About this file

This document is a Questions and Answers response issued by the City of Madison Engineering Division regarding RFP #9296 for Environmental Consulting Services, dated February 21, 2023. The RFP seeks qualified environmental consulting firms to provide environmental site assessment services on an as-needed basis for properties owned by or being considered for purchase by the City of Madison, as well as for right-of-way activities during construction. Services encompassed in the RFP include Phase 1 Environmental Site Assessments (ESAs), Phase 2 ESAs, Hazardous Materials Assessments (HMAs), soil boring investigations, groundwater sampling, and construction oversight of contaminated soil and groundwater management. The RFP requires consultants to work on both City-owned and private properties, with the City's Real Estate department handling access negotiations while the consultant coordinates drilling and sampling logistics. Example projects provided in the RFP include Phase 1 HMA work following the Wisconsin Department of Transportation (WisDOT) Facilities Development Manual (FDM) Process, Phase 2 ESAs, and environmental construction oversight. The City requires that only Wisconsin Department of Natural Resources (WDNR)-certified laboratories be used for specified analyses, with sampling and laboratory Standard Operating Procedures available upon request. Project examples must be from the consultant's work within the past three years for any client type, and references must also span the previous three years.

Proposed budgets for environmental services are provided based on recent contract examples. A Phase 1 ESA for a single property is estimated at approximately $3,200 to $5,750 as a fixed fee, while Phase 2 ESA work is estimated around $6,000. Investigation work involving soil borings and sampling, such as the University Avenue Reconstruction project, was budgeted at $39,000. Construction oversight for contaminated soil and groundwater management was proposed at $22,700 on a time-and-materials basis. Fee schedules from incumbent contractors SCS Engineers and TRC Environmental Corporation detail labor rates ranging from approximately $74 to $250 per hour depending on staff classification, with equipment and subcontractor services billed at cost plus 10 to 15 percent markup. The City clarified that investigation-derived waste characterization and disposal costs must be included in proposals, with cuttings disposed of at local Subtitle D landfills and purge water at the local wastewater treatment plant. The winning contractors from the previous February 2020 bid were TRC Environmental Corporation and SCS Engineers, whose prior proposals and purchase orders are referenced as examples of scope and cost for bidders to review.

FROM: James M. Wolfe, City Engineerg

RE: Environmental Consulting Services RFP Questions and Answers (Contract #9296)

The City of Madison received the following questions in response to RFP #9296:

1. Is the scope of work anticipated to take place on private or public properties? On private properties, is the consultant expected to correspond with and negotiate access/drilling agreements with the private property owner?

Work will happen on both City‐owned and private properties. In the case of private properties, our Real Estate department will negotiate the access agreement, but the Consultant will be responsible for coordinating drilling and sampling logistics.

2. Is a QAPP already in place for this contract, or will the contractor be expected to participate in QAPP development?

We have not required a QAPP under the existing contract. However, the City expects the winning Consultant(s) to only contract with laboratories that have WDNR‐certification for the specified analyses/matrices. You must include information about your contract lab(s) in your submittal.

Sampling and laboratory SOPs must be available upon request.

3. Shall the consultant be expected to include costs for investigation derived waste characterization (e.g.

drums of soil cuttings, purge water) and disposal in their proposal?

Yes. For Project Example #3, assume that cuttings require landfilling at a local, nonhazardous, Subtitle D landfill and purge water can be disposed of at the local WWTP.

4. Would the City be willing to revise the requirements for similar example projects within the last five years (instead of three), and references for the last five years (instead of three)?

No. The request for example projects in the last three years is not specific for local government clients. This can be Phase 1s, Phase 2s, site investigations, or remedial planning for any client.

5. For Project Example #2 – Do you mean just a Phase 1 of the WisDOT FDM Process?

Yes, Project Example #2 asks for a budget to conduct a Phase 1 HMA following the FDM. Do not include any subsurface work.

Deputy City Engineer Bryan Cooper, AIA

Gregory T. Fries, P.E.

Chris Petykowski, P.E.

Deputy Division Manager Kathleen M. Cryan

Principal Engineer 2 John S. Fahrney, P.E.

Janet Schmidt, P.E.

Principal Engineer 1 Christina M. Bachmann, P.E.

Mark D. Moder, P.E.

Financial Manager Steven B. Danner-Rivers

6. Is the HMA cost scenario geared toward road structures (bridges/culverts), building structures (potential building encroachments into ROW), or both?

