About this file

This is a technical proposal submitted by Environmental Testing & Consulting, Inc. (ETC) to the City of Madison, Wisconsin, in response to RFP# 8914-0-2020-BG for Environmental Consulting Services. The proposal was submitted on February 14, 2020, by the 2:00 PM CST deadline to Ms. Brittany Garcia at the City of Madison Purchasing Services. The City of Madison Engineering Division sought proposals from qualified environmental consulting firms to provide environmental site assessment services on an umbrella contract basis for as-needed work on land owned or being considered for purchase by the City, or in the right of way during construction activities. ETC's proposal outlines three primary service categories: Phase I Environmental Site Assessments conducted per ASTM E1527-13 standards, Phase II Environmental Site Assessments including soil and groundwater sampling per ASTM E1903-11 standards, and remediation activities including underground and above-ground storage tank assessments, removal oversight, and field compliance verification. The contract was structured as an umbrella agreement with site-specific work plans and cost estimates to be developed on an as-needed basis as City departments identified environmental consulting needs.

ETC's proposal emphasized the firm's qualifications as a Small Woman Business Enterprise (WBE) and Section 3 Business Concern established in 1989, with offices in Michigan and extensive experience conducting environmental assessments for municipal entities, housing authorities, and land banks throughout the Midwest. The company maintains Errors & Omissions and Professional Liability Insurance, employs 85 staff members including 20 asbestos-certified and 17 lead-certified professionals, and holds multiple certifications and accreditations including NVLAP and EMLAP laboratory accreditation. ETC documented relevant experience with similar government clients including the Detroit Housing Commission (contract since 2008), City of Flint, Flint Housing Commission, City of Lansing, Lucas Metro Housing Authority in Toledo, Oakland County, and the Detroit Land Bank Authority, demonstrating capacity to manage large-scale environmental assessment projects and meet tight compliance timelines. The proposal did not specify pricing terms or a total contract value in the submitted technical document, as pricing was to be determined through site-specific work plans and cost estimates submitted for individual projects initiated by City departments.

IV. SCOPE OF SERVICES

4.1 Phase I Environmental Site Assessments

In conducting a Phase I environmental site assessments, ETC follows the guidelines and procedures established by the American Society for Testing and Materials (ASTM) for conducting Phase I Environmental Site Assessments: E 1527-13 (ASTM Standard Practice for Environmental Site Assessments: Phase I Environmental Site Assessment Process).

Also, the Phase I ESA will be in accordance to an All Appropriate Inquiry (AAI) per the 2002 Brownfield’s Amendments to the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), also known as Superfund, required EPA to promulgate regulations establishing standards and practices for conducting AAI. The AAI final rule was published in the Federal Register on November 1, 2005 (70 FR 66070) and went into effect on November 1, 2006.

The purpose of the Phase I ESA study is to establish an information base for assessing the likelihood of potential “Recognized Environmental Conditions” (RECs), as defined by

ASTM Standard E1527-13 at the subject property. The term “Recognized Environmental

Condition” is defined as, “the presence or likely presence of any hazardous substances or petroleum products in, on, or at a property: (1) due to release to the environment;

(2) under conditions indicative of a release to the environment; or (3) under conditions that pose a material threat of a future release to the environment.” The 2013 ASTM

E1527-13 standard has been modified to also include “Historic” and “Controlled”

Recognized Environmental Conditions, as well as vapor encroachment screening considerations.

To accomplish this, a review of available federal and state environmental databases, using distances specified in ASTM E1527-13, is conducted to identify sites that are a potential risk to impact the study property. Municipal department files and historical documentation are evaluated to identify prior land usage and the potential for soil and/or water sources of contamination. A visual survey of the subject property and mailto:kedwards@calhouncountymi.gov

15 | P a g e interviews are conducted to identify potential indicators of environmental concern and areas of potentially impacted soil and/or groundwater. The survey also includes a visual assessment of the adjacent public roads and adjoining properties, to the extent possible, for the presence of environmental concerns. The Phase I report summarizes

ETC’s evaluations and conclusions and identifies areas of Recognized, Historic, and

Controlled Environmental Conditions.

Phase I ESA Regional Geology/Hydrogeology

ETC has provided regional and local geology/hydrogeology (watersheds) as determined from viewing relevant public resources; United States Geological Survey (USGS) 7.5-minute topographic maps, United States Agriculture Department Soil Surveys, and City documents, aerial photographs, historical Fire Insurance SANBORN maps.

Phase I ESA Historical Records Search/Regulatory List of Sites

ETC has provided Regional 1-mile radius survey of potential environmental impact sites will be performed for the project. This information is used to determine potential pathway migration for potential contaminants on-site and off-site. The survey provides historical records of regulatory sites and contaminated sites within a 1-mile radius including historical sites.

ETC plans to interview personnel regarding potential existing conditions of the property, former building location and uses, if applicable.

Photographs of Property

ETC plans to provide photographs of descriptions (property front, left side, back, right side of structures and hazardous material photos-Color only).

PHASE I ESA REPORT

A Transaction Screen will not satisfy the requirement to conduct all appropriate inquiries into the previous ownership and uses of the property consistent with the Landowner Liability Protections (LLPs) in the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), as defined in 42 U.S.C. §9601(35)(B). To

16 | P a g e qualify for LLPs’ environmental due diligence, a Phase I Environmental Site Assessment (ESA) should be conducted (ASTM E1527: Standard Practice for Environmental Site Assessments: Phase I Environmental Site Assessment Process).

The Phase I ESA report will be provided in a .pdf file and photos will be provided in color only per the RFQ.

