The purpose of amendment 0016 is to provide changes to solicitation N00024-15-R-4300 in order to clarify the Government requirements. Solicitation N00024-15-R-4300 is hereby changed as follows:

1. In Section B, Supplies or Services and Prices,

a. Note E is hereby changed as follows (deletions made in strikethrough and additions are bolded) NOTE E – All work identified as supplemental work (or “New Work”) will be contracted under a cost-reimbursement level-of-effort option that the ACO will exercise as new work is specifically determined by local ship’s maintenance broker and approved by SUBLANT. Supplemental work is defined as additional work items resulting from either contractor or government proposed changes to the AWP. As such, supplemental work becomes known; it shall be incorporated into the IDD AWP and negotiated under Item 0006. Labor cost for such supplemental work shall be calculated on the basis of the fully burdened MD rate(s). The contractor shall evaluate the impact of new work to the Integrated Master Schedule by critical path analysis, and notify the government of any potential delay to schedule prior to authorization of the new work. Supplemental work, as defined in Section C, is to be performed by the contractor under the provisions of the Cost-Plus-Fixed-Fee Level-of-Effort (LOE) ceiling amount of 10,000 man-days for CLIN 0006 without any delay to the original period of performance. The contractor is to notify the government prior to expending 75% of the ceiling amount, and provide a detailed request for any increase in the ceiling amount.

b. Paragraph 5 and 7 under the section denoted as “Assumptions for Lots 1 and 2,” are hereby revised to the following (deletions made in strikethrough and additions are bolded):

5. It is intended that all Government activities work schedules fit into the established docking period and original Period of Performance availability schedule. In the event such Government activities work schedules do not fit into the established docking period and original Period of Performance availability schedule, consideration may be given on a case by case basis, in accordance with the Changes clause of this contract.

7. All work identified in the AWP shall be bid. The Government has provided Government clarifying information to specific SWLIN and RFP requirements to the USS MONTPELIER IDD as outlined in Attachment 1 to this amendment, and in addition, the Government has specified the items to be provided as Government furnished equipment (GFE). The clarifying information and GFE are identified in Attachment (1) to this Amendment. Do not, under any circumstance, take exceptions or make conditions to the RFP requirements. This is a competitive acquisition and the Government cannot evaluate a proposal that takes exceptions to the RFP requirements. If you take any exception to the Government's RFP requirements, your proposal may be rendered technically unacceptable.

c. Under paragraph titled “B. Opening, Inspecting and Reporting Requirements/Special Incentive (CLIN 0003)”, the following paragraph is changed to read as follows (deletions made in strikethrough and additions are bolded):

The Navy recognizes that additional growth and new work may have an effect on schedule (docking period, undocking, and fast cruise) and delivery which will be negotiated on a case-by-case basis by the Administrative Contracting Officer. The Government will make best and reasonable efforts to definitize all growth work in a timely manner.

d. Paragraph titled “C. Milestone Schedule Incentive (CLIN 0003)”, is hereby changed to as follows (deletions made in strikethroughs and additions made in bold):

C. Early Delivery Incentive (CLIN 0003)

This “Early Delivery Incentive” for USS MONTPELIER (SSN 765) IDD replaces the previously identified “Milestone Schedule Incentive” for Undocking and Fast Cruise.

Submarine maintenance and modernization is required at prescribed intervals within the life cycle of a submarine to sustain its safety and tactical integrity for extended periods of deployment. Submarine maintenance and modernization is directly related to ensuring the safety of the crew. The goal of this availability is to complete the work required within the AWP and return the ship back to the fleet so that the submarine can perform assigned missions and continue to be an operating asset to the Navy.

The nature of submarine repair realizes a certain amount of normal and usual repair work within the basic contract. In addition, growth and new work will come from open and inspect requirements. This should be assumed in planning the execution of the availability. Since the contractor is an expert in the accomplishment of submarine maintenance, they should be knowledgeable in the expectations of growth work. The contractor should develop and adhere to a schedule to manage accomplishment of all repair and modernization work, including normal and usual repairs within the period of performance set forth for execution of this availability. This is required to ensure the government will have all repairs and modernization completed as quickly and as accurately as possible.

