NAME OF OFFEROR: NEWPORT NEWS SHIPBUILDING DATE: 15-Jan-15
NAVSEA SOLICITATION NUMBER: N00024-15-R-4300 QUESTION# 2 (RFP)
SHIPS: USS MONTPELIER SSN 765/USS COLUMBUS SSN 762
SPECIFICATION NO: RFP PARAGRAPH NO.:
TITLE: SUPPLIES OR SERVICES AND PRICES PAGE NO.:
QUESTION:
Notes E and J refer to the 10,000 and 16,000 MD’s respectively as both a minimum and a ceiling amount. The RFP suggests that the 10,000 and 16,000 MD’s will be treated as a ceiling amount. Furthermore, acknowledging information discussed with industry by the Government during the 13 January 2015 pre-proposal conference, the contractor understands that it shall be entitled to a schedule adjustment for any new work that is demonstrated to cause impact to the execution period critical path schedule.
Accordingly, the contractor recommends deleting the second to the last sentence of Notes E and J and adding in its place the following: “Supplemental work as defined in Section C, is to be performed by the contractor under the provisions of the Cost Plus Fixed Fee Level-of –Effort (LOE) ceiling amount of 10,000 man-days for CLIN 0006”

TITLE: PAGE NO.:
The text of Notes D & I addresses supplemental work (New Work) but is not indicated for CLIN’s 0006 or 0012. Is the Offeror correct in interpreting Note D as applying to the Supplemental/New work in CLIN’s 0006 or 0012? Recommend the government add “SEE NOTES D & E” to the CLIN description for CLIN 0006 of Section B? Will the government add “SEE NOTES I & J” to the CLIN description for CLIN 0012 of Section B?

NAVSEA SOLICITATION NUMBER: N00024-15-R-4300 QUESTION# 12 (RFP)
SPECIFICATION NO: RFP PARAGRAPH NO.:
TITLE: PAGE NO.:
Note D provides that “all supplemental and emergent work over and above that identified in Notes A and C will be processed in accordance with the FAR Clause 52.243-2 entitled “CHANGES – COST REIMBURSEMENT.” Notes A and C do not identify any amounts of supplemental or emergent work. Note D, however, specifies 68,000 mandays of emergent work and Note E specifies 10,000 mandays of supplemental work. We believe that the reference to “Notes A and C” should be changed to “Notes D and E” as follows: “All supplemental and emergent work over and above that identified in Notes D and E will be processed in accordance with the FAR Clause 52.243-2 entitled “CHANGES – COST REIMBURSEMENT.” Request that the contractor’s proposed language be used in lieu of the RFP’s current language.

The RFP includes the paragraph “Management and Disposal of Hazardous Waste (1996)” in Section C on page 47 and includes the same clause in Section H on page 82, entitled “5252.223-9114, MANAGEMENT AND DISPOSAL OF HAZARDOUS WASTE (NOV 1996).” There are minor differences in the clauses. The Contractor requests that the Government list the clause only once.

SPECIFICATION NO: RFP PARAGRAPH NO.:
TITLE: PAGE NO.:
If the Government does not require certified cost or pricing data because it received adequate price competition pursuant to FAR 15.403-1(b)(1), does it intend to delete in the award document, DFARS 252.215-7002 which is required only when a contract is “awarded on the basis of certified cost or pricing data.”? Similarly, if the Government does not require certified cost or pricing data because it received adequate price competition pursuant to FAR 15.403-1(b)(1), does it intend deleting in the award document FAR 52.215-10, FAR 52.215-12, and the Alternate I version of 52.215-14?
The clause may come out at award of USS MONTPELIER and/or USS COLUMBUS if adequate competition has been obtained.

NAVSEA SOLICITATION NUMBER: N00024-15-R-4300 QUESTION# 24 (RFP)
SPECIFICATION NO: RFP PARAGRAPH NO.:
TITLE: PAGE NO.:
It is the contractors interpretation that the LOE’s specified for the supplemental or “New Work” CLINs (0006 and 0012) will be used to fund all additional contractor costs required to accomplish New Work items including any additional planning, engineering, management, services, support, and production costs which are funded for the baseline AWP (non-New Work) via other CLIN’s. Is this interpretation correct?
1. During the planning phase, all planning will be charged to CLIN 0001. If new work is added between contract award and the start of the availability, all planning will be completed using CLIN 0001/0007. After the availability starts (is in execution) , use of CLIN 0001/0007 will end.
2. Once the availability starts, all support services will be charged to CLIN 0003/0009 which provides engineering support, planning, etc. The details for how work is charged to the different CLINS and new work is executed is well explained in EB bidder's questions 112 and 113.

SPECIFICATION NO: RFP PARAGRAPH NO.:
TITLE: PAGE NO.:
In the Milestone Incentives for CLINs 0003 and 0009, the second sentence of the second paragraph states that “In addition, growth and new work will come from open and inspect requirements.” According to the definitions of growth and new work used elsewhere in the contract, new work is defined as “additional work items,” and growth work is defined as “additional work items resulting from “open and inspect” requirements or testing.” Accordingly, recommend deleting the reference to “new” work in Milestone Incentive paragraphs for both CLINS 0003 and 0009
Open and inspect most likely will result in growth work. However, there are instances where inspections will identify interferences or other associated work that a prudent shipbuilder would identify to the Government and recommend for repair. The identification of interferences or other associated work would be classified as new work arising out of inspections.