The HMA scenario refers to the public right of way and road structures.

7. Does Project Example #2 refer to a stretch of county highway in an urban, developed area or a rural, undeveloped area?

Project Example 2 asks for an HMA covering county highway “at the edge of the City of Madison”, new urban transitioning to rural. A recent example of this would be construction work on Mineral Point Road or S. Junction Road, west of the Hwy 12/18.

8. For the Example Project #2, can you provide information on the number of sites requiring WDNR review you expect to encounter?

Assume the HMA requires the review of two WDNR BRRTS cases.

9. Please clarify the WDNR reporting requirement for Example Project #3, the Phase 2 ESA?

Assume no WDNR reporting requirements or submittals.

10. For Project Example #4, would this oversight work require a PE/PG, or is an experienced and qualified Environmental Technician working under the direction of PE/PG acceptable?

A qualified Environmental Technician supervised by a PE or PG is acceptable.

11. Can the City please provide the previous publicly available proposals submitted for this contract?

The consultant proposals from February 2020 are attached as a zipped folder. The winning firms from that bid were TRC Environmental Corporation and SCS Engineers.

12. Can the City please provide details related to existing and previous expenditures or budgets related to this contract?

See attached recent Phase 1 and Phase 2 bids and purchase orders.

Sincerely, James M. Wolfe, P.E., City Engineer

Ms. Brynn Bemis City of Madison 210 Martin Luther King Jr. Blvd.

Madison, WI 53703

Subject: Updated Right of Way Investigation Proposal University Avenue Reconstruction

Dear Ms. Bemis:

Thank you for the opportunity to provide you with this proposal for environmental investigation services related to the proposed reconstruction of University Avenue. The scope of services and costs are outlined below.

SCS Engineers (SCS) reviewed the Hazardous Materials Assessment (HMA) prepared by KL Engineering, which identified 20 potential hazardous material source sites along the proposed reconstruction project length. The proposed scope of work consists of soil borings, primarily in the current roadway, to investigate potential impacts related to current or historical structures or uses identified by the HMA. Potentially impacted soil and groundwater may affect the reconstruction based on the need for special handling and disposal of soils and dewatering spoils. The investigation will allow potential bidders to accurately include these special provisions in their bids.

SCOPE OF SERVICES

SCS will perform the following tasks:

Task 1. Project Management

• Coordinate with the Geoprobe™ (geoprobe) and laboratory subcontractors.

• Arrange for Digger’s Hotline or other authorized utility locator to mark underground utilities.

• Prepare a site-specific Health and Safety Plan to be used by SCS personnel on site.

• Act as client liaison and coordinate meetings.

Task 2. Field Investigation The field investigation includes 32 soil borings to a depth of 10 to 30 feet. The depth of the proposed borings is based on the anticipated depth of excavation at each boring location.

• Inspect the proposed boring locations and finalize locations based on utilities and traffic controlled areas.

enblb2 Text Box Example Budgets of Recent Work

• Observe and document the drilling of as many as 32 geoprobe soil borings. Collect continuous soil samples from the borings. Describe and classify the samples using the Unified Soil Classification System, noting stratigraphy and moisture. Perform headspace analysis on each soil sample using a photo-ionization detector.

• Analyze one soil sample from each boring for volatile organic compounds (VOCs). At former gas/service station sites, also analyze one sample for lead by toxicity characteristic leaching procedure (TCLP).

• Where cinders, ash, or other suspect fill materials are observed, analyze as many as five samples for eight RCRA metals by TCLP, semi-volalatile organic compounds, and polychlorinated biphenyls (PCBs).

• Collect groundwater samples from approximately six borings for VOC analysis.

• Document the abandonment of the borings in accordance with NR 141, Wisconsin Administrative Code. Abandonment will be completed by topping off the boring with several inches of soil, concrete, or asphalt.

• Soil cuttings will be containerized in steel drums and left on a city-owned property along the project length, such as the Well #6 property at 2757 University Avenue.

Assumptions

• The City of Madison will waive/coordinate the street opening permits for this work.

• An SCS field geologist will be on site for three (3) days to observe and document drilling activities and collect soil and groundwater samples. An SCS field technician will be also on site to assist with traffic control and sample collection.

