Phase I Environmental Site Assessment ProSource will perform a limited corridor Phase I ESA for the project in consideration of ASTM Standard 1527-13, with oversight of a qualified Environmental Professional per the ASTM standard.
The intent of the limited corridor Phase I ESA is to identify the extent practicable of potential sources of contamination (based on present or former land use) on properties that could impact the road reconstruction project.
The purpose of conducting the Phase I ESA is to provide information about the general environmental character of the Properties along the corridor; and satisfy one of the requirements to qualify for the innocent landowner, contiguous property owner, or bona fide prospective purchaser limitations on Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) liability in accordance with 42 USC §9601(35)(B), if the need should arise. That requirement includes conducting “all appropriate inquiry into the previous ownership and uses of the Property consistent with good commercial and customary practice.”
In addition, the Phase I ESA will be completed with consideration of property transfer guidelines to determine if a release or threatened release of a hazardous substance, pollutant or contaminant exists or has occurred. The following description provides a detailed scope of work to conduct a Phase I
ESA.
The scope of services to be provided by ProSource to conduct a Phase I ESA includes the following:
1. Site Location – Describe the location of the corridor, by street address, township and municipality, county, and United States Geological Survey (USGS) Quadrants to the nearest 1/4 section.
2. Uses of the Corridor – Identify obvious uses of the corridor from the present, back to the corridor’s first developed use, or back to 1940, whichever is earlier.
3. Uses of Property in Surrounding Area – Identify uses of surrounding parcels, to the extent that this information is revealed in the course of researching the corridor Properties.
4. Site Reconnaissance – Visit the corridor in an effort to visually or physically determine the presence of underground or aboveground storage tanks (USTs or ASTs) including types of materials stored, refuse disposal, wells, septic systems, sumps, pits, ponds, lagoons, catchment basins, retention ponds, areas of surface soil staining, stressed vegetation, or any other obvious indication of a contamination source. Adjacent properties will also be assessed to determine if they are potential sources of contamination. The site reconnaissance will be performed from the public road right of way.
5. Site Maps – Provide historic and current topographic maps that designate the locations of pertinent site features, structures and potential sources of contamination.
6. Database File Search – Conduct a database file search of all applicable State, Federal and Tribal regulatory agencies to determine the presence of known contaminated sites near the corridor.
7. Information Requests – Inquire via letter or telephone interview with local officials regarding their knowledge of the corridor. A reasonable attempt will be made to contact at least one staff member of any one of the following types of state and or local government agencies: the local fire department, State or local health department, local engineering and/or public works department, planning and development personnel of the city, county and other development authorities, zoning and assessment personnel of the city or county, the county solid waste officer, the county hazardous waste officer, and the local fire department inspector.
ProSource Technologies, LLC City of Madison 16
8. Water Supply – Attempt to identify through database research the locations and presence of water supply wells within the corridor and on adjacent properties.
9. Aerial Photographs – Provide and review copies of aerial photographs, or reasonable facsimiles, to check for altered land use, previous storage, etc.
10. Sanborn Maps – Provide and review copies of historic Sanborn fire insurance maps, or reasonable facsimiles, to check for altered land use, previous storage, etc.
11. City Directories – Review historic city directories that have been published to determine the history of occupancy.
12. Other Historical Records – Review as necessary other historical records including but not limited to Property tax files, recorded land title records, building department records, zoning department records and other reasonably ascertainable historical sources that identify past uses of the Properties within the corridor.
All information gathered during the Phase I ESA will be presented in a single comprehensive report.
The report will identify recognized environmental conditions (RECs) and will provide recommendations for any additional actions along the study corridor.
Users Responsibilities In accordance with ASTM 1527-13, several tasks are to be provided by the User and will help identify the possibility for recognized environmental conditions in connection with the Properties.
The following tasks are typically expected to be completed by the user and this information provided to ProSource (environmental consultant).
1. Environmental Cleanup Liens (note: ProSource can provide this title research service for an additional fee).
2. Activity and land use limitations that are in place on the Properties or that have been filed or recorded in a registry.
3. Specialized knowledge or experience of the person seeking to qualify for the Landowner Liability
Protection.
4. Relationship of the purchase price to the fair market value of the Properties if they were not contaminated.
5. Commonly known or reasonably ascertainable information about the Properties.
6. The degree of obviousness of the presence of likely presence of contamination at the Properties, and the ability to detect the contamination by appropriate investigation.
Assumptions/Conditions
1. No attempt will be made to perform a compliance audit involving regulatory permit review for any on-site operations or adjacent areas of concern identified during this ESA, or for any planned use of the corridor.
2. ProSource will be provided with the names and telephone numbers of key contact persons at the City.
3. It will be necessary to contact only those agencies specified in the proposed scope of services to obtain information on current and prior ownership, land use and regulatory compliance.
Furthermore, it is assumed that all information compiled from these agencies can be obtained without conducting on-site interviews with departmental staff.
4. The field reconnaissance will not include entrance to private property or structures along the corridor.
5. The field reconnaissance will be performed from the public road right of way.
ProSource Technologies, LLC City of Madison 17
Phase I ESA Report and Phase II ESA Recommendations A Phase I ESA report will be prepared in accordance with the format presented in guidance document ASTM 1527-13. Following completion of the Phase I ESA report, a Phase II ESA recommendation and work plan letter will be prepared.
Phase II Environmental Site Assessment Prior to conducting the soil probing:
ProSource will review the City’s project plans as provided by the City to identify the potential locations of underground utilities in the project area in order to plan the placement/marking of the soil probes.
ProSource will obtain the required City street use permit, soil boring/utility opening/excavation permit and meter hooding or no parking signage (as necessary).
ProSource will prepare a project Health and Safety Plan.
The soil probe contractor will obtain any required soil boring permits.
ProSource will mark the proposed locations of the soil probes prior to the public utility locate.
The soil probe contractor will submit the public utility locate one call notice.
Environmental Soil Probes Soil probe work will be conducted by a subcontractor registered with the City under the on-site supervision of ProSource. The soil probes will be advanced using a hydraulic direct push machine mounted on either a wheeled or a tracked vehicle.
Soil Sampling and Laboratory Analysis of Soil After collection, the recovered plastic sleeve filled with soil will be cut open to expose the sampled soil. The recovered soil will be visually characterized and recorded on a log sheet. A portion of the recovered soil will be placed in a sealable plastic bag. The collected soil samples in the plastic bags will be screened with a photoionization detector (PID) for the presence of volatile organic compounds.
One sample from each location will be submitted for laboratory analysis. Soil sample laboratory analysis will be conducted by a subcontracted laboratory. The laboratory analyses selected will be based on the City’s bid specifications.
Decontamination Cleaned or single use disposable sampling equipment will be used for sample collection. Sampling equipment in contact with the sampled soil will be decontaminated (washed) between each sample interval and between soil probe holes.
Restoration Each soil probe and soil boring will be soil backfilled and/or bentonite grouted in accordance with State of Wisconsin regulations. The disturbed asphalt/paved street surface will be patched with asphalt patch to the field measured depth of the asphalt street.
