Dam Safety Services Jackson Bluff Dam

Contract CN335 TA16 Amendment No. 4

Reason for Amendment The Florida Department of Environmental Protection (FDEP) requested that Taylor Engineering Inc.

(Taylor) and Mead & Hunt, Inc. (Mead & Hunt) provide additional engineering services at the Jackson Bluff Dam (Project). These services include the following:

• Obtaining permits for the toe berm/filter project at the right embankment.

• Attend two pre-bid meetings on-site.

• Provide construction administration (CA) services for upstream and downstream underwater concrete repairs.

• Provide construction administration services for the Tainter gate lifting bracket replacement project.

Scope of Services The Taylor Engineering team will provide the following services:

Subtask 16 – Natural Resource Survey

To support the permit applications, Taylor environmental staff will complete a natural resource assessment of the project area to establish baseline environmental conditions to support regulatory permitting. The natural resource assessment will include wetlands delineation, habitat and vegetation characterization, and listed species assessment. The listed species assessment will generally identify state-and federally listed species that may occur within the project area based on habitat conditions and site observations. The assessment does not include detailed, species-specific surveys.

Deliverables The Taylor Engineering team will provide the following deliverable to the FDEP:

Natural Resource Survey Report ............................................................................ 1 copy via email (PDF file)

Performance Measures The FDEP will review the deliverables to confirm they are complete, accurate, and timely.

Subtask 17 – Environmental Permitting Services

Pre-Application Meetings The proposed work will occur within jurisdictional areas of the FDEP and the Northwest Florida Water Management District (NWFWMD). Under current federal rules, Taylor assumes the proposed work does not require separate authorization directly from the U.S. Army Corps of Engineers and FDEP has assumed the federal Section 404 Clean Water Act (CWA) regulatory authority at the proposed project location.

Taylor will coordinate and lead pre-application meetings with FDEP and NWFWMD. In these meetings, Taylor will present the existing conditions, data collection efforts, project overview, and review proposed application components. Taylor will document the meeting in meeting summaries.

Permit Application Development and Processing Taylor will develop the necessary permit applications for state and federal regulatory authorizations. The NWFWMD will likely lead state agency review. If federal Section 404 CWA authorization is required, the FDEP will lead that effort. The pre-application meeting will define the lead regulatory agency or agencies responsible for reviewing this project. The permit applications will include the information necessary for agencies to perform their technical review and public processes. In support of the application, Taylor will prepare all narratives describing the project design, purpose, and need; project best management practices (BMPs); avoidance and minimization measures; natural resources within the project area and unavoidable impacts; proposed wetland mitigation if required (mitigation bank assumed); property ownership and adjacent property owners; and construction methodology and schedule. Please note this scope of work does not include the preparation of a detailed alternatives analysis for wetland impacts which could be requested by FDEP. If an alternative analysis is required by FDEP, Taylor will submit a revised scope work and fee proposal for the additional work.

Taylor will submit the draft application package to FDEP for review and comment. Following receipt of comments, Taylor will incorporate feasible changes to produce the final permit application packages and submit the packages to the regulatory agencies.

The establishment and maintenance of a clear line of communication between the applicant and the participating agencies represents the single most important activity during the permitting process. To that end, Taylor will actively coordinate with regulatory agencies staff during the application process. These agencies include, but are not limited to, the FDEP, NWFWMD, and Florida Fish and Wildlife Conservation Commission (FWC).

Following submission of the permit application(s), agencies may respond with requests for additional information (RAIs). While Taylor anticipates submittal of a complete and concise permit application package, the project may generate review comments and RAIs from regulatory agencies and the related natural resource agencies that provide comments on permit applications. Such requests typically comprise a series of questions requiring additional explanation or clarification of environmental and engineering issues. As the FDEP’s permitting agent, Taylor will coordinate with FDEP and the lead regulatory agencies to address such RAIs. This scope of work includes budget for development and coordination of two formal RAI responses per agency. Should the regulatory negotiations require additional efforts and fees outside those presented herein, Taylor will contact FDEP to discuss an amendment to the scope of work and fee.

Services to be provided do not include:

• Permit authorization directly from the USACE.

• On-site mitigation planning or design. Proposed wetland mitigation for unavoidable impacts will involve purchase of in-kind mitigation credits from an approved mitigation bank only.

• The payment of permit processing fees.

Deliverables The Taylor Engineering team will provide the following deliverables to the FDEP:

FDEP and NWFWMD Pre-Application Meeting Summaries ................................... 1 copy via email (PDF file) FDEP and NWFWMD Permit Applications ............................................................. 1 copy via email (PDF file) RAI Responses ...................................................................................................... copies via email (PDF files)

Performance Measures The FDEP will review the deliverables to confirm they are complete, accurate, and timely.