• Soil borings will be drilled using a geoprobe. On-site soils are believed to consist of mixed materials of glacial origin and fill materials. Bedrock was observed in previous investigations, with the depth varying significantly.

• On-site underground utilities will be located by Digger’s Hotline, as all work will be completed within the public right-of-way.

• Traffic control will be supplied by SCS and will consist of advanced warning signs, a mobile sign board and cones/pylons around the work area.

• Drilling areas will be limited to the far right or left lanes along the curb.

• Drilling operations will be limited to approximately 6 hours per day due to traffic control limitations.

• A second mobilization with rock drilling equipment may be required if it is not possible to collect groundwater samples at the desired locations. The cost of an additional mobilization is not included in this proposal.

Task 3. Data Analysis and Report Preparation

• Evaluate field and laboratory data and prepare a brief letter report that documents the field investigation activities and presents the investigation results. The report will include the following:

– Description of sampling activities and laboratory analysis

– Wisconsin Department of Natural Resources soil boring logs and abandonment forms

– Tabulated results of laboratory chemical analysis performed on soil and groundwater samples

– Site location map

– Site figure with boring locations

– Recommendations for additional investigation or remediation, if necessary

Assumption

• The report is not intended for, or to be relied on, by persons not party to this agreement.

TIMELINE

SCS will complete the proposed investigation work and laboratory analytical testing and prepare a documentation report within approximately 8 - 10 weeks of the notification to proceed.

ESTIMATED COST

Our estimated cost for the investigation scope is $39,000. These are estimated costs only. Actual costs will depend on conditions encountered in the field, actual hours worked, and final subcontractor costs.

Final billings will be based upon actual time and materials used extended at the quoted fee rates in the Fee Schedule. Final billings will not exceed the cost estimate without prior written approval. The scope of services will not change from that outlined in this proposal without your prior authorization.

If the proposal is acceptable to you, please send us a purchase order by email to eoelkers@scsengineers.com or fax (608-224-2839). Please contact Eric at 608-216-7341 if you have any questions or comments concerning our proposal.

Total: 13

Advise the project engineer and highway contractor on the requirements for the management of contaminated soil excavated, and groundwater if encountered, during the highway construction. It is anticipated that the highway contractor can be directed on the appropriate segregation and reuse of cinders as backfill (if geotechnically suitable as determined by the geotechnical engineer) when encountered, reducing the time required for TRC to be on-Site.

Soil sampling will be performed as needed to document the extent of contamination encountered during excavation activities for the project where the presence and/or extent of contamination was not determined during previous excavations. Up to eight (8) soil samples are anticipated and will be analyzed for petroleum volatile organic compounds (PVOCs) plus naphthalene by a Wisconsin-licensed analytical laboratory on a standard ten (10) day turnaround.

Prepare a letter-style report documenting the results of the field-screening and management of potentially contaminated soil and groundwater if encountered, and submit to the City and the Wisconsin Department of Natural Resources (WDNR).

Assumptions:

13 days on-site have been budgeted for field-screening and oversight during excavation of potentially contaminated soil for the north (westbound) side of University Avenue. On-site time will be as required by the contractor’s schedule.

Stationing of contaminated areas and estimations of contaminated soil volumes are derived from WisDOT Highway Work Proposal Number 009 and the 2022 Materials Management Plan prepared by SCS Engineers.

Analytical results from previous investigations will be used for waste characterization. The City will profile the generated wastes with the selected disposal facility.

Costs to excavate, transport, and dispose of contaminated soil will be billed by the contractor to the WisDOT project. Such costs are therefore not included herein.

The Scope of Services for this Work order will be performed on a time-and-materials basis under the terms and rates of the City of Madison Contract for Purchase of Services (Design Professionals) with TRC Environmental Corporation, Inc. executed March 18, 2020 and renewed in Amendment #2 March 2022.

Acceptance:

Authorization for TRC to commence work included in this Work Order constitutes acceptance of this Agreement.

Acceptance can be made by signing in the place provided below, issuance of a purchase order, or by receipt of written authorization from Client to TRC to commence work.

Subject: Phase 1 Environmental Site Assessment Proposal 2300 Block of South Park Street, Madison, Wisconsin

Dear Ms. Bemis:

This proposal provides the scope of services, estimated schedule, and cost to perform a Phase 1 Environmental Site Assessment (ESA) on the Villager Mall property located along the 2300 block of South Park Street, with PIN number 251/0709-352-0406-9, in Madison, Wisconsin, hereafter referred to as the Property.

