Memorandum To: Angela Knecht, Division Director Through: Lisa Robertson, Program Administrator CC: Devurnya Roberts, Budget Analyst Kimberly Walker, Budget Analyst From: Pearce L. Barrett III, P.E., Project Manager

SUBJECT: DEP Contract CN335, Task Assignment No. 11 - Change Order No. 2, Norriego Point Recreation Construction Engineering Services DATE: June 23, 2022

The Norriego Point Project design and permitting was initiated in 2014 and construction phases I (Shoreline Stabilization) and phase II (dune vegetation) were completed in Fall, 2018, and Spring, 2019 respectively. Phase III of the project, the final phase, includes the construction of a new restroom, shade pavilion, ADA beach access, harbor side boardwalk and dune crossovers. As set forth in the stipulation for the project the City of Destin is obligated to construct an extension of Gulf Beach Road to provide improved access to the park for persons entering from the landward side. Since completion of Phase II the City has been in negotiations with the owner/developer of the adjacent property to have as part of the development’s development order pay for construction of the roadway extension, parking, utilities, and associated enhancements that will go along with the roadway extension.

During the period that the city/developer negotiations have been going on, construction of the recreation facilities have been placed on hold. Until the roadway is completed, building permits cannot be obtained for the new facilities due to several factors:

1. Without a permanent traversable surface for emergency vehicles (EMS, firetrucks etc.) the city fire marshal will not sign off on the plans.

2. A fire hydrant must be also installed within the required distance from the new restroom.

The city and owner/developer have finally been able to enter into an agreement that will have the city, through its consultant, design and permit the roadway extension that will provide access to the park and allow the developer to move forward with their plans for building on the adjacent property. The developer will be responsible for the construction of the roadway but until this work begins DEP does not have assurance that we can release the recreation facilities out for bids.

Another issue, that has evolved during the time that DEP has been waiting on the city and developer to resolve the roadway issue, is that excessive erosion and reduction of the newly constructed “dune” has been occurring at the northern end of Norriego Point. This is largely due in part to an increase in the number of watercrafts entering and exiting the harbor entrance causing an increase in wave action not anticipated in the original designs.

It has become apparent that additional stabilizing of this area is needed, and it has been requested by the city that this problem be resolved as a part of the recreation facility phase.

Because of these changes, additional scope and delays it has become apparent that additional tasks and fees need to be added to Taylor Engineering’s Task Order. These tasks and associated fees are summarized in the following:

Additional Scope and Fee Recommendations

Task 5.1 - Provides for additional scope and fees designated for the Consultant to assist, when requested, the DEP project manager in coordinating with the city, developer, and roadway contractor during the design and construction of the roadway.

Fee- Not to exceed $12,421.64

Task 5.2 - Provides for additional scope and fees to have the Consultant revise the current construction drawings and technical specifications for the recreational facilities to match up with the City’s roadway plans to include revision of utilities, access, staging areas and current cost estimate to assist with preparing of bid documents. These revisions will also include final designs for erosion mitigation.

Fee – Fixed Price - $34,149.06

Task 6 – Mitigation of the Erosion at North End of Norriego Point – This task includes additional scope for performing necessary topographic/bathymetric, MHW, and natural resource surveys for preparing and applying for DEP and

USACOE permits.

Fee – Fixed Price $

Summary of Costs

Original NRDA Funding - $10,228,130.00 Funding from ORCP - $3,768,750.00 Adjusted Budget - $13,996,880.00

DEP Contract No. CN335, Task Assignment No. 11 Scope of Work

Norriego Point Recreation Construction Engineering Services Change Order No. 2

This change order adds the following tasks:

Description: The Norriego Point Recreation project (Project) is the third phase of the Norriego Point Project that includes construction of recreational amenities that includes construction of a new restroom, ADA accessible shade pavilion, ADA beach access, harbor side boardwalk and dune crossovers. Phase I (shoreline stabilization) and Phase II (dike vegetation) were completed in 2018 and 2019 respectively. Construction of the recreational facility phase has been delayed due to extended negotiations between the City of Destin (city) and the owner/developer (developer) of the property adjacent to Norriego Point Park (park). The city is ultimately responsible for construction of the access road to the park but has been negotiating with the developer to build the road as part of their development order.

Because of these extended negotiations and final roadway designs provided by the city’s consultant, the scope of work in Taylor Engineering’s (consultant) contract no. CN335 has needed to be revised due to factors outside the control of the Department and consultant. The city and the developer are intending to construct an extension of Gulf Beach roadway (Roadway) in the next six (6) to twelve (12) months, that will allow increased access to Norriego Point and allow a release of a building permit for the Recreational Facilities from the city building department. This change order will also allow the consultant to assist the DEP project manager in coordinating with the city/developer during the roadway design and construction process and revise the recreation facilities construction drawings to match up with roadway changes by the city/developer.

Additionally, the Department and city have requested the project include design of permanent erosion mitigation measures at the northeastern extent of the Norriego Point stabilization, where vessel wakes are causing ongoing erosion of the vegetated sand dike. Under a separate Contract (RM156; Task 5), consultant performed regulatory permitting assistance for Phase I erosion mitigation features. This additional shoreline mitigation measure to alleviate the ongoing erosion of the vegetated dike includes stabilizing approximately 340 feet of shoreline on the harbor side of the point through use of clean sand fill and articulated concrete mattresses with geotextile underlayment.

Task 5: Coordination and Revision of Bid Documents

Task 5.1: City, Department, and Roadway Contractor Coordination

Description: The new Roadway extension, being constructed by the Developer through agreement with the city, that will provide access to Norriego Point, will need to be substantially complete to the extent that the City’s Building Dept.

will issue a building permit, prior to the Department releasing invitations to bid for the recreation facilities. During construction of the recreational facilities, the roadway will likely be also utilized by the Developer for their own construction activities. Site access and staging areas are limited and will require coordination with the City and Developer to avoid conflict between the developer’s and DEP’s contractors. Prior to the construction of the project, coordination will be required for utility service that would normally be borne by the contractor.

Based on information provided by the City, the Roadway Contractor (led by the City or the neighboring property developer) will install water, sewer, and electrical utility stub-outs on the project parcel for connection to the restroom.

Under this task, Consultant will:

Assist, when requested, the DEP Project Manager, with the coordination of utility requirements with the City and Roadway Contractor.
