Re: Proposal for 12 Months O&M / RASS Report Westwood Cleaners 4513 Gunn Highway Tampa, Florida, 33624 Facility ID No. 29950774, ERIC_4706
Dear Mr. Grubbs:
Professional Service Industries, Inc. (PSI), an Intertek company, is pleased to provide the proposal contained herein to provide twelve months of remediation system Operation & Maintenance (O&M) services, quarterly email summaries of system operations, and documentation of the remediation system performance with the development of two Remedial Action System Status Reports, for the former Westwood Cleaners located at 4513 Gunn Highway, Tampa, Florida.
Included with this proposal is a brief discussion of project history to date, proposed scope of work, cost estimate and a proposed schedule for completion. Site access has been provided by Noble Properties via 2018 Site Access Agreement and confirmed via email on March 5, 2024.
PROJECT BACKGROUND
The Westwood Cleaners operated from 1984 to 2003 and occupied a tenant space on the east portion of a multi-tenant commercial shopping center in Tampa, Florida. The cleaners operated one tetrachloroethene (PCE) drycleaning machine and the facility has two floor drains. Based on results from the Site Screening activities in May 1997 showing PCE in the soil at a concentration of 700,000 micrograms per kilogram (μg/kg), the drycleaner business was accepted into the Drycleaning Solvent Cleanup Program. The soil sample was collected near the backdoor of the drycleaner building.
FDEP – Westwood Cleaners, O&M, RASS
March 18, 2024 www.intertek.com/building
The former Westwood Cleaners tenant space is currently vacant but was recently a martial arts studio, Carrollwood Tae Kwon Do. The business has been remodeled with an elevated bamboo floor for the martial arts training. No drycleaning equipment remains at the former drycleaners.
A Site Assessment / Interim Source Removal Plan was prepared by PSI for the FDEP and was submitted August 29, 2018, and subsequently approved by the FDEP on May 20, 2019. Of note is the very high PCE concentration detected in the shallow well installed next to the former dryclean machine at 64,000 ug/L in February 2018, 12,000 ug/L in April 2020, and 9,300 ug/L in March 2021. The Interim Source Removal (ISR) Plan consisted of addressing the contaminant mass such that additional contaminant contribution to the surrounding soil and groundwater is minimized using Soil Vapor Extraction (SVE) technology.
An SVE system was installed in October through December 2019 at the Westwood Cleaners facility, with start-up in December 2019.
The system has been operating since December 2019. A Remedial Alternatives Evaluation addressing the solvent-impacted groundwater was submitted in September 2023 which identified ISCO (in-site chemical oxidation) as the remediation strategy. Prior to an ISCO Remedial Action Plan, however, additional delineation inside the former drycleaner tenant space was recommended. PSI is currently working with the tenant and owners to gain access inside the building and will submit a proposal to conduct the assessment as well as updated groundwater quality data.
Therefore, the proposal contained herein for the O&M does not include groundwater sampling and analysis.
PROPOSED SCOPE OF WORK
The proposal contained herein consists of utilities service and twelve-monthly O&M events with two report deliverables for the existing SVE system, quarterly email summaries, and reporting.
The results will be used to confirm system operations and evaluate mass recovery rates as compared to remedial design. Specifically, the proposed scope of work consists of the following subtasks:
1. Project Management
This scope is provided for in the template worksheets.
2. Three Months of O&M (First Quarter)
Operations and Maintenance will be conducted on the SVE system. The work will be conducted as follows:
a. Mobilization to the site on a monthly basis.
b. Collect monthly vacuum and air flow readings from the SVE wells.
March 18, 2024 www.intertek.com/building
c. Collect monthly PID readings from SVE wells and system effluent.
d. Optimize system performance and recollect system readings as necessary to confirm enhanced system operation.
e. Collect quarterly system influent and effluent samples, and six (6) samples from the operating SVE wells for analysis by Method TO-15.
f. Document system readings in the site-specific O&M checklist.
g. Quarterly update via email to the FDEP on system operation.
Additionally, during the first quarter, PSI will mobilize to the site and replumb and install a new bleed air silencer and replace the SVE system filters. During the June 2023 O&M event, PSI attempted to replumb a broken PVC fitting. During that activity the integrity of the silencer housing was compromised due to significant corrosion of the silencer housing. Based on the amount of flow through the main inline filter from both the unfiltered bleed air and the SVE wells as well as the change in pressure across the blower tripping the blower, PSI recommended and FDEP approved replacement of the system’s filters. These activities are intended to reduce the noise generated by the system to that of the original design as well as to reduce the change in pressure across the blower to within the range of the blower to reduce system down time.
