AMENDMENT 0005

The purpose of this amendment is to clarify specifications, to incorporate Errata 3, and to update

Section C and J.

QUESTION 023 Section C:

PLANT PROTECTION Requirement Paragraph (a): Please provide contractors copy of Plant

Protection Plan (DI-035) to review the in-depth requirements

ANSWER 023 Section C:

The identification of Plant Protection Plan (DI-035) is deleted from the statement of work. A

Plant Protection Plan shall identify physical security boundaries and other security measures to provide safeguards against hazards; including, unauthorized entry, malicious mischief, theft, espionage, sabotage, and terrorism for the ship, materials, and crews in accordance with the requirements of the Contract.

QUESTION 025:

Will the Government please clarify if this contract have any classified work that needs to be completed? Clause D-211-H001 is included to this contract and states: Classified reports, data, and documentation shall be prepared for shipment in accordance with National Industrial

Security Program Operating Manual (NISPOM), 32 CFR Part 117. Will any classified equipment be installed during this upgrade that will require Classified Reports??

ANSWER 025:

NAVSEA Clause D-211-H001 is deleted, there is no classified equipment to be installed in this contract.

QUESTION 035 Work Item 235-60-001:

After discussion with OEM from GE on item 235-60-001. It was brought to Contractors attention that reference listed under 2.1 (1127019 Rev 003, MV Drives DP and Automation Upgrades;

MV3000 Drives, DP and Automation Upgrade Firm Quotation) has been updated and reference in its current form is outdated. Will the Government please provide Contractor with the latest up to date reference?

ANSWER 035 Work Item 235-60-001:

Yes, this was modified and the changes were incorporated under Errata 2. Contact the SERMC

Technical Library for a copy of the latest revision.

QUESTION 036 Work Item 623-21-001:

Paragraph 3.2.1 requires the Contractor to fabricate a new Accommodation Ladder, and a new

Lower Platform and Fender assembly. Reference 2.1 describes the Accommodation ladder, which includes various lengths. Please provide the length of the new Accommodation Ladder.

There is not a reference provided that details the assembly of the Lower Platform and Fender

Assembly. Please provide a reference for the Lower Platform and Fender Assembly.

ANSWER 036 Work Item 623-21-001:

Yes, the length of the Accommodation ladder is 20 feet. There is no reference for a platform and fender assembly as they are not required.

QUESTION 037 Work Item 992-11-003:

Paragraph 3.1.3 directs contractor to “accomplish the following using Attachment A for criteria…” Contractor notices that the specification not only lacks an Attachment A but doesn’t have any references making motion about one. Can the government please provide such

Attachment A or correct the specification? Paragraph 3.1.4-3.1.5 describes personnel with office sizes to total 11 personnel. Will this be the quantity/amount of office space the contractor needs to budget for this specification?

ANSWER 037 Work Item 992-11-003:

Yes. Attachment J-6 is provided and the requirements for TSV 1 will be used for guidance.

QUESTION 043 Section C:

A definitive work scope required to formulate a Firm Fixed Price estimate is not present in the current version of work item 992-11-002 (American Bureau of Shipping Reactivation Survey;

accomplish). The work item directs the Contractor to “Accomplish each requirement of section

3 of the American Bureau of shipping Layup and Reactivation of OSV’s as designated by the

Supervisor”. The Contractor understands that the vessel is in a condition of Cold Stack Layup without a periodical layup maintenance plan. In accordance with the work item reference for vessels in this condition a complete recommissioning of all machinery and safety systems, as well as completion of all overdue surveys and insulation resistance testing of all shipboard electrical circuits, will be required. The Contractor has extensive experience working with ABS and USCG on OSV/PSV shipboard machinery and safety commissioning projects. In the

Contractor’s experience, machinery that is laid up for this duration, without periodical maintenance being perform, normally experiences a high level of faults such as deteriorated bearings, seals, gaskets and o-rings, electrical ground faults, and software programing issues. All of the potential discrepancies noted during commissioning will need to be corrected to complete the ABS reactivation plan. With no frontloads or work scope boundaries defined in the work item to clearly identify who has the ownership of repairs to discrepancies discovered during commissioning, it is impossible for the Contractor to propose a fair and reasonable FFP for the work item. Would the GOVERNMENT consider modifying the work item to include verbiage stating all discrepancies noted during ship commissioning of components undisturbed during the availability be documented via CFR and corrected via RCC or RTR? This approach will allow the Contractor to provide a fair and reasonable FFP to accomplish the system testing. Correction of discrepancies will be documented via CFR and corrective actions can be agreed upon and settled as growth.