4.2 Phase II Environmental Site Assessments

The Phase II sampling design is chosen to: evaluate potential contamination at the subject property resulting from the identified RECs; analyze for the parameters associated with these RECs, and compare the results to Wisconsin DEP Criteria in order to evaluate impacts to the subject property based upon relevant pathways. Relevant pathways to surface soil sampling areas are Soil Residential (more stringent) pathways;

1) Direct Contact Criteria and 2) Infinite Source Volatile Soil Inhalation Criteria as they pertain to Wisconsin Criteria and regulations.

Surface Soil Sampling

Surface Soil Sampling Procedures will be in accordance to accepted practices as described in the “New Jersey Field Sampling Procedures Manual; Technical Guidance” document of 2005 (NJFSP manual). Discreet surface soil samples will be collected using a stainless steel 1-2-inch coring device. The surface soil samples will be collected in the field into appropriate containers and labeled as provided by the chemical analytical laboratory. The soil samples will be logged in the field using procedures in the NJFS manual and appropriate chain of custody procedures will follow. ETC expects the surface soil sampling to be a 1-day process using 2 field personnel. Field decontamination procedures of sampling devices will be used to prevent cross contamination of samples (Quality Control), or inert disposable sampling tools will be used, if appropriate.

Soil Samples can include analysis for MI 10 metals using USEPA method 6010, and PAHs using USEPA method 8270, for PCBs using USEPA method 8082 where electrical signals are identified on the property.

ETC may deem further parameters depending on findings in the Phase I ESA. Vacant farm land may include Pesticides/Herbicides and nitrogen (water samples).

17 | P a g e

Groundwater containing nitrogen with regulated levels and pumped into a water well can cause “blue baby” disease due to removal of oxygen from the water. If fertilizer plants are near a property, this sampling may become prevalent.

New Soil Borings/ Monitor Well Installation and/or sampling

All new soil borings will be drilled and documented using the Unified Soil Classification

System (USCS) for logging soil and groundwater content by appropriate ETC personnel.

Boring logs will be completed and entered into the final Phase II ESA report. MISSDIG will be allowed proper notification to locate underground utilities prior to any drilling or excavation/test pit activities.

Boring and soil sampling procedures will be conducted using the NJFSP manual as a guideline of accepted practices. At this time, ETC is proposing probe drilling or hollow stem auger driller depending on the findings in Phase I ESA. Certainly, ETC will use the more cost effective and timely method for City depending on field conditions and site-specific conditions.

PHASE II ESA REPORT

The Phase II ESA report will be provided in .pdf files with excel files for analytical data compared to Wisconsin DEP criteria. Photographs will be provided in color.

4.3 Remediation Activities

USTS and ASTS

ETC will complete a database search of Underground Storage Tanks both Active and Closed databases. The data filter capabilities are used to pinpoint the address and determine if USTs are listed on either database using the property address.

If no USTs are listed on the database, but USTs are found on a property, then the USTs will require registration with Wisconsin Department of Environmental Protection and the City will need to pay the fee for Registration. Once work is commenced, should a release be suspected, Wisconsin DEP notification is required within 24-hours. All work requires a Notice of Activity to Wisconsin DEP prior to field activities for Leaking UST sites. All underground work requires 72-hour notification to MISSDIG to locate utilities in the area of work prior to commencing on-site activities.

18 | P a g e

ASTs are similar to USTs requiring tank tightness test and integrity. ETC can provide environmental consulting for releases from ASTs, as well per Wisconsin DEP regulations.

ETC will provide the City with subcontractors that are able to perform removal of USTs, including cleaning, tank destruction, transport, and disposal of all materials in the abatement of removal of USTs. ETC can provide project oversight of UST removal activities.

ETC can provide Ground Penetrating Radar (GPR) surveys to locate suspected areas of USTs, if intrusive work is not desired at the time. ETC can aid the City in the bid and award process to complete a GPR survey.

ETC has ASTM RBCA trained personnel to provide site closure services that are practical and best available practices, and O&M management of long-term projects.

Field Oversight of Remediation Activities

Throughout the contract period, ETC will meet with the City to ensure on-going environmental compliance for all projects included within the RFP. These meetings should be at least quarterly but may increase to monthly depending on currently workload and projects under construction. In addition to regular meetings with the City, ETC will conduct random or scheduled on-site reviews of contractors conducting removal, remediation and / or compliance for the various projects under this grant.

Areas and items that may require site visits to ensure compliance include (but are not limited to: (Please note: not all of these services may be necessary but are included to insure a comprehensive response.)

• ETC may opt to perform an on-site paperwork review to ensure that all documentation required to be on-site is up to date, complete and accurate.

• Review of submitted sub-surface work plan presented by potential remediation contractors prior to bid award

• Review of any sub-surface work conducted by remediation contractors (USTs, contaminated soils, etc.) to verify compliance with MDEGLE and Due Care requirements (if applicable)

• ETC may opt to be on-site (with City approval) during removal of any contaminated and Soil Erosion and Sedimentation Controls materials to verify removed quantities are equivalent to quantities disposed of.

• If redevelopment is conducted, review of proposed plans to insure they comply with due care requirements for the property.

19 | P a g e

• If sub-surface contamination exists on a property prose for redevelopment, vapor intrusion testing may be required to ensure the safety of the occupants

• Verification that all hazardous / contaminated materials removed from the site are properly disposed of and manifested (as required).

For any on-site visits / reviews, ETC will produce a report including a log of activities, any potential violations / issues noted during the visit, direction for addressing any concerns given to the contractor, regulatory rational as to why the visit was needed, and any other details appropriate for this visit.
