OAK SHORE DRIVE FISHING PIER

DEP Agreement No. CN335

Task Assignment No. 5

The Florida Department of Environmental Protection (DEP) has selected Taylor Engineering, Inc.

(Consultant) to provide professional services for the Deepwater Horizon Natural Resources Damage Assessment (NRDA) Phase III Early Restoration Project, Oak Shore Drive Fishing Pier (Project) to be located offshore of Earl Gilbert Park in the City of Parker, Bay County, Florida. This Task Assignment (Task Assignment) is issued pursuant to DEP Bureau of Design and Construction (BDC) Contract No. CN335 (Contract).

For clarity, this Task Assignment follows the engineering study performed under Task Assignment No. 3 of Contract No. CN335 which included site observations, background data review, and preparation of a conceptual design with an opinion of probable construction cost for a fishing pier following the City of Parker’s NRDA project application.

Background

As part of the Deepwater Horizon NRDA Early Restoration Program, DEP selected the Consultant to provide professional engineering design and permitting services for the proposed pier, which aims to increase fishing and recreational access to East Bay, of St. Andrews Bay, for the City of Parker and Tyndall Air Force Base residents. Based on the conceptual design prepared under Task Assignment No. 3, the Project proposes construction of an approximately ~460 ft concrete and timber fishing pier and a ~110 ft timber boardwalk to provide access to the pier from existing parking facilities. This Task Assignment describes the natural resource survey and coordination tasks to be completed by the Consultant during the National Marine Fisheries Service (NMFS) accepted seagrass survey period (June 1 and September 30).

Notably, the results of seagrass survey will likely influence design and permitting requirements, which may include seagrass mitigation. Since the Project is a NRDA Phase III Early Restoration project, it has been previously assessed and determined to be in compliance with the requirements of the National Environmental Policy Act.

Reporting Requirements

The Consultant shall submit monthly progress reports which indicate the work performed during the reporting period, work scheduled for the next reporting period, problems encountered and resolutions of the problems, and any schedule updates. This monthly report shall be provided to the DEP Project Manager in conjunction with monthly invoices or within five (5) business days of the close of each proceeding month at no additional cost to DEP.

Additional Services

The Consultant may be requested to provide other professional services related to the Project, as deemed necessary by DEP, based on the availability of funding. Based on DEP’s ability to negotiate a satisfactory price, DEP reserves the right to amend this Task Assignment to include additional services related to the Project’s planning and design, bidding assistance, and construction administration as may become necessary.

DEP Agreement No. CN335, Task Assignment No. 5, Page 2 of 4

Project Description

The Project is comprised of a ~460 ft concrete and timber fishing pier and a ~110 ft timber boardwalk to provide access to the pier from existing parking facilities at Earl Gilbert Park. The facility development will generally follow conceptual design plans developed under a separate authorization. The pier will comprise of a concrete substructure and partial superstructure and incorporate breakaway timber deck panels and timber handrails. The 8-ft wide pier will follow the shallow shoal extending south from the park shoreline, along an area of reduced potential for seagrass impact. Approximately 200 ft from the shoreline, the pier reorients perpendicular to offshore contours and transitions to a width of ~12 ft once outside of abundant SAV habitat. The pier extends to a terminal structure in water depth of 23 ft. The deck elevation of the pier will be approximately 4.5 ft-NAVD and will comply with Americans with Disabilities Act (ADA).

Assumptions

The Consultant has made several assumptions in developing this scope of services and associated fees for the Project. The assumptions affect the proposed level of effort and associated costs. If any of the assumptions should prove incorrect, the Consultant will submit a proposal to modify its scope of services and fees accordingly.

Information to be Provided by DEP

The Consultant assumes DEP will provide the following additional information to support project design.

1. Project-related correspondence between DEP and the local project proposers, specifically in reference to project design requests, budgets, etc.

2. Direction on the proposed designs, budget, etc.

3. Any available survey information and data including upland topographic data and hydrographic data and boundary survey information.

Tasks and Deliverables

Subtask 1 – Natural Resource Survey and Coordination Meeting

Description: The necessity of seagrass impact avoidance for the Project is documented in the NRDA Programmatic Environmental Impact Statement and the National Marine Fisheries Service Biological Opinion. The pier aims to avoid seagrass impact by traversing the shallow sand bar extending south from the Earl Gilbert Park shoreline, through a narrow area between seagrasses previously documented by the Florida Fish and Wildlife Conservation Commission Florida Wildlife Research Institute. From initial discussions with State and federal regulators, formal documentation of the seagrass boundaries and communities will be required for environmental resource permitting. To incorporate avoidance and minimization, the location of seagrass boundaries will likely affect the pier design and may indicate seagrass mitigation requirements. The purpose of the coordination meeting with the DEP project manager is to review the seagrass survey findings and delineate potential design revisions and/or incorporation of seagrass mitigation into the Project.