PHASE 1 ENVIRONMENTAL SITE ASSESSMENT

SCS Engineers (SCS) proposes to complete a Phase 1 ESA on the Property consistent with the process outlined in the Environmental Protection Agency (EPA) Standards and Practices for All Appropriate Inquiry (AAI) as set forth in 40 CFR, Part 312, and the ASTM International (ASTM) Standard Practice E 1527-13.

The purpose of the Phase 1 ESA is to identify whether the Property is subject to recognized environmental conditions (RECs). ASTM E 1527-13, section 1.1.1, defines a REC as “[T]he presence or likely presence of any hazardous substances or petroleum products in, on, or at a property: 1) due to any release to the environment; 2) under conditions indicative of a release to the environment; or

3) under conditions that pose a material threat of a future release to the environment. De minimis conditions1 are not recognized environmental conditions.”

The above-referenced EPA and ASTM standards were not developed to identify all environmental risks to property. The standards were developed to allow a User2 (Client) to qualify for the innocent purchaser defense, bona fide prospective purchaser defense, and contiguous property owner defense to landowner liabilities under the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (CERCLA, also known as Superfund) and subsequent amendments.

The Phase 1 ESA is intended to constitute an appropriate inquiry into the previous ownership and uses of the Property consistent with good commercial and customary practice, as part of the due diligence process required by CERCLA, the Superfund Amendments and Reauthorization Act of 1986 (SARA), and the Small Business Liability Relief and Brownfields Revitalization Act of 2002 (Acts).

1 As defined in ASTM E 1527-13, section 3.2.22 – “A condition that generally does not present a threat to human health or the environment and that generally would not be the subject of an enforcement action if brought to the attention of appropriate governmental agencies.”

2 As defined in ASTM E 1527-13, section 3.2.98 – “The party seeking to use Practice E1527 to complete an environmental assessment of the Property…”

Brynn Bemis

SCOPE OF SERVICES

SCS will provide the following services consistent with ASTM E 1527-13:

• Review reasonably ascertainable environmental and historical records, based on their availability and our professional discretion. Records include the following:

– Standard federal, tribal, and state inventories of contaminated sites within minimum search distances from the Property;

– Physical setting sources including U.S. Geological Survey (USGS) topographic maps, and Soil Conservation Survey soils maps; and

– Standard sources of historical information including aerial photographs, fire insurance maps, USGS topographic maps, property tax files, assessor’s office files, street directories, building department records, zoning/land use records, and other sources (newspapers, internet sites, local libraries, interviews, etc.).

• Inspect the land and structures located on the Property, and observe the adjoining properties to the extent that they can be seen from the Property or public property.

Current and past uses of the Property and surrounding area are considered, and the primary features of the Property noted. Observations focus on evidence of spills, leaks, chemical storage, stressed vegetation, and other indications that hazardous substances or petroleum products may have been released.

• Interview individuals likely to have information regarding the potential for contamination at the Property. Individuals interviewed may include local government officials, past or current owners, operators or occupants, and the key site manager. The key site manager, as identified by Client, is generally the property manager, physical plant supervisor, or maintenance person most familiar with the uses and physical characteristics of the Property. Prior to the Property inspection, we ask that Client and/or the key site manager provide copies of helpful information and documents related to the Property.

• Review information and documents provided by the User related to the Property.

• Review the responses to a User Questionnaire provided by SCS.

• Review regulatory files associated with the listing of the Property, or adjoining properties, on any of the standard environmental record sources indicating contamination. The purpose of the regulatory file review is to obtain sufficient information to determine if a REC exists on the Property in connection with the listing.

• Provide an electronic copy of the Phase 1 ESA Report to Client. The findings, opinions, and conclusions in the Phase 1 ESA Report will be supported by documentation that, where appropriate, will be included as attachments to the report.

Assumptions

• Information to be reviewed is obtainable within reasonable time and cost constraints.

The information is available from the source within 7 calendar days of the request for the information.

Brynn Bemis

• Regulatory file reviews to determine if a REC exists on the Property in connection with listings is completed within 4 hours. A summary of pertinent information and copies of selected documents are included in the report.

• SCS supplies an environmental lien search of the Property for one deed. If the Property has more than one deed the additional cost for the environmental lien search is $110 per additional deed.

