This document is a Task Assignment Change Order Form issued by the Florida Department of Environmental Protection (FDEP) for Contract CN330, Task Assignment 25, Change Order #1, involving the consultant firm Cummins Cederberg, Inc. The project is located at Indian Key Historic State Park in Islamorada, Florida, and concerns dock and pavilion replacement improvements. The change order was approved on April 10-16, 2025, with required signatures from FDEP budget, project management, and contract authority representatives, as well as the consultant.

The change order authorizes additional environmental consulting services for coral relocation and monitoring associated with expanded dock pile replacement work. The original task scope anticipated relocating approximately 40 coral colonies based on replacing 22 of 30 dock piles; however, FDEP subsequently confirmed that all 30 piles below the Mean High Water Line must be replaced, requiring relocation of 130 total coral colonies, resulting in an additional 90 colonies beyond the original scope. The change order covers Subtask 4 (Additional Coral Relocation and Baseline Monitoring) at $56,161.98 and Subtasks 5A through 5E (one-week, one-month, three-month, six-month, and one-year post-relocation monitoring and reporting) totaling $50,865.24. The net increase in task amount is $107,027.22, bringing the total task value to $218,436.90, with a schedule extension of 182 days to a new end date of June 30, 2026. The fixed fee component totals $88,487.22, with reimbursable costs of $18,540.00, and payment is contingent upon FDEP approval of deliverables for each subtask.

RE: Contract CN330; Task Assignment: 25 – CO#1

Proposal for Permitting, Coral Relocation and Monitoring associated with Dock Improvements at Indian Key Historic State Park

Dear Mr. Post:

Cummins Cederberg, Inc (Cummins Cederberg) is pleased to present this proposal addendum for our environmental consulting services for the proposed Indian Key Dock Improvements Project located east and waterward of U.S Highway 1 Islamorada, Florida. The proposed Project will include environmental permitting for dock rehabilitation, coral relocation, and post-relocation coral monitoring for up to one-year post-relocation.

The November 2022 engineering conditions assessment of the Indian Key dock piles determined that in-water work would involve replacing 22 of the 30 dock piles. Consequently, upon executing Task Order 25 on February 16, 2023, it was initially anticipated that this would necessitate relocating approximately 40 coral colonies. However, following the execution of TO 25, the scope of work expanded to include replacement of all 30 dock piles located below the Mean High Water Line (MHWL), as confirmed by FDEP. According to the July 2023 Coral Relocation Plan and Mitigation Plan (Cummins Cederberg, Inc.), 130 hard coral colonies and octocorals within the impact area must be relocated. This includes all viable corals and octocorals colonizing the 30 piles, as well as those within a 3-ft buffer surrounding them. As a result, an additional 90 coral colonies must be relocated beyond the 40 colonies addressed in Task Order 25, Subtask

2. The corals will be relocated and reattached on the same day they are harvested (removed) from the project site. Since the approved and permitted recipient site, determined in collaboration with State Park biologists and Cummins Cederberg, is approximately 4 miles from the dock, multiple trips per day may be necessary to complete the relocation. Baseline monitoring and mapping will be conducted after all 130 corals have been relocated. The total relocation process is expected to take 7 days, with Task 25 Change Order #1 accounting only for the 5 additional days required.

Indian Key Dock Coral Relocation and Baseline Monitoring

Indian Key Historic State Park Contract CN330, Task Assignment Number 25 - CO#1

Subtask 4: Additional Coral Relocation and Baseline Monitoring Description: According to the July 2023 Coral Relocation Plan and Mitigation Plan (Cummins Cederberg, Inc.), one-hundred thirty (130) hard coral colonies and octocorals within the impact area must be relocated. FDEP has confirmed that all 30 piles on the dock, located waterward of MHWL, must be replaced. As a result, an additional ninety (90) coral colonies must be relocated beyond the forty (40) addressed in Task Order 25, Subtask 2, dated February 16, 2023. The relocation and reattachment of corals will occur on the same day they are harvested (removed from project site). Baseline monitoring and mapping will be conducted after all one-hundred thirty

(130) corals have been relocated. The total relocation process is expected to take seven (7) days, with Task Change Order #1 accounting only for the five (5) additional days required.