The Level of Effort for system repairs and the first quarter O&M is detailed in Subtask 2.
3. Three Months of O&M (Second Quarter)
O&M will be conducted once a month for three months as specified above. Air samples will be collected from the influent and effluent and analyzed by TO-15. A summary of system conditions will be submitted via email to the FDEP each quarter.
The Level of Effort is detailed in Subtask 3.
4. Semi-Annual RASS Report
A Semi-Annual Remedial Action System Status Report will be developed which will include an evaluation of the collected information and data. The report will detail and summarize the monthly O&M information, along with summary tables, figures and a graphical depiction of the system performance. Vapor sampling results will be submitted in the RASS report. The report will be prepared in accordance with the Technical Worksheets or similar guidance documents, developed by the FDEP Drycleaning Solvent Cleanup Program.
Conclusions and recommendations will be made, which will include a summary of modifications made to the system to enhance the recovery rates or decrease system time to achieve targeted goals. The report will incorporate specific recommendations and provide opinions based on professional experience in order to achieve the most efficient cleanup endpoints. We understand that the Department’s goal is to achieve aggressive contaminant reduction in an efficient and cost-effective method.
March 18, 2024 www.intertek.com/building
The Level of Effort is detailed in Subtask 4.
5. Three Months of O&M (Third Quarter)
O&M will be conducted once a month for three months as specified above. Air samples will be collected from the influent and effluent and six of the SVE wells at the end of the third quarter of the year and analyzed by TO-15. A summary of system conditions will be submitted quarterly via email to the FDEP. Following the third month, the system will be shut down for a minimum of 30 days for a system shutdown evaluation.
The Level of Effort is detailed in Subtask 5.
6. Three Months of O&M (Fourth Quarter)
Following 30 days of system shutdown following the third quarter, an O&M will be conducted and Soil Vapor samples collected from the six (6) active SVE wells. Results from these wells will be evaluated as part of a system shutdown evaluation. Typical O&M events will be conducted once a month for three months as specified above with typical quarterly air sampling from the influent and effluent to be analyzed by TO-15 at the end of the quarter. A summary of system conditions will be submitted quarterly via email to the FDEP. During the forth quarter, PSI will drum and arrange transport and proper disposal of up to one (1) drum of water from the poly tank as generated by use of the SVE system. Currently the poly tank contains approximately 50-gallons.
The Level of Effort is detailed in Subtask 6.
7. Annual RASS Report
An Annual Remedial Action System Status Report will be developed which will include an evaluation of the collected information and data for the entire year. The report will detail and summarize the monthly O&M information, along with summary tables, figures and a graphical depiction of the system performance as well as any groundwater sampling and analysis performed under a different Task Assignment during this reporting period. Vapor sampling results will be submitted in the RASS report which will evaluate the results of the system shutdown evaluation.
The Level of Effort is detailed in Subtask 7.
March 18, 2024 www.intertek.com/building
8. Utilities for remediation system operation
PSI used the previous utility costs from this system as well as similar equipment at other sites as a basis for the utility costs, as detailed in Level of Effort Subtask 5. We are currently running the system at 100% due to the recommendations by the FDEP.
The Level of Effort for utilities is detailed in Subtask 8.
COST ESTIMATE AND SCHEDULE
The estimated cost to perform the O&M for twelve months along with two RASS report deliverables and quarterly email summaries is shown on the attached Cost Estimate. All PSI services will be conducted in accordance with the terms and conditions contained within DEP Contract No. HW 686, Waste Cleanup Program Services, dated December 21, 2021. The services will be completed on a monthly basis upon authorization.
The O&M will start in April 2024 and continue for 12 months until March 2025 with the quarterly brief summaries as a deliverable. EnviroServe Inc. Terms and Conditions The following terms and conditions apply to all materials sold and services provided by EnviroServe Inc. (“Contractor”) to the Client named on the face sheet of this Agreement and are applicable to any subsidiary and/or affiliate of Client that Contractor sells materials to or provides services on such Client’s behalf.