ANSWER 043 Section C:

Any system or equipment found to have issues not covered by the work specification requirements and determined to require additional repairs would be subject to growth work and should be reported through Condition Found Reports.

QUESTION 046 Section C:

Is the vessel due for its 5 year special survey, and if so is that a part of the work scope. Does the government have a clear list of corrosion prevention and preservative requirements? Will the government provide a list of calibration requirements needed at the time of delivery, including number of items, type of items to be calibrated, etc.? Does the government plan on re-flagging vessel for the United States? If so, what are the implications relative to Certifications and bringing the vessel up to the most up-to-date standards/requirements of the new certifying agency(ies)? Solicitation asks for ship to be fully outfitted with approvals and certifications in place. Will the government provide a full list of Certifications, requirements and approvals needed to ensure the contractor is able to reasonably estimate the full needs of the vessel?

Certifications to what standards and which Class/Certifying agencies: USCG? ABS?

IMO/SOLAS? All of the above? Additionally, does meeting the desired certifications include purchasing and onloading all of the electronic equipment and other equipage necessary for certification? If so, does the government have this comprehensive listing of equipments to be purchased for installation and turnover so that the contractor can accurately and reasonably estimate this work?

ANSWER 046 Section C:

No, the Government will not provide a list of corrosion prevention and preservative requirements other than required in the specific work items. No, the Government will not provide a list of calibration requirements needed at the time of delivery other than required in the specific work items. The vessel was constructed to ABS rules and then re-classed under RINA and reflagged

Marshall Islands upon delivery to Brazil. The vessel successfully underwent a pre-classification survey with ABS in January 2021 for readmission to ABS. The vessel is flagged USA. It is owned and operated by the US Navy. It will seek the following ABS documents, certifications and notations: (Maltese cross) A1, Offshore Support Vessel, (CircleE), (Maltese Cross) AMS, Loadline Certificate, Stability Booklet. The vessel’s ABS ID # is 14238711. The vessel will not be USCG inspected and will not be IMO/SOLAS certified. The work item requirements do not require purchase and installation of additional electronic or other equipment (other than that included in other work items such as firefighting system modifications associated with structural modifications).

QUESTION 047 Section C:

This contractor has extensive experience with performing vessel overhauls and reconfigurations.

This contractor also has extensive experience with performing both government and commercial work, and working to commercial standards and certifications. Additionally, this contractor has extensive experience with this vessel type (OSVs), having been the Build Yard for many OSVs.

Lastly, this contractor has the capacity, capability, excperience, availability, and interest to perform this work ; however, the existing solicitation contains so many truly significant ambiguities and unknowns that the project is unable to be responsibly estimated. These significant ambiguities represent unbounded financial risk to the contractor, and the Fixed Price proposal places the entirety of that unbounded risk upon the contractor. With the information still required for contractor to reasonably/responsbily estimate the work, outlined in BQ 36-41 will the Government consider changing this project to a Cost Plus solicitation? If so, than this contractor is ready to develop/offer a proposal.

ANSWER 047 Section C:

This solicitation will be awarded as a Firm Fixed Price Contract.

QUESTION 048 Work Item 301-10-001:

Contractor has received quote from Marga Cruz (904) 672-1330 from vendor JO-Kell on

7/21/2022 for CABLE, UNARM, WT,1000V,0 AWG, 4 COND, 1.358” OD (1.820#/FT) with a part ID of LSFSGU-100 with a LLTM of 365 Days. This lead time is outside the Period of

Performance. Will Government please provide material as GFM to ensure completion of specification within POP date?