Period of Performance is revised for the USS MONTPELIER (SSN 765) IDD to:

15 September 2016 through 15 February 2018

CNO availability dates remain unchanged: 15 September 2016 through 15 December 2017 This Delivery Incentive requires the contractor to ensure the availability is progressing, and adhering to complete the USS MONTPELIER (SSN 765) IDD prior to the end of the CNO availability dates the approved contractor milestone schedule, and to ensure that the availability does not exceed the specified period of performance. The contractor’s performance will be evaluated by the reviewing official at two separate milestones: (1) Completion of Undocking, and (2) Start of Fast Cruise.

CNO availability dates - 15 September 2016 through 15 December 2017.

The contractor shall propose up to an 11% base profit for CLIN 0003. This incentive will be an additional 3% (1.5% for completion of undocking and 1.5% for start of Fast Cruise) of the profit available to be earned against the total cost established under CLIN 0003.

This “Early Delivery Incentive” requires the contractor to complete the USS MONTPELIER (SSN 765) IDD prior to the end of the Period of Performance and provides maximum profit award for completing the IDD on, or before, the CNO Availability End Date. The contractor’s performance will be monitored continuously and evaluated by the reviewing official at Completion of availability.

The contractor shall propose up to an 11% base profit for CLIN 0003. This “Early Delivery Incentive” will provide up to an additional 3% of the profit available to be earned against the total cost established under CLIN 0003 as follows:

1) Additional 3% if the contractor completes the IDD on or before 15 December 2017 (CNO Availability Date).

2) Additional 1.5% if the contractor completes the IDD between 16 December 2017 and 15 January 2018.

No additional fee will be earned by the contractor for IDD completion beyond 15 January 2018.

The Navy recognizes that additional growth and new work may have an effect on schedule and delivery (docking period, undocking, and fast cruise) which will be negotiated on a case-by-case basis by the Administrative Contracting Officer. The Government will make best and reasonable efforts to definitize all growth work in a timely manner.

2. In Section C, Description and Specifications,

a. Item 0001, paragraph 1(c)(1) is hereby revised to the following (addition are highlighted in bold):

(1) Furnish non-nuclear, non-standard long lead time material. As identified in the NAVSEA issued Alteration Authorization Letter, a listing of long lead time material being furnished by SUBMEPP, updated periodically, will be provided to the contractor. This requirement in no way relieves the contractor of the obligation to procure all other material to accomplish the applicable availability, except for the Government Furnished Material (GFM) identified in Section F (see GOVERNMENT PROPERTY - ADDITIONAL CONTRACT REQUIREMENTS) and the Government Furnished Equipment (GFE) identified in Attachment (1).

b. First paragraph of Item 0003 description is hereby changed as follows (addition are highlighted in bold):

Item 0003 – In accordance with COMFLTFORCOMINST 4790.3 Rev C, Change 1, Volume 2, Part 1, Chapter 2, Section 2.1.2., the contractor will perform the functions as the Lead Maintenance Activity (LMA). The LMA is the single activity responsible for integrating and overseeing all maintenance and modernization work performed during the execution of the availability. Oversight of AIT is governed by NAVSEA Technical Specification TS-9090-310(F) ALTERATIONS TO SHIPS ACCOMPLISHED BYALTERATION INSTALLATION TEAMS. The contractor is expected to assume responsibilities of LMA at the local area Submarine Base/Piers upon completion of weapons offload, and remain LMA until (unrestricted Operations) URO certification of the ship.

c. First paragraph of Item 0006 description is hereby changed as follows (changes made in Bold):

Item 0006 – All work identified as supplemental work (or “New Work”) will be accomplished under this line item up to a maximum of 10,000 Man-days. The ACO will execute new work as it is specifically identified. Supplemental work is defined as additional work items resulting from either contractor or government proposed changes to the AWP. As such, supplemental work becomes known; it shall be incorporated into the IDD AWP and negotiated under this line item. Labor cost for such supplemental work shall be calculated on the basis of the fully burdened MD rate(s), as established for this line item.

3. Under Section F, Deliveries or Performance, Delivery information for CLINs 0003, 0004, 0005, and 0006 is hereby changed from 15 December 2017 to 15 February 2018:

4. Under Section L, Instructions, Conditions and Notices to Bidders,

a. the first two paragraphs of the Additional Instruction to Offerors are hereby revised to the following: (deletions made in strikethroughs and additions made in bold)

ADDITIONAL INSTRUCTIONS TO OFFERORS

The offeror shall develop its proposal assuming accomplishment of all the work stated in the Availability Work Package (AWP) forwarded by SUBMEPP letter SSN 765/4700 Ser 1812KM/223 dated 12 September 2014, for Lot 1, and the work stated in the AWP forwarded by SUBMEPP letter SSN 762/4700 Ser 1812KM/280 dated 25 November 2014 for Lot 2. It is government’s desire to have all the work stated in these AWPs accomplished within the CNO planned period of performance (POP) for each boat.

