Negotiation Summary Task Assignment DC003C Nelson’s Cleaners
ERIC_4822
SVE System Installation
CDM Smith Inc. (CDM) will construct a soil vapor extraction system (SVE). Specific subtasks are detailed below:
Subtask 1: Project Management Project Management is calculated at 13% of the direct labor.
Subtask 2: Baseline/Annual Groundwater Monitoring And Reporting In accordance with the 2022 ISRP prepared by HSW, groundwater samples will be collected from monitoring wells MW01, MW02, MW04, MW05, MW06, MW07, MW08, MW10, MW011, MW012, MW013, MW014, MW015, MW016, and MW017. The groundwater samples will be submitted to Eurofins Test America Laboratories, Inc. (TA) for laboratory analysis by United States Environmental Protection Agency (EPA) Method 8260 for volatile organic halocarbons (VOHs).
The laboratory analyses in this proposal include fifteen groundwater samples. CDM Smith will collect water levels from fifteen sampled monitoring wells during the baseline sampling event.
Purging and sampling will be in accordance with FDEP’s Standard Operating Procedures (SOP) for Groundwater Sampling. A YSI-556 multi-parameter probe and a turbidimeter will be used to collect purge parameters including dissolved oxygen, pH, conductivity, oxidation reduction potential, temperature, turbidity.
Investigation derived waste (IDW) disposal is anticipated and has been accounted for under this subtask. Erwin Remediation for IDW disposal was chosen on a lowest-cost basis. 2 IDW bids are included and the 3rd from EnviroServe was non-responsive.
Subtask 3: Soil Vapor Extraction System Construction and Startup CDM Smith has reviewed the SVE system design and has relied on HSW’s design and recommendations in their FDEP-approved 2022 ISRP. The SVE system described in this proposal is intended to meet or exceed the operational design requirements of the HSW ISRP. The components in Subtask 3 include the SVE blower system, SVE manifold, the control panel, the treatment system enclosure, fencing, transfer piping, and connections. Subtask 3 includes system startup and first week of system operation, followed by the submittal of a Startup/Construction Completion Report. Four copies and an electronic version of a detailed O&M Manual will be provided with the treatment system. Equipment warranty information will be in the O&M Manual along with a completed FDEP property reporting form. The treatment system manufacturer will provide one day of startup testing. CDM Smith will provide construction management and an on-site representative during the construction activities. Petroleum
Resource & Development (PR&D) has been selected to perform the treatment system installation. It is assumed that the on-site construction activities will take approximately five days.
Prior to system startup, CDM Smith will complete functional tests for all equipment for proper operation, and all system shutoffs and safeguards will be tested. All piping will be inspected for leaks including pressure testing on vapor and air transfer piping and water leaks from the moisture separator system. System startup testing will be completed following the functional testing. The SVE system will be operated for approximately 24 hours and the vacuums and flows will be monitored for equilibration, and an organic vapor analyzer equipped with a photoionization detector (OVA-PID) will be used to monitor vapors from the individual SVE wells, combined influent, and effluent. Vapor sampling for laboratory analyses will be collected for the equilibrated flows following the first 24 hours of operation. The value of allowing the flows to equilibrate is that the vapor samples will not bias the VOC recovery and emission rates too high to represent the rates that will be sustained thereafter. Vapor samples will be collected from the five SVE wells, the combined influent, and the SVE system discharge. The samples will be collected in Suma canisters over a 1-hour period. The CDM Smith representative will remain at the site one additional day following system startup to verify proper system operations. The system startup activities are expected to take two days to complete. CDM Smith will perform operation and maintenance (O&M) activities in one week following system startup. When construction is complete, and following the first week of system operation, CDM Smith will prepare a Startup/Construction Completion Report, as described in the 2022 ISRP. The report will include as-built drawings certified by a professional engineer registered in the State of Florida. The report will summarize the construction activities, changes from the 2022 ISRP and this proposal, and describe the system startup activities and results.
Subtask 4: Utilities CDM Smith will provide utilities for the SVE system and assume $1,300 per month. Handling + setup fees are covered separately in CEF.
FDEP Technical Staff has approved of the proposal dating May 11th, 2023.
CDM and the FDEP confirmed on May 18th, 2023, that an Access Agreement with the current real property owner of the site has been executed.
The final cost total for Task Assignment DC003C is $154,438.72.

1203 West Highway 50
Clermont, Lake County, Florida
Dear Mr. McMurray:
CDM Smith Inc. (CDM Smith) is pleased to respond to the Florida Department of Environmental Protection (FDEP) Task Assignment Request to construct a soil vapor extraction (SVE) system, conduct baseline/annual groundwater sampling, groundwater monitoring well installation, and SVE system operation and maintenance (O&M) for Nelson's Cleaners (the Site) located at 1203 West Highway 50, Suite G, in Clermont, Lake County, Florida, ERIC_4822. Our project understanding, the scope of work, and project schedule are described below, and the cost estimate is also attached.
Project Understanding CDM Smith understands that FDEP requires the construction, startup, and operation of an SVE system at the Site. This proposal to complete this work also includes one month of SVE system O&M, SVE system monitoring and optimization, and a System Start-Up/Construction Completion Report. The project duration will be approximately four months, including system installation and start-up, one month of operation, and delivery of the System Start-Up/Construction Completion Report. CDM Smith understands that the Site is an actively operating facility, and the site work must accommodate the Site operations.
Nelson's Cleaners Construction Proposal 06_23
Scope of Work CDM Smith’s proposed scope of work is described below. To complete this project, support services will be required from several subcontractors. Competitive bids were obtained for drilling and SVE System construction and installation. The laboratory and disposal services will be provided by companies with approved rates previously negotiated for use on the Waste Cleanup Program Contract HW681. The companies selected by CDM Smith for the Nelson’s Cleaners project are identified in the associated task descriptions.