ANSWER 048 Work Item 301-10-001:

Yes, the Government will provide Cable as GFM and this changed is incorporated under Errata

3.

QUESTION 049 Work Item 150-11-004:

Contractor has received quote from Juniper Industries (Jennifer Patikowski, 718-326-2546, projmgr3@juniperindustries.com) on 7/21/2022 for part number 805-1400066-309-MOD

(DOOR,STL,WT,36X66,RH,INDV 10 DOG,13PSI) with a LLTM of 364 days. This lead time is outside the Period of Performance. Will Government please provide material as GFM to ensure completion of specification within POP date?

ANSWER 049 Work Item 150-11-004:

Yes, the Government will provide GFM and this changed is incorporated under Errata 3.

QUESTION 053 Work Item 623-21-001:

Specification location states 01 level, weather, Frame 65 Port.

There are shell attachments required for the rigging of the accommodation ladder.

Reference 2.2 Notes states that platform shall be designed to support use of ladder on both sides.

Reference 2.3 displays stowage pads and stowage stanchions for accommodation ladder to be stow upright on Port or STBD side, normally one on each side.

Is the intent of the government to have the accommodation ladder set up to only be used in the

Port side?

Where is the accommodation ladder going to be stowed at? Will the government provide the reference associated with accommodation ladder stowage?

Specification makes no mention about the bail bracket required to rig the accommodation ladder

IAW ref 2.3?

Will the government review and provide the appropriate reference for the bail bracket?

ANSWER 053 Work Item 623-21-001:

The accommodation ladder will be stowed on starboard side. Port side will have mounting points and slotted channel (Bail Bracket) only, for ladder use on port side when required.

Paragraph 2 of the work item provides sufficient references with regards to rigging and securing the ladder to the side of the ship and the bail bracket which is attached to the hull and swings out to support the ladder when deployed.

QUESTION 054 Work Item 623-21-001:

Specification reference 2.3 requires Vang Staples to secure the ladder to the shell side of the ship.

General Note #12 requires to provide 6 for each Port and STBD side.

Reference states Vang Staple to be forged from GR 1023W.

Will the government provide the manufacturer of the Vang Staples, or provide the staples as

GFM?

ANSWER 054 Work Item 623-21-001 :

Yes, the Government will provide VANG Staples as GFM and this changed is incorporated under Errata 3.

QUESTION 055 Work Item 623-21-001:

Specification reference 2.3 displays accommodation ladder fully rigged which requires bail pendant, bridle, chain, lashing, falls, etc.

Specification is silent about where that hardware will be coming from.

Furthermore, ref 2.3 directs to its reference #6 for bridle arrangement. This reference was never mentioned on this specification.

Is the government providing all the rigging hardware associated with fully rigging the accommodation ladder?

If not, is the government providing the reference with appropriate NSN and/or point of contact to acquire the hardware?

ANSWER 055 Work Item 623-21-001:

Yes, the Government will provide rigging hardware as GFM and this changed is incorporated under Errata 3. Paragraph 2 of the work item provides sufficient references with regards to rigging and securing the ladder to the side of the ship and the bail bracket which is attached to the hull and swings out to support the ladder when deployed.

QUESTION 056 Work Item 583-11-001:

Item 583-11-001 paragraph 2.3 and Item 150-11-002 paragraph 2.1 list same reference to be accomplished (Reference: 136-5113170, 87MNS1401 Vindicator (TSV-5) 01 Deck Extension and TOC Modifications). Will the Government please advise on which work Item reference 136-

5113170 is to be assigned and accomplished?

ANSWER 056 Work Item 583-11-001:

Yes, Work Item 583-11-001 is to install Boat Davit, as titled. Work Item 150-11-002 is to repair

01 Level Deck, as titled. Both requirements are referenced in 136-5113170, 87mNS1401

Vindicator (TSV 5) 01 Level Extension and TOC Modifications.

