The following items are applicable to this modification:

SUMMARY OF CHANGES:

a. Remove and replace the Standard Form (SF) 1442 with the attached SF 1442 contained herein.

b. SECTION 00100, make the following changes:

1. Proposal Information, delete paragraph entitled Small Business Subcontracting Plan and replace with the below:

Small Business Subcontracting Plan. (Reference FAR 52.219-9 Alt II and DFARS 252.219-7003). NAVFAC's command-wide small business subcontracting targets are shown in Technical Factor 3. These may be higher or lower than percentages that would represent realistic, challenging small business subcontracting goals for this acquisition. Offerors representing as other than small businesses (Large Businesses) shall establish small business subcontracting plan goals that are consistent with their small business participation and commitment strategies submitted for evaluation under the small business utilization source selection factor in this solicitation and shall document in their subcontracting plans the basis for all proposed goals. Plans shall be submitted with initial offers in the Price Proposal.

Small businesses identified by name in offerors’ proposals/participation and commitment strategies and considered in the evaluation shall be listed in small business subcontracting plans submitted pursuant to FAR 52.219-9 in order to facilitate compliance with 252.219-7003(e). Material discrepancies between the small business participation and commitment strategy and small business subcontracting plan (if required) shall be corrected and responses provided to questions identified.

See the Small Business Subcontracting Plan (Template), Attachment M, for format.

The Small Business Subcontracting Plan submitted by the contract awardee will be incorporated by reference in the contract award.

2. BASIS OF AWARD AND EVALUATION FACTORS, paragraph B. EVALUATION FACTORS FOR

AWARD, make the following changes:

(a) Remove and replace Factor 3 – Small Business Participation with the Factor 3 - Small Business

Participation below:

“Factor 3 – Small Business Participation

It is the policy of the Government to provide maximum practicable opportunities in its acquisitions to Small

Business (SB) concerns, including Historically Underutilized Business Zone SB (HUBZone SB), Woman-Owned

SB (WOSB), Small Disadvantaged Business (SDB), Veteran-Owned SB (VOSB), Service-Disabled SB (SDVOSB), and other small business concerns. Further, it is the policy of the Government that such concerns will have the maximum practicable opportunity to participate in contract performance consistent with its efficient performance.

a. Solicitation Submittal Requirements:

1. All offerors (both large and small) shall use solicitation attachment titled “Small Business Participation Plan” to submit the following requested information for evaluation of this factor:

To demonstrate commitment to use small business concerns in the performance of this contract, identify all planned subcontractors by name that will be used to support each specific small business category (i.e. work to be performed by small business as the prime contractor and/or work to be performed by small business subcontractors). Identify the type of product/service to be subcontracted, the estimated subcontract value, and the type of commitment (i.e.

teaming agreement, letter of commitment, etc.) to each subcontractor.

To demonstrate maximum practicable participation of small businesses, identify (in terms of dollar value and percentage of the total contract value) the Offeror’s total proposed small business participation (the extent of work the offeror will self-perform as the prime contractor. If submitting an offer as a joint venture, identify the percentage of work each member will be responsible for and indicate the size status of each member (e.g. small business, woman-owned small business, other than small business). All Offerors who are not able to meet the minimum total small business participation rate of 20% of the total contract value shall provide a detailed explanation why the minimum total small business participation rate cannot be achieved. Offerors are encouraged to exceed the percentage and seek meaningful levels of participation in each of the small business categories (i.e. SB, HUBZone

SB, WOSB, SDB, VOSB, SDVOSB) consistent with efficient contract performance. If the Offeror does not intend to subcontract, provide a detailed explanation why subcontracting would not result in efficient contract performance.

2. Large Business Offerors shall submit an acceptable Small Business Subcontracting Plan with their proposal. The

Small Business Subcontracting Plan shall incorporate the proposed subcontract values and small business concerns that are specifically identified in the Offeror’s Small Business Participation Plan. The Small Business

Subcontracting Plan shall also include small business subcontracting goals that meet or exceed the minimum small business subcontracting targets stated in the table below. The Small Business Subcontracting Plan template will be provided as a solicitation attachment.