Subtasks 5A, 5B, 5C, 5D, and 5E: Monitoring and Reporting Description: Following relocation, and as part of the baseline monitoring, all colonies will be documented, photographed, and mapped, and GPS coordinates will be collected of the general relocation area. According to the July 2023 Coral Relocation and Mitigation Plan, monitoring will occur at the following intervals:

One-week post-relocation (Subtask 5A) One-month post-relocation (Subtask 5B) Three-months post-relocation (Subtask 5C) Six-months post-relocation (Subtask 5D) One-year post-relocation (Subtask 5E)

The FKNMS has approved this schedule per the USACE issued permit. It is assumed that the one-week post-relocation monitoring (Task 5A) will be conducted within the same mobilization as the relocation and baseline monitoring (Task 4) and all other monitoring events (5B-5E) will be conducted under separate mobilizations. During the post-relocation monitoring events, divers will assess the reattachment status, overall condition, and reattach any colonies that have become de-stabilized or detached. During the baseline, six-month, and one-year events, measurements of the widths and heights will also be collected to estimated coral skeletal and living tissue area.

All baseline data and photographs collected during the relocation and subsequent monitoring events will be submitted within a report (five reports following each monitoring event). The reports will include coordinates of the relocation site, a map of the colonies attached within the relocation site, representative photographs, copies of data sheets and tables of data with information of the species, size, and conditions of the reattached colonies.

Conditions/Assumptions

Client will notify Cummins Cederberg of any known conditions related to the Project that may affect the above-described scope of services.

Client will provide safe access to the Project site as needed by Cummins Cederberg to complete the above-described scope of services.

Costing is based on the relocation and monitoring of approximately one-hundred thirty

(130) hard corals and octocoral colonies total. If the number of colonies required to be relocated by the permitting agencies exceeds one-hundred thirty (130) coral colonies, additional field days will be required, and a task assignment addendum will be provided.

April 8, 2025 Page 9 of 9

It is assumed there will be no legal encumbrance issues and no historical or archaeological resource issues.

Client will provide any available background information, such as as-built drawings, historical photographs, or other available documentation.

An additional in-season (June 1 – September 30) marine resource survey may be required by the FDEP for this Project. If a separate marine resource survey is required, Cummins Cederberg can provide one under an addendum scope of work.

This scope assumes the Florida Keys National Marine Sanctuary (FKNMS) will comment on the USACE permit, or provide a letter of authorization, and a separate FKNMS permit will not be required.

If special conditions are listed in the FDEP or USACE permits that go beyond the scope of this proposal, a task assignment addendum will be required.

The project schedule may be revised as additional project-specific information becomes available during the environmental permitting process.

In-water work will only be conducted pending the determination of safe working conditions for the area. Cummins Cederberg maintains the right to make its own determination on safe working conditions for its divers.

Coral relocation is assumed to occur during good working/weather conditions. If a specific timeframe is required during a period of non-conducive weather conditions, an addendum to add additional field days will be provided.

Reimbursable costs are estimated using current prices; significant increases in costs may necessitate a task assignment addendum.

Per the FKNMS letter of authorization provided within the USACE permit, all non-relocated corals within the footprint and a 50ft buffer must be marked prior to construction and remain in place during construction. Per discussion with the Client, this scope assumes the contractor will be responsible for marking these corals and Cummins Cederberg will not mark corals as part of this scope.

Per the FKNMS letter of authorization provided within the USACE permit, a post-construction benthic survey may be required within one-month of construction completion to assess the status and health of corals not relocated from the project area. It is anticipated that the biologists who conducted the initial survey will complete this survey if required. Otherwise, an addendum will be provided by Cummins Cederberg.

It is assumed that the one-week post-relocation monitoring (Task 5A) will be conducted within the same mobilization as the relocation and baseline monitoring (Task 4) and all other monitoring events (5B-5E) will be conducted under separate mobilizations. Should the one-week post-relocation monitoring (Task 5A) require an additional mobilization due to weather or unforeseen circumstances, an addendum will be provided by Cummins Cederberg.
