| 014 | Ref: Section 01 57 19.01, part 3.1.1.8. Is there merchantable timber present within the logging/clearing limits of this contract for which the contractor will be required to reimburse the market value of such timber to the Government? If so, what is the approximate value of the timber which proposers should consider for their bids? | 41 | Assume 194 MBF of marketable forest products consisting of Douglas-Fir, Western Red Cedar, and other minor species are located within the construction clearining limits of this contract. These forest products must be puchased by the contractor in advance of removal. The actual price at time of removal will be based on rates established twice yearly by the Washington State Department of Revenue. | |
| 034 | Contractors were not allowed to take photos during the site visit on 8/10. NAVFAC representative suggested that NAVFAC could take photos of the 3 primary construction areas and provide those to contractors via Amendment. Please provide these photos at your earliest convenience. | 78 | Photos provided in amendment #009. | |
| 137 | Plan Sheet CW114, Note 4, states: “Remove Exist Beach Debris as Required for Construction and Pile Driving During Low Tide…”. Please confirm that ALL of the debris on the beach does not need to be removed; only what is required by Contractor's means need to be removed. | |||
| 287 | All beach debris noted on details A3 and A4 on drawing CW114 shall be removed. | |||
| 083 | Section 01 57 19.01 20 Paragraph 3.1.1.8 states that “Merchantable forest products such as timber and firewood must be appraised and payment received by the Government prior to disturbance or removal, in accordance with COMNAVREGNWINST 11015.1, forest product sales and permit program. | |||
| Please provide the details of this requirement such as assumed value of the forest products. | 312 | Assume 194 MBF of marketable forest products consisting of Douglas-Fir, Western Red Cedar, and other minor species are located within the construction clearining limits of this contract. These forest products must be puchased by the contractor in advance of removal. The actual price at time of removal will be based on rates established twice yearly by the Washington State Department of Revenue. | ||
| 153 | Reference section 01 57 19, A0004, and previous PPIs. The ESA/MMMPA Monitoring and Construction Restriction Requirements indicates that 2 MAMU monitors are required during impact driving operations. It does not specifically state how many MMM are required during vibratory or impact driving or where these monitors are to be located (e.g. land based, boat based). Please provide required number and type/location of MMM proposers should consider as a basis for bids. | 329 | It is expected that a minimum of four marine mammal monitors will be required. One of the four total marine mammal monitors may also serve as the monitoring coordinator. During pile driving one marine mammal monitor should be stationed on a vessel and the remaining three on K/B pier, along the shore, or on the pile driving derrick as required to maximize observation of the injury zone. | |
| 154 | Amendment 0004 issued a revised Section 01 32 17.00 20 COST-LOADED NETWORK ANALYSIS SCHEDULE. This revised section states that proposers should allow two lost work days per month of pile driving activity due to the presence of protected species in the shutdown zones. Please confirm that the Government will provide compensation for both standby costs as well as an extension of contract time for any delays in excess of 2 days per month due to presence of protected species | 330 | Any “suspensions of work” will be determined as prescribed in FAR 52.241-14 Suspension of Work. |
If it is in the best interest of the Government to “suspend work,” the Contracting Officer will determine any compensation due to the impact the delay has on the contractor and may be satisfied through a request for equitable adjustment or claim.
A suspension of work may not result in a time extension to the contract, such as where the critical path has not been affected or in the case of a critical delay. A suspension of work can cause impact damages, such as lost productivity, idle equipment and material escalation costs.

Is there an alternate material that will be acceptable for those components not available from the manufacturer in 316 stainless steel? | 389 | In lieu of stainless steel, the strut components can be of A653 GR33 steel. General notes on SB106 have been updated to include A653 GR33 steel. |
| 40 | a. Steel Storage Racks – Specification Section 10 56 13 |
The sizes of the Steel Storage Racks per Drawing ID-101 (Volume 2, VMF Drawing Set) do not match the sizes of the Bulk Steel Storage Rack per the Schedule, provided in Specification Section 10 56 13.3.4.
| Please confirm actual sizes and quantities of the bulk steel storage racks as shown on Drawing ID- 101. Please also note that I was informed by a Steel Rack Manufacturer that based on the height of the storage racks, the storage units with a depth less than 36” would not meet the seismic tie-down requirements. | 390 | Revised storage types and dimensions are incorporated to Drawing AB101 and Section 10 56 13. Mechanically fasten racks to each other and to the floor with embedded anchor bolts similar to other tie down methods. |

| 012 | RFI: FAR 52.249-10(a) states in part, "The Contractor and its sureties shall be liable for any damage to the Government resulting from the Contractor's refusal or failure to complete the work within the specified time, whether or not the Contractor's right to proceed with the work is terminated." (Emphasis added.) However, FAR 52.211-12 provides for liquidated damages of "$5,739 for each calendar day of delay until the work is completed or accepted," and that "If the Government terminates the Contractor's right to proceed, liquidated damages will continue to accrue until the work is completed." This opens the door for Contractor to be unfairly exposed to both any actual delay damages, including consequential damages, plus liquidated damages for delay, and it undermines the purpose of liquidated damages. Please confirm the liquidated damages established by FAR 52.211-12 will be the Government's sole and exclusive remedy for Contractor not completing the work within the Contract Time, or explain what is intended. |
| 347 | In the event of delays that fall under FAR 52.211-12, the Government may utilize all remedies available under the FAR. This contract is no exception |