1. Entire and Sole Agreement: These terms and conditions, along with any terms contained on the face sheet of this Agreement, shall constitute the entire and sole agreement (“Agreement”) between Contractor and Client as to the goods sold and/or services provided, and shall supersede all prior oral or written agreements by and between Contractor and Client. These terms and conditions may not be modified, altered or canceled without the express written agreement signed by both Contractor and Client. In the case of any inconsistency between these terms and conditions and any other terms, conditions, or provisions, then the terms and conditions set forth herein shall expressly control. Client expressly waives all provisions contained in any correspondence or forms involved in this transaction which negate, limit, extend or conflict with the terms and conditions stated herein. Client agrees that it has not been induced to enter into this Agreement by any oral or written representation, guaranty or warranty made by Contractor, its employees, agents or representatives other than as expressly set forth herein or on the face sheet hereof. If any portion of this Agreement is deemed to be illegal or unenforceable by a court of law, then the validity of the remaining portions or provision shall not be affected and shall remain in full force and effect. Notwithstanding the preceding sentence, if Contractor in its sole discretion determines that the absence of the eliminated provision is contrary to the original intention of the parties, then Contractor shall have the right to terminate this Agreement.
2. Governing Law:The validity, performance, and construction of this Agreement shall be governed in accordance with the laws of the State of Ohio. The parties agree that should any claim be made by and against the parties hereto which seeks to recover a sum less than $25,000.00, then that claim shall be decided exclusively through the processes of the American Arbitration Association (“AAA”), and any such AAA hearing shall be conducted in Cuyahoga County, Ohio. Should any claim be made by and against the parties hereto, which seeks to recover a sum in excess of $25,000.00, the parties agree to the exclusive jurisdiction and venue to resolve such claim in the courts located in Cuyahoga County, Ohio.
3. Independent Contractor: Contractor shall be an independent contractor and shall determine the method, details, and needs for performing the job(s) covered by this Agreement. Contractor is not now, nor shall it ever become, an employee, partner, agent, or principal of Client while this Agreement is in effect. Contractor is not entitled to the rights or benefits afforded to the Client’s employees. Contractor’s review or supervision of work prepared or performed by other individuals or entities retained by others shall not relieve such individuals or entities of complete and sole responsibility for the adequacy of their work, for which such other individual and/or entity shall remain completely liable to Client and Contractor.
4. Changes:The Client, without invalidating this Agreement, may request changes within the general scope of the services required by the initial contract between it and Contractor. Any change proposed by Client shall not become effective unless and until Contractor consents, in writing, to such change in accordance with Paragraph 1, above.Should any change result in additional cost and/or increase the time of Contractor to perform said services, then Client agrees to compensate Contractor for such additional cost and time, including, without limitation, any overhead and profit margin associated with such cost and time as solely determined by Contractor.
5.Termination:
A.)By Contractor:
Contractor may immediately terminate this agreement in the event of Client’s breach or threatened breach of any term or provision of this Agreement, including but not limited to failure to pay on a timely basis, or if Client becomes insolvent, the subject of an order for relief in bankruptcy, receivership, reorganization, dissolution, or similar law, or makes an assignment for the benefit of its creditors, or if Clients actions or inactions causes increased risk, exposure, cost or liability, or if Contractor deems itself insecure as to payment or other matters (“Default”). Notice of termination shall be in writing and deemed given when delivered in person or by certified mail, postage prepaid, return receipt requested. In the event Contractor terminates this Agreement for Client’s Default, then Contractor, in addition to being entitled to payment for work already performed, is entitled to liquidated damages, which are not in the way of a penalty, in the amount of 15% of the total contract covered by this Agreement, including any changes approved by Contractor through the date of termination, and reasonable attorney fees and costs of collection. Client acknowledges that the actual damage to Contractor in the event of termination is difficult to fix or prove, and the foregoing liquidated damages amount is reasonable and commensurate with the anticipated loss to Contractor resulting from such termination and is an agreed upon fee and is not imposed as a penalty.Collection of liquidated damages by Contractor shall be in addition to any rights or remedies available to Contractor under this Agreement or at law. Contractor shall not be liable for loss or damage caused by termination of its performance.
B.)By Client:
The Client may terminate this Agreement in whole or in part at any time by written notice. On receipt of such notice, Contractor shall, except as otherwise directed in said notice, immediately discontinue services and shall, if required, make reasonable efforts to procure termination of subcontracts to which Contractor is a party.
