About this file

This document is a Task Assignment Change Order (TACO #1) executed between the State of Florida Department of Environmental Protection (FDEP) and CDM Smith Inc. for environmental site assessment services at the Elite Cleaners facility located at 11301 North 56th Street, Temple Terrace, Hillsborough County, Florida. The underlying contract is designated HW681, with the original Task Assignment (DC010B) issued on August 2, 2022. The change order was executed on June 21, 2023, and extends the project completion date by 168 days, from June 30, 2023 to December 15, 2023.

The change order authorizes CDM Smith to perform expanded Phase II assessment activities in response to contamination levels that exceeded initial expectations when Maximum Contaminant Gradient (MAGs) testing data was received. Scope modifications include removing certain soil and groundwater samples from Subtask 2 while adding substantial work under Subtasks 4 and 5, including installation of five monitoring wells, installation and testing of MAGs wells, soil gas sampling, and investigation-derived waste (IDW) management. The original Task Assignment value was $95,708.23; the change order increases the total TA value to $186,537.59, representing a cost increase of $90,829.36. Subcontractors engaged include Environmental Drilling Service Inc. for well installation ($47,555.00), Erwin Remediation for IDW disposal ($6,875.00), Site Lines LLC for utility marking ($800.00), and Southeastern Survey for surveying services ($2,565.00). Labor rates range from $26.45 to $81.53 per hour across multiple staff categories, with an overhead rate of 135 percent and fringe benefits of 37.7 percent. Deliverables are due by June 30, 2023 (Subtasks 2-3), August 30, 2023 (Subtask 4), and November 15, 2023 (Subtasks 1 and 5), with invoice payments scheduled upon FDEP approval of corresponding deliverables.

TACO #1

ERIC_4708

This Task Assignment Change Order tasks CDM with expanded Phase II assessment activities and 168-day time extension. In accordance with the CDM Smith (CDM) Change Order Request and cost estimate forms received on June 5th, 2023.

Upon receipt of the MAGs testing data contamination levels were higher then expected. After discussions with FDEP Technical Staff and Project Manager it has been decided to expand this original Task Assignments scope to complete Site Assessment.

Changes to the original CDM scope of work include the following:

Subtask 3: Stage I Field Investigation Subtask 2 has an overall price decrease due to change in scope. Removed 7 soil samples, 36 groundwater samples, 1 TCLP VOCs, subcontractor GWP, shipping costs, and equipment costs.

The work remaining in subtask 3 has already been completed prior to this change order reduction. All additional work that is required to complete the Site Assessment Report is added to subtask 4 and 5.

Subtask 4: Stage III Field Investigation Subtask 4 has an overall price increase due to additional vehicle costs, Monitoring wells installations (5), MAGs well installations, Mark utilities subcontractor costs, IDW costs, 12 Soil Gas samples, 5 Groundwater samples, shipping costs, equipment costs, and CDM labor.

Investigation derived waste (IDW) disposal is anticipated and has been accounted for under this subtask. Erwin Remediation for IDW disposal was chosen on a lowest-cost basis.

Subtask 5: Site Assessment Report Subtask 5 has an overall price increase due to additional CDM labor.

The overall cost increase related to this Change Order is $90,829.35.

The FDEP project manager agrees to the scope of work and final cost associated with the Task Assignment Change Order. The final cost total for Task Assignment DC010B is $186,537.59.

SITE LINES LLC PROPOSAL

SITE LOCATION

Elite Cleaners Site – 11301 N 56th Street, Temple Terrace, FL

PROPOSED SCOPE OF WORK

Site Lines (“Company”) will use Ground Penetrating Radar (GPR) and conventional electromagnetic (EM) pipe and cable locators to determine the location of underground utilities at the site identified by CDM Smith (“Client”). Of specific concern is the location of utilities within the area of approximately 6 proposed drilling locations. A map of the locations was provided and is attached to the back of this document.

RESULTS OF THE INVESTIGATION

The estimated depth and location of utilities identified during the investigation will be marked on the ground surface using spray paint or other method to be agreed upon by the parties. Designated utilities will also be documented on a field sketch.