• Access to the Property is arranged by the Client. The Property inspection is completed in 1 day during normal business hours, and a knowledgeable person familiar with the site usage and history provides unrestricted access to the land and all structures on the Property.

• Client is the designated User. Upon written request from the Client, SCS provides a standard reliance letter allowing use of the report to one additional entity. Additional reliance letters or letters requiring negotiation of conditions are provided at cost using SCS’s standard rates (Fee Schedule attached).

ESTIMATED SCHEDULE AND COST

SCS will begin work upon receiving a signed purchase order from Client and complete the Scope of Services within 30 business days. We can often accommodate shorter project schedules depending on your specific needs.

The cost to complete the Scope of Services is a fixed fee of $5,750 invoiced at the end of the project. Additional scope costs, as needed, will be billed at a time and materials rate according to the attached rate sheet. If the Property has more than one deed, there is an additional fee of $110 per deed to complete the environmental lien search.

September 26, 2022 File No. 25220105.00

Ms. Brynn Bemis City of Madison 210 Martin Luther King Jr. Blvd.

Madison, WI 53703

Subject: Phase 2 Environmental Site Assessment Proposal and Agreement Centro Hispano of Dane County 810 W Badger Road, Madison, WI 53713

Dear Ms. Bemis:

Thank you for the opportunity to provide you with this proposal for Phase 2 Environmental Site Assessment (ESA) services at the above-referenced property. The scope of services and costs are outlined below.

SCS Engineers (SCS) prepared a Phase I ESA at the 810 W Badger Road property (Subject Property) in August 2022 and identified the following recognized environmental conditions (RECs):

1. The potential use of fuel oil in early homes on the Subject Property.

2. The use and generation of ammonia and or ammonium hydroxide on the Subject Property and unknown quantity, handling, and disposal practices.

3. The limited information regarding the use of benzene, ignitable waste, and tetrachloroethylene on the Subject Property.

Due to the potential for a release of hazardous substances and or petroleum products on the Subject Property, SCS recommends a Phase 2 ESA.

SCOPE OF SERVICES

SCS Engineers (SCS) will perform the following tasks:

September 26, 2022

Task 2. Field Investigation

• Observe and document the drilling of five geoprobe soil borings to 10 feet below ground surface (bgs). Collect continuous soil samples from the borings. Describe and classify the samples using the Unified Soil Classification System, noting stratigraphy and moisture.

Perform headspace analysis on each soil sample using a photoionization detector.

• Analyze one soil sample from each boring for volatile organic compounds (VOCs), ammonia, metals, and or polycyclic aromatic hydrocarbons (PAHs).

• Document the abandonment of the borings in accordance with NR 141, Wisconsin Administrative Code. Abandonment will be completed by topping off the boring with several inches of soil, concrete, or asphalt.

Assumptions

• An SCS field geologist will be on-site for 1 day to observe and document drilling activities and collect soil samples.

• Soil borings will be drilled using a geoprobe. On-site soils are believed to consist of silty sand or sandy silt. Bedrock is estimated to be around 10 feet but could be as shallow as 5 feet bgs or as deep as 20 feet bgs.

• Groundwater is estimated to be within bedrock at about 20 feet bgs.

• On-site underground utilities not located by Digger’s Hotline will be located and marked by a private locator contracted through the driller.

• All proposed boring locations are accessible and or will be adjusted slightly depending on site conditions and drilling access

– Tabulated results of laboratory chemical analysis performed on soil samples

– Site location map

– Site figure with boring locations

– Recommendations for additional investigation or remediation, if necessary

Assumption

• The report is not intended for, or to be relied on, by persons not party to this agreement.

September 26, 2022

ESTIMATED COST

Our estimated cost for the Phase 2 ESA is detailed in the table below.

Task Cost 1 Phase 2 ESA (field work + reporting) $6,000 Total $6,000

These are estimated costs only. Actual costs will depend on conditions encountered in the field, actual hours worked, and final subcontractor costs.

Final billings will be based upon actual time and materials used and extended at the quoted fee rates in the Fee Schedule. Final billings will not exceed the cost estimate without prior written approval. The scope of services will not change from that outlined in this proposal without your prior authorization.

If the proposal is acceptable to you, please return a purchase order to Tony Kollasch at tkollasch@scsengineers.com. Please contact Jackie at (608) 381-9188 or Tony at (608) 843-3870 if you have any questions or comments concerning our proposal.
