52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
(i) Technical:
The Offeror shall provide a technical plan demonstrating the current ability or a plan to have the ability to meet the requirements of this solicitation.
The plan shall include:
1. Current available inventory to meet the leasing requirements of the contract, and be able to deliver and install leased equipment within 30 days of contract.
2. The capability to replace any parts washer within 48 hours of the repair or replace determination.
3. The capability to comply with the EPA and DOT regulations when hazardous waste needs to be recycled/disposed of at an approved Treatment, Storage, and Disposal Facility (TSDF), and meeting or exceeding all applicable Occupational Safety and Health Administration (OSHA) standards, National Fire Protection Association Standards, and applicable Fire Codes.
4. The capability to provide sample of virgin MIL-PRF-680A Type II solvent for testing at PSNS (Bremerton) within 5 days after contract award.
5. The capability to meet the Parts Washers Common Elements listed in the Performance Work Statement, as well as the Tank Style dimensions, types, quantity and sizes.
Basis of Evaluation:
The Government will review the technical capabilities. Offerors who provide all submission information and demonstrate the current capability to meet the technical plan or a realistic plan to attain the capability will be given an “ACCEPTABLE” rating. Offerors who do not provide all submission information or do not demonstrate the current capability or are unable to demonstrate an adequate plan to attain the capability to meet the technical requirements of this solicitation, will be given an “UNACCEPTABLE” rating.
(ii) Price
Price: Analysis will be performed by one or more of the following techniques to ensure a fair and reasonable price:
(a) Comparison of proposed prices received in response to the RFP.
(b) Comparison of proposed prices with available historical information.
(c) Comparison of market research results.
Evaluation of the price proposal will determine the reasonableness, and completeness of the Offeror’s proposal.
*Price shall be submitted separate from the non-price factors.*
The Price Proposal will be evaluated using price analysis techniques to determine reasonableness, and completeness of the Offeror’s proposal. Evaluation will determine the Offeror’s comprehension of the requirements of the RFP as well as to assess the degree to which the proposed price accurately reflects proposed performance.
For evaluation purposes, the total evaluated price will be calculated by adding the total price for the basic requirement. Evaluation of options will not obligate the Government to exercise the options. The Government may determine that a proposal is unacceptable if the prices proposed are materially unbalanced between line items or exhibit line items. Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more contract line items is significantly overstated or understated as indicated by the application of cost or price analysis techniques. A proposal may be rejected if the Contracting Officer determines that the balance poses an unacceptable risk to the Government.
Please provide two examples of past performance that when combined provide proof of having performed the technical capabilities outlined in the technical factor.
Offerors will be evaluated on a pass/fail basis with the resulting award to the lowest price remaining offer.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer mailed, or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(End of provision)