Schedules (IPS), Test and Inspection Plans (TIP), Corrective Action Reports (CAR), Required Reports, associated with and in accordance with the following: Accomplish each (I), (V) and (Q) test/inspection that does not have an associated (G)-point, with qualified and/or currently certified personnel where required by each technical document

(e.g., NAVSEA Basic Paint Inspector (NBPI), National Association of Corrosion Engineers (NACE), nondestructive testing, electrical cableway inspection, Oxygen Cleanliness Inspector, etc.) as follows: Each (I) inspection requires verification and documentation by a separate individual, other than the person who has accomplished the work, who is qualified as an inspector. Each (V) inspection requires verification and documentation by the qualified tradesperson, trade supervisor, or inspector. The authority to accomplish, document, accept and reject each (I) and

(V) inspection may be delegated to qualified subcontractor personnel, without regards to geographical location, subject to SUPERVISOR approval. Accomplish (G)-Point (government notification) as follows: (G) is a symbol inserted in a Work Item to establish a point in the sequence of accomplishment of work at which time the

SUPERVISOR must be notified by the prime contractor in each case to permit observation of a specific test or inspection (I)(V) by the government. When the symbol (G) precedes each test or inspection in a Work Item which are applicable to more than one action, the symbol (G) must identify the action required, e.g., (G) "HYDROSTATIC

TEST". When more than one unit is involved, the (G) notification requirement applies to each unit.

Notify the SUPERVISOR's designated representative by FAX, hard copy, or by electronic method. Notify the SUPERVISOR prior to commencing each specific requirement in a paragraph annotated with the symbol (G), during each normal day shift working hour with at least 4 hours. Following the required notification, each requirement in the paragraph annotated with the symbol (G) may proceed prior to the scheduled time as approved by the SUPERVISOR.

Notify the SUPERVISOR to cancel a scheduled test or inspection no later than 2 hours prior to the scheduled event or as negotiated with the SUPERVISOR. Notify the SUPERVISOR not later than 6 hours before the end of the last preceding normal work day when each test or inspection following a (G) Point is scheduled after normal day shift working hour, on a weekend, or on a federal holiday. Following the required notification, each requirement in the paragraph annotated with the symbol (G) may proceed prior to the scheduled time as approved by the SUPERVISOR.

Notify the SUPERVISOR to cancel a scheduled test or inspection as soon as known, but no later than 2 hour prior to the scheduled event. Notify the SUPERVISOR at least 48 hours, prior to commencing each (G)-Point at contractor/subcontractor plant located in excess of 50 miles by the most direct roadway nearest to the place of performance of the contract. Document the date, time, and identification of the SUPERVISOR's representative notified. Following the required notification, each requirement in the paragraph annotated with the symbol (G) may proceed prior to the scheduled time as approved by the SUPERVISOR.

Notify the SUPERVISOR to cancel a scheduled test or inspection as soon as known, but no later than 4 hour prior to the scheduled event. Proceed with the test or inspection if the SUPERVISOR is not present, provided the required advance notice has been furnished to the SUPERVISOR and the contractor has completed and mailto:michael.m.schoeller.civ@us.navy.mil documented each preceding test and inspection. A partial test or inspection requiring (G) notification may be accomplished in the event that work cannot be completed and work progress would be delayed in waiting for total completion of work.

Notify SUPERVISOR when the incomplete work is completed and ready for the remainder of the test or inspection. Note each partial inspection on the test or inspection form. A qualified contractor representative must be present to accomplish, accept or reject and document each test or inspection associated with the symbol (G). The authority to witness or perform, document and accept/reject (I)(G), (Q)(G), and (V)(G) test and inspection is a prime contractor's responsibility but, subject to SUPERVISOR approval within a 50-mile radius of the contractor’s plant nearest to the place of performance of the contract, may be delegated to each subcontractor who are Master Ship

Repair Agreement (MSRA) or Agreement Boat Repair (ABR) agreement holders, Society for Protective Coatings

(SPC) Quality Procedure (QP) One certified, NDT certified, or have a current Quality Management System (QMS) accepted by the SUPERVISOR. The contractor may delegate responsibility to each subcontractor to perform, document and accept/reject each (I)(G) and (V)(G) test and inspection performed at each plant located outside a 50-mile radius of the contractor's plant nearest to the place of performance of the contract subject to SUPERVISOR prior approval. Each associated (G)-Point notification requirement must not be delegated. Reporting requirements are as follows:

