is unable to assess what is being proposed then they may provide clarifying questions, hold discussions, and/or enter negotiations to evaluate the proposal. | 11/8/24 | 11/12/24 | 11/22/24 | |

| 14 | 5. The Statement of work lists the preconstruction phase services aka design phase services as having a number of meetings required. Please provide a count for each of the meetings to be attended and anticipated durations of each. A. Pre-Construction Phase Services a.k.a. Design Phase Services. The CMc shall exercise reasonable care in performing its Pre-Construction Services. The Owner and A/E shall be entitled to rely on, and shall not be responsible for, the accuracy, completeness, and timeliness of services and information furnished by the CMc. The CMc, however, does not warrant or guarantee estimates and schedules except as may be included as part of the GMP. The CMc is not required to ascertain that the Drawings and Specifications are in accordance with applicable laws, statutes, ordinances, codes, rules and regulations, or lawful orders of public authorities, but the CMc shall promptly report to the A/E and Owner any nonconformity discovered by or made known to the CMc as a request for information in such form as the A/E may require. | Refer to the SOW Section III General Requirements | 11/8/24 | 11/12/24 | 11/22/24 | |
| 15 | Please provide a count for each of the meetings to be attended and anticipated durations of each. 1. PROJECT INITIATION MEETING | |||||
| The CMc shall participate in an initial meeting with other members of the project team (the A/E, GSA, CMa, and customer agency representatives to review the project’s scope, status of design, discuss goals, begin initial project planning, and agree to the schedule for regularly scheduled Project Meetings. | Refer to the SOW Section III General Requirements | 11/8/24 | 11/12/24 | 11/22/24 | ||
| 16 | Please provide a count for each of the meetings to be attended and anticipated durations of each. 2. COLLABORATION WITH THE A/E | |||||
| During the A/E’s Design Phase Services, the CMc provides Pre-Construction advice to the owner and the A/E in a collaborative environment to identify the potential impact of the design on the project's actual construction and cost. Specifically, the CMc will focus on the design, constructability issues, schedule, cost, risks, and engage in a series of CMc Constructability Reviews and CERPA that occur after each A/E Design Submission. As required by the project the CMc shall facilitate in COST ESTIMATE RECONCILIATION and PROPOSED ALTERNATIVES workshops after each Constructability Review. The ultimate goal of this collaboration is to establish a final Estimated Cost of Work (GMP) that does not exceed the “initial target GMP” (as set forth in the Contractor’s proposal). The CMc's involvement during the project design phase provides GSA with the ability to identify current market conditions concerning labor and material availability, constructability issues, and any phasing and sequencing impacts. In addition to the Constructability Reviews and CERPA workshops the A/E and its subcontractors will communicate through “Informal Information Exchange”, “Design Assist” or “Delegated Design” processes or contracts that may involve the CMc and its trade subcontractors. This will ensure mutual understanding of both the A/E's design intent and the CMc's means and methods, and thus ensure greater certainty in pricing the construction work. It also increases the likelihood that design errors and omissions are recognized and resolved during design. In addition, this collaboration takes place during a time that does not significantly impact the construction schedule and that can result in expedited production and review of shop drawings once construction commences. | Refer to the SOW Section III General Requirements | 11/8/24 | 11/12/24 | 11/22/24 | ||
| 17 | Please provide a count for each of the meetings to be attended and anticipated durations of each. 3. DELIVERABLES MATRIX The Deliverables Matrix has this project’s detailed list of design review deliverables and milestones. A copy of the Deliverables Matrix is attached. The CMc shall be responsible for General Information deliverable requirements as applicable to the services provided and Cost Estimating deliverable requirements. | 2 | Please confirm documents updated and/or provided with Amendment #003 are as follows: #33, 35, 58, 69 & 98. | Any attachments are clearly identified in the body of each Amendment and uploaded into SAM.gov with the original attachments. It is the responsibility of the Offeror to download any updated attachment and/or added attachments. | 3 | Please confirm if use of CSI Divisional Format is acceptable in lieu of Uniform Level 3. If Uniformat must be used please confirm if Level 2 is acceptable which matches sample estimates provided in reference document 58. | Uniformat Level 3 must be used. | 12/5/24 | 12/5/24 | 12/5/24 |
| 4 | It is our experience that more time is spent on moving scope items in and out of locations within unit format than reconciling cost and quantities within estimates. Example is Document 58. GSA Program Development Study 100% PDS Report 2021 02 08 posted in Amendment 003 has a estimate in Uniformat and the page of the estimate directly after the summary has stairs within Uniformat section B10 Superstructure which is for roof and floor construction however, the elements of façade listed for these stairs should be under B20 Exterior Enclosure and stairs should be listed in Uniformat section C20 Stairs but there are elements listed in several different Uniformat sections to try to capture this one scope item. | Uniformat Level 3 must be used. Document 58. GSA Program Development Study 100% PDS Report 2021 02 08 is for reference use only. | 12/5/24 | 12/5/24 | 12/5/24 |
| 5 | A CSI Divisional Format would allow for time spent reconciling estimates to be focused on scope, quantity and unit price and not where items are listed within a Uniformat structure. | Uniformat Level 3 must be used. | 12/5/24 | 12/5/24 | 12/5/24 |
| 6 | It is assumed that design team meetings will be held during the design phase of the project bi-weekly and will last approximately 2 hours.