The minimum subcontracting targets for Fiscal Year (FY) 2021 are:

Small Business (SB) 40%

HUBZone Small Business (HUBZone) 3%

Service-Disabled Veteran-Owned Small Business (SDVOSB) 3%

Small Disadvantaged Business (SDB) 5%

Women Owned Small Business (WOSB) 9%

Veteran Owned Small Business 3%

(b) Basis of Evaluation:

The Government will evaluate the Offeror’s Small Business Participation Plan to determine that the Offeror has identified and demonstrated a commitment to small business concerns in each specific small business category (i.e.

SB, HUBZone SB, WOSB, SDB, VOSB, SDVOSB) in the performance of the contract.

The Government will also evaluate the Offeror’s Small Business Participation Plan to determine that the Offeror has demonstrated the maximum practicable participation of small businesses by meeting or exceeding the solicitation’s minimum total small business participation rate (i.e. work to be performed by small business as the prime contractor and/or work to be performed by small business subcontractors).

Large Business Offerors may achieve the minimum total small business participation through subcontracting to small businesses.

Small Business Offerors may achieve the minimum total small business participation through their own performance/participation as a prime and also through a joint venture, teaming arrangement, and/or subcontracting to other small businesses.

Proposals that fail to identify and commit to use small business concerns in the performance of this contract may be rated Unacceptable; however, the Government may take into account reasonable explanations why subcontracting would not result in efficient contract performance.

Forms to be used for offeror submission of Small Business Utilization Factor information are:

Attachment E – Small Business Participation and Commitment Strategy”

2. Remove and replace paragraph (6) Price Factor with the paragraph (6) Price Factor below:

“(6) Price Factor

(i) Solicitation Submittal Requirements:

The Offer’s price proposal shall be separate from the technical proposal. Complete and submit the following:

1. Cover letter in accordance with FAR 52.215-1(c)(2), including DUNS number (if a JV, then include

DUNS for JV and for each managing partner under JV).

2. Standard Form 1442 (Solicitation, Offer, and Award) - Blocks 14 through 20c;

3. Section 00010, Schedule of Prices;

4. Supplemental (in addition to SAM) representations and certifications provided in Section 00600 –

Representations and Certifications of the Solicitation. Additionally, the Offeror shall ensure their SAM is updated and current;

5. Bid Bond (Class Deviation 2020-O0016 Original Documents, Signatures, Seals, and Notarization) in accordance with FAR 52.228-1 Bid Guarantee (SEP 1996);

6. If a Large Business Offeror, an acceptable Subcontracting Plan, see Instructions to Offerors;

7. Confirmation of filing current VETS 4212 report;

8. Financial Questionnaire Form;

9. Acknowledgement of all amendments; and

Technical Factor 3 Small Business Utilization shall be submitted with Price in a separate .PDF file. The

Subcontracting Plan (if applicable) shall be submitted electronically to grace.montero@navy.mil and nancy.coffee@navy.mil on no later than 2PM local time 08 April 2021.

(ii) Basis of Evaluation: In accordance with FAR Provision 52.217-4 Evaluation of Options Exercised at

Time of Contract Award (JUN 1988), the Government will evaluate the total price for the basic requirement (CLIN

0001) together with the Option CLIN (CLIN 0002). Evaluation of CLIN 0002 does not obligate the Government to award the Option CLIN. Analysis will be performed by one or more of the following techniques to ensure a fair and reasonable price:

Comparison of proposed prices received in response to the RFP;

Comparison of proposed prices with the IGCE;

Comparison of proposed prices with available historical information; or

Comparison of market survey results.

The Bid Bond will be reviewed for compliance with FAR 28.101.

The successful offeror’s financial questionnaire form will be reviewed for contractor responsibility (FAR Part 9).

Representations and certifications contained in SAM and Supplemental representations and certifications contained in Section 00600 will be reviewed to ensure they are current and complete. Supplemental representations and certifications are to be provided with the Price Proposal.”