Subtask 1.1 Natural Resource Survey and Reporting: To support the design and permitting phases of the project, the Consultant’s environmental staff will complete a natural resource survey to map and characterize shoreline wetlands and submerged resources in the vicinity of the proposed fishing pier.

DEP Agreement No. CN335, Task Assignment No. 5, Page 3 of 4

Subtask 1.1.1 Wetlands Survey: The Consultant will field delineate the limits of jurisdictional wetlands along the project shoreline pursuant to current state and federal methodologies. The Consultant will install stakes or flagging to mark the location of the wetland boundary and record each position using differentially-corrected global positioning system (DGPS) with sub-meter accuracy. The Consultant will also map (using DGPS) and characterize shoreline habitats and wetland vegetation communities.

Subtask 1.1.2 Submerged Resource Survey: The Consultant’s environmental staff will map (using DGPS) and characterize submerged resources (e.g., seagrasses and oyster communities). The submerged resources survey will begin at the mean high water line along the project shoreline and extend at least 100 feet beyond the boundaries of the proposed waterfront structure (i.e., fishing pier) footprint. The survey will employ qualitative and quantitative methods accepted by state and federal regulatory and resource agencies. Please note that the NMFS requires seagrass surveys to occur between June 1 and September 30.

Subtask 1.1.3 Natural Resources Survey Report: The Consultant will prepare a natural resources survey report to document the survey findings (Subtasks 1.1.1-1.1.2). The report will describe the survey methodology and characterize and quantify biological communities within the survey area. The report will include resource maps that delineate the survey area resource boundaries including wetland communities and submerged resources.

Subtask 1.2 Coordination Meeting: The Consultant will coordinate with the DEP Project Manager and schedule a meeting to review and discuss the natural resource survey findings and the potential effect on project design, permitting, and construction. Such effects may include, but not be limited to, reorientation or revision of the conceptual pier design layout and/or deck elevation (performed under separate/future authorization), increased regulatory coordination, seagrass mitigation design, incorporation of alternative materials such as grated decking, etc. Prior to the meeting, the Consultant will coordinate internally with senior biologists and with DEP regulatory staff and be prepared to address pertinent issues with the DEP Project Manager. The Consultant shall prepare an agenda for the meeting and distribute it to all invited attendees at least two (2) business days prior to the meeting for review and comment.

Deliverables Subtasks 1.1 – 1.2: The Consultant shall provide one electronic copy (via email in .pdf format) of the draft natural resources survey report to the DEP Project Manager for review. After receipt of DEP comments, The Consultant will revise the draft report as necessary and submit (via email) one electronic copy (.pdf format) of the final report and all digital data files in ArcGIS (.shp) format. The Consultant shall also provide to the DEP Project Manager a copy of the meeting agenda, attendance log, and minutes from the coordination meeting.

Performance Measures Subtasks 1.1 – 1.2: The DEP Project Manager shall review the natural resource survey report to verify satisfactory completion of the services rendered. The DEP Project Manager shall also review the proposed agenda (prior to the meeting), attendance log, and coordination meeting minutes to verify satisfactory completion of the services rendered. The DEP Project Manager shall notify the Consultant of any deficiencies in the deliverable(s) and shall give the Consultant reasonable opportunity to correct noted deficiencies and provide a revised deliverable(s).

Schedule Subtasks 1.1 – 1.2: Assuming the Task Assignment is authorized by September 17, 2018, the natural resource survey shall occur prior to September 30, 2018 in accordance with NMFS guidelines. If schedule requirements necessitate, the Consultant may request and secure written approval from

DEP Agreement No. CN335, Task Assignment No. 5, Page 4 of 4 regulatory agencies to conduct surveys into early October; however, such approval is not guaranteed. The draft natural resource survey report will be provided to the DEP Project Manager within four (4) weeks from the date of the survey(s) (Subtasks 1.1.1-1.1.2). The Consultant shall schedule the coordination meeting within two (2) weeks of completion of the natural resource survey and provide draft meeting agenda before the meeting and attendance log and meeting minutes within one (1) week of the meeting date. Final task deliverables will be provided to the DEP Project Manager within one (1) week following receipt of DEP comments.