The American Public Works Association Uniform Color Codes for the marking of underground utilities will be used.

PROJECT FEE

The fee to complete the project as described within this proposal is: Eight Hundred Dollars [$800.00].

Client shall pay Company in full within thirty (30) days of the invoice date, unless the parties have agreed to another payment arrangement in writing. If during the investigation, Company determines that the goals of the project cannot be achieved with the resources available to Company, Company will notify Client as soon as reasonably possible. Under such circumstances, Company will charge Client only for time expended and materials used to date.

CLIENT REQUIREMENTS

Client is responsible for all site access, maintenance of traffic (MOT), site clearing and/or any other logistical considerations necessary to conduct the utility locate.

Client will also provide all pertinent maps of the project site, including those that show the boundaries of the utility locate, pertinent landmarks, and known utilities (if available). Company is not a substitute for Chapter 556, Florida Statutes.

Accordingly, Client is responsible for calling Sunshine State One Call of Florida

(811) before undertaking any invasive activities, whether through Company, any other entity, or on its own.

DESCRIPTION OF COMPANY INVESTIGATION AND LIMITATIONS

A GSSI SIR-4000 GPR system will be used with a 900, 400, or 270 megahertz antenna configuration depending on site conditions and desired targets. The GPR will assist in locating nonmetallic and metallic utilities. Physical surface conditions, subsurface conditions and technical limitations effect the ability of GPR to resolve targeted utilities and/or subsurface structures. Depth and/or diameter of the utility, soil type, moisture/ionic content of the soil, and electrical properties of the soil compared to that of the utility can prevent the GPR from identifying utilities at the site. The diameter of a utility cannot be determined by GPR data. Estimated depths of utilities are directly affected by soil conditions and the material of the utility. A margin of error of +/- 20-25% in depth should be expected when performing invasive activities.

An RD 8000 will be used for the EM survey. Electromagnetic induction which transmits a signal directly into the desired target and passive power detection which locates naturally occurring magnetic fields in energized lines will be identified by detecting and following the signals with a receiver. The EM survey will assist in finding only metallic utilities. The magnetic field and/or induced signal should emanate from the target in a circular geometry. When this occurs, the receiver will receive its peak signal directly above the target. However, when metallic utilities are running near each other, or there is environmental interference from fences, cars or overhead power lines, the signal can become distorted and the peak no longer can be directly over the utility. Care must be taken when doing any invasive work around the utilities. A margin of error of +/- 20-25% in depth should be expected when performing invasive activities. Company’s personnel are highly experienced and certified operators of GPR and EM pipe and cable locators.

Due to the limitations described above, when Client is working around indicated utilities, a minimum of two (2)-feet clearance from either side of the marked utility will be maintained. For absolute confirmation, Client is responsible for exposing any indicated underground utility.

Company will conduct utility investigations in accordance with the level of care and generally accepted professional practices as ordinarily exercised by members of the same profession practicing in the same locality under similar conditions.

REPRESENTATIONS AND WARRANTIES

Neither Company nor its employees or agents are licensed surveyors under Florida law, nor do they represent themselves as such. Accordingly, the work Company is to perform is not a substitute for work typically completed by a licensed surveyor.

Company specifically and expressly disclaims any liability for any type of property damage or personal injury, including but not limited to death, arising from client’s failure to determine that the services of a licensed surveyor are necessary or to retain a licensed surveyor to perform necessary services.

Limitations in technology, complexity of the physical characteristics of the subsurface conditions, and circumstances beyond Company’s control may limit the performance of Company’s utility investigation. For these reasons, Company expresses no guarantee that all utilities and underground structures will be identified and located during this project.

Company is responsible only for locating underground utilities, the presence of which is both known and indicated on site maps to be provided by Client to Company before Company performs the utility locate. Company will use its best efforts to locate both known and unknown utilities within the project boundaries. However, Company will only be responsible for locating utilities, the presence of which is known before Company undertakes its investigation.

Company expressly disclaims any and all warranties regarding specific or desired results.