The offeror shall submit its proposal in two volumes: Technical/Past Performance (Factors 1 and 2), and Cost (Factor 3). If the offeror is proposing against Lot 1, there shall be a Technical/Past Performance Volume for Lot 1 and a Cost Volume for Lot 1. If the offeror is proposing against Lot 2, there shall be a Technical/Past Performance Volume for Lot 2 and a Cost Volume for Lot 2. If the offeror is proposing against both Lots 1 and 2, there shall be a Technical/Past Performance Volume for Lot 1, a Technical/Past Performance Volume for Lot 2, a Cost Volume for Lot 1, a Cost Volume for Lot 2, and a Technical Supplemental Volume for Lots 1 and 2. The Technical Supplemental Volume for Lots 1 and 2 shall address the offeror’s ability to successfully perform both Lots 1 and 2 adhering to both schedule and the requirements of the Availability Work Packages (AWPs).

The government requires that all work stated in these AWPs be accomplished within the period of performance (POP) for each boat.

The Government has provided Government Clarifying Information to specific SWLIN and RFP requirements to the USS MONTPELIER IDD and has specified the items to be provided as Government furnished equipment (GFE). The Government Clarifying Information and GFE are identified in Attachment (1) to this Amendment. Do not, under any circumstance, take exceptions or make conditions to the RFP requirements beyond those specifically identified in Attachment (1). This is a competitive acquisition and the Government cannot evaluate a proposal that takes exceptions to the RFP requirements. If you take any exception to the Government’s RFP requirements, your proposal may be rendered technically unacceptable.

b. Under Sub-Factor 3. Schedule, the words “CNO planned” is hereby deleted as follows: (deletions are made in strikethrough) Sub-Factor 3. Schedule The offeror shall submit a detailed schedule which identifies key events and critical milestones required to accomplish the work defined in this contract within the CNO Planned period of performance (POP) for each boat under for Lots 1 and 2.

5. Under Section M, Evaluation Factors for Award,

a. The paragraph titled “NOTE:” is hereby revised to incorporate GFE requirements as follows (addition are provided in bold text):

NOTE: The Government has provided Government Clarifying Information to specific SWLIN and RFP requirements to the USS MONTPELIER IDD and has specified the items to be provided as Government furnished equipment (GFE). The clarifying Information and GFE are identified in Attachment (1) to this Amendment.

Unrealistically low estimates, initially or subsequently, may be grounds for eliminating a proposal from the competition either on the basis that the offeror does not understand the Government’s requirement or that the offeror has submitted an unrealistic proposal.

The Government may make a final determination as to whether the offeror’s proposal is acceptable or not acceptable solely on the basis of initial proposals as submitted. Offerors are advised to submit proposals that are fully and clearly acceptable without requests for additional information. Offerors are required to meet all solicitation requirements, such as terms and conditions and technical requirements, as outlined in the solicitation to be eligible for award.

The Government intends to award two contracts, one contract for USS MONTPELIER Interim Dry Docking (IDD) and one contract for USS COLUMBUS Engineered Overhaul (EOH). However, the Government reserves the right to award only one contract or no contract, depending on the quality of proposal(s) submitted and the availability of funds. The Government may determine that an offeror is technically acceptable and lowest evaluated cost/price to perform a contract for one availability, but would not be technically acceptable (although lowest evaluated cost/price) if it were awarded contracts for two availabilities. In that case, the Government reserves the right, at its sole discretion, to award a contract to that offeror for only one availability and may choose which of the two availabilities shall be awarded to that offeror. The Government may choose to award the other availability to the next technically acceptable, lowest evaluated cost/price offeror, or it may choose not to award the contract for the second availability.

Award will be made to the responsible, technically acceptable offeror or offerors with the lowest evaluated cost/price whose proposal(s) conforms to all solicitation requirements, such as terms, conditions, representations, and certifications.

Award will be made to the responsible, technically acceptable offeror or offerors with the lowest evaluated cost/price whose proposal(s) conforms to all solicitation requirements, such as terms, conditions, representations, and certifications.

6. All Other terms and conditions shall remain unchanged and in full force and effect.