When a Work Item does not require a report, and one is determined to be necessary in order to produce a reliable or complete repair, submit one legible copy, in approved transferrable media, of a report with supporting data as early as possible in the contract period. The goal is to have required work completed within the original contract period. For each report required by 2.1 or the Work Item, that could result in a change in work to be accomplished or additional material to be procured, complete the preliminary work and submit one legible copy, in approved transferrable media, of the report in a time frame to allow the SUPERVISOR to initiate early action, but no later than the first 20 percent or 30 days of the availability whichever occurs first. Each report is costly to generate and process. Identify each suspected duplicative reporting requirement and case where each required report could be combined in order to eliminate a report to the SUPERVISOR via e-mail.

Receipt of this notification by the SUPERVISOR is not to be construed as a waiver of each reporting requirement unless the SUPERVISOR’s response eliminates the required report. Respond in writing to each

SUPERVISOR issued Method B/C/D Corrective Action (CA) within 3 business days unless otherwise specified by the SUPERVISOR. Initial response must include immediate corrective action taken and a plan of action for CA completion, including estimated completion dates. Final response must include preventive action for recurrence of identified nonconformance, root cause analysis and Objective Quality Evidence (OQE) for corrective action completed.

All follow up responses must be as specified by the SUPERVISOR. Inform the SUPERVISOR when corrective actions are complete for each SUPERVISOR issued Method A (CA). Response required within 3 business days unless otherwise specified by the SUPERVISOR. Response must state that the non-conformance has been corrected. Develop a Test and Inspection Plan (TIP) incorporating each Work Item in the job order or

Statements of Work (SOW). The initial TIP must include all inspections and tests required by the contractor’s

Quality Assurance or Quality Management Plan as well as by symbols (I) (V) (Q) test/inspections and (G) government notification identified in the Work Item, and any additional tests and inspections the contractor deems necessary to substantiate product conformance. Submit the initial copy of the TIP to the SUPERVISOR prior to start of productive work. Test and Inspection records must include hull number, Job Order and Work Item number, component identification, accept/reject criteria, date, time, unique identification of test equipment used, and signature of the contractor's authorized representative who witnessed or performed the test or inspection. The signature occurs after the checkpoint is determined to be satisfactory or unsatisfactory and any exceptions are documented. The records must indicate the results of the test and or inspection accomplished. Test and inspection records must be retained and made available to the SUPERVISOR as part of work completion certification. All test and inspections requiring ABS Surveyor attendance also requires Government SBS attendance and a checkpoint sheet shall be developed and recorded in NMD in the form of a Condition Found Report (CFR) with signed checkpoint record attached.

Attend SUPERVISOR conducted fact-finding/investigative meetings when requested by the

SUPERVISOR not to exceed 4 hours. For all required data submission throughout the administration of this contract, documentation must be submitted in electronic format that is compatible with Microsoft Office products

(Word/Excel/Project/etc.) and/or Adobe Acrobat as designated by the Government. The Contractor and any

Nondestructive Testing (NDT) subcontractor shall utilize, for the performance of required NDT, only personnel who are currently certified, as a minimum, in accordance with Recommended Practice No. ASNT SNT-TC-1A, or the

Regulatory Bodies. An NDT subcontractor is defined as a first tier subcontractor performing NDT in conjunction with the production of materials, components, or equipment for the vessel. NDT includes radiography, magnetic particle, liquid penetrant, eddy current, ultrasonic inspections and visual inspections.

Certification of Level III (NDT Examiner) personnel shall be based, as a minimum, on successful completion of appropriate American Society for Nondestructive Testing Level III Examinations and associated fabrication documents or other Regulatory Body qualifications. Examinations may be developed and administered by the Contractor or by an outside agent designated in the Contractor’s written practice.

Documentation pertaining to the qualification and certification of NDT personnel shall be available to the
