Approval of the bypassing systems by the Engineer shall in no way be construed as relieving the Contractor of any responsibility under this Contract as related to the protection of the interests of the Owner, the general public and the waters of the Commonwealth.
If any materials associated with plugging, pumping and bypassing sewage flows left in the existing or proposed sewage collection system by the Contractor cause sewage collection system surcharging and subsequent damage to public and/or private property, the Contractor shall be solely responsible for damage to pubic and/or private property and all expenses incurred by the Owner and all property Owners.
1.11 CONSTRUCTION RIGHT-OF-WAY
The Contractor shall be responsible for determining for himself the various widths of existing public rights-of-way on public highways, roads, streets and alleys. The Owner has secured the permanent rights-of-way widths as noted on the Drawings, along the proposed alignment through private properties.
Unless otherwise shown or noted on the Drawings, the Contractor will only have the widths of the existing public rights-of-way, or the Owner secured rights-of-way across private property shown on the Drawings within which to construct the proposed sewer extension. If the Successful Bidder requires additional rights-of-way for his operations, it shall be the Successful Bidder’s responsibility to secure additional easements as required at no additional cost to the Local Government. Any damage to property outside the rights-of-way provided shall be corrected by the Successful Bidder at the Successful Bidder’s expense to the satisfaction of all parties involved.
West Branch Regional Authority 02000-5 January 2026
1.12 EXPLORATORY EXCAVATIONS TO LOCATE EXISTING UTILITIES
The Engineer reserves the right to require the Contractor to make exploratory excavations in advance of the actual construction of the proposed work to locate existing utilities in critical areas or to determine the type and outside diameter of an existing pipe. Payment for these exploratory excavations will be incidental to the line items as set forth in the Bid Form.
1.13 PROTECTION OF EXISTING UTILITIES AND SITE

2. The Contractor shall prevent the spread of dust and flying particles.
3. The Contractor shall use extreme care to protect any and all private property, property of the Owner, Owner employees, Owner representatives and the public. The Contractor shall be responsible for the restoration of all property damaged or otherwise disturbed to the satisfaction of the Owner, including but not limited to:
a. vehicles
b. lawn areas
c. fencing
d. walkways
e. paved and stabilized surfaces
f. access roadway
g. electrical facilities
h. buildings
i. utilities
j. pipelines and wires
The pipelines may also encroach upon rights-of-way owned and occupied by other utility companies. The Contractor shall conduct this work very carefully to avoid disturbance of those utility lines and shall advise his/her personnel (and those of any subcontractor) of the hazards inherent in working near underground gas lines and/or overhead high voltage electrical lines. Any and all damages caused to existing utility lines or resulting from exposure of and contact with said lines or from other construction activities, shall be rectified by that Contractor which is responsible for same.
It is the responsibility of the Contractor to obtain public utility information as is required to properly complete the work in compliance with the Specifications, and to contact the Owner of the various utilities in the area prior to the startup as well as during the performance of the work.
The location of power, telephone and guide poles along the route of the work, and the overhead lines supported by all such poles, shall be observed and located by the Contractor prior to commencement of the work.
West Branch Regional Authority 02000-6 January 2026