Subtask 1 – Project Management Project management activities performed under this task consist of administrative functions required to maintain the project schedule, adhere to budget, and deliver the quality of the work products defined by CDM Smith's quality standards. We will prepare and submit invoices upon approval of each deliverable or milestone completion.
Project Kickoff and Progress Meetings CDM Smith expects to have a kickoff meeting or telephone conference with the FDEP to review the status of the project and address FDEP comments regarding the Task Assignment. CDM Smith will prepare meeting agendas and notes as part of this task.
Project Quality Technical Review CDM Smith's Quality Management System guidelines will be followed. Internal quality reviews will be conducted on plans and on investigation findings and reports.
Project Status Reports CDM Smith's Project Manager will prepare and submit monthly status reports to accompany each invoice throughout this project. The Project Manager will also discuss the project's status with the FDEP bi-weekly until it is complete.
Subtask 2 – Baseline/Annual Groundwater Monitoring and Reporting Groundwater sampling was last performed at the Site in August 2022. CDM Smith proposes to perform a baseline groundwater sampling event before SVE system startup. Annual groundwater monitoring is current being performed at the Site, and it is anticipated that the baseline and annual groundwater sampling will be combined into one event. CDM Smith anticipates the baseline sampling event will be performed soon after the Task Assignment is awarded to CDM Smith. A site-specific Health and Safety Plan (HASP) will be prepared by CDM Smith prior to commencing any site activities. The HASP will be comprehensive of all sitework anticipated for this site.
In accordance with the 2022 ISRP prepared by HSW, groundwater samples will be collected from monitoring wells MW01, MW02, MW04, MW05, MW06, MW07, MW08, MW10, MW011, MW012, MW013, MW014, MW015, MW016, and MW017.
Purging and sampling will be in accordance with FDEP’s Standard Operating Procedures (SOP) for Groundwater Sampling, FS 2200, and will be collected using low-flow techniques with a peristaltic pump and dedicated polyethylene tubing. A YSI-556 multi-parameter probe and a turbidimeter will be used to collect purge parameters including dissolved oxygen, pH, conductivity, oxidation reduction potential, temperature, turbidity. The instrumentation will be properly calibrated and recorded. Purge water will be contained in drums for characterization and disposal as nonhazardous investigation-derived waste (IDW). CDM Smith assumes that one IDW drum will require disposal under this task assignment. The baseline sample results will be evaluated in the Semi-Annual Remedial Action Status Report submitted as part of Subtask 5.
Deliverables: HASP, Laboratory Analytical Report, Updated Tables
Subtask 3 – Soil Vapor Extraction System Construction and Startup CDM Smith has reviewed the SVE system design and has relied on HSW’s design and recommendations in their FDEP-approved 2022 ISRP. CDM Smith has not verified all ISRP design elements in the HSW ISRP and has not identified a need to do so, based on a rudimentary review.
The SVE system described in this proposal is intended to meet or exceed the operational design requirements of the HSW ISRP. The components in Subtask 3 include the SVE blower system, SVE manifold, the control panel, the treatment system enclosure, fencing, transfer piping, and connections. Subtask 3 includes system startup and first month of system operation, followed by the submittal of a Startup/Construction Completion Report.
Treatment System Construction
The SVE system will be enclosed, pre-wired (entire system including electrical control panel and equipment UL-certified at factory), pre-piped, and tested prior to arriving at the site. The system will be equipped with a process logic controller (PLC) controller system that will integrate the operations of all equipment. The controllers will be programmed to shut down the entire system upon failure of any of the fail-safes and provide remote shut-down and restart capabilities. The treatment system will be constructed by RSI LLC. The major component details are provided below:

Air inlet louvers with sound hoods to reduce noise.
Circuit breaker protection for interior lighting and fan.
Four copies and an electronic version of a detailed O&M Manual will be provided with the treatment system. Equipment warranty information will be in the O&M Manual along with a completed FDEP property reporting form. The treatment system manufacturer will provide one day of startup testing.
Fencing, Transfer Piping, and System Connections
CDM Smith will provide construction management and an on-site representative during the construction activities. Petroleum Resource & Development (PR&D) has been selected to perform the treatment system installation. The selected contractor will perform the following under the direct supervision of CDM Smith personnel:
Installation of piping, fittings, valves, gauges, sample ports, etc., required to complete the scope of work. The total piping lengths based on the ISRP will be approximately 55 feet indoors and 90 feet outdoors. The ceiling type is not known, and the hanger types required cannot be identified now. It is assumed that conventional hangers will be appropriate and modifications to the existing structure will not be required.
Surface restoration (including sod installation, landscape plants and materials, and asphalt concrete paving, if needed).
Install engineering controls for surface runoff and sediments (as needed).
Construction and demolition debris disposal.
Providing equipment suitable to lift carbon vessels and equipment and move them into position.
Proper installation of required anchors and tie-down straps for treatment system enclosure.
Provide an electrical drop (3-phase, 200-amp), including permitting fees and the use of a licensed electrician. Includes the installation of temporary service pole and disconnect at the location specified by the Engineer (assume maximum 20 feet from control panel), and connection to the treatment system control panel (aboveground). The electrician will also be available for one 8-hour day at startup.
Installing up to 30 feet of 6-foot-high wooden fence around the treatment system enclosure, including a main gate capable of allowing the treatment system to be removed.
It is assumed that the on-site construction activities will take approximately five days.
System Startup and Monitoring
The 2022 ISRP does not specify a sample duration. The samples will be laboratory analyzed by TA using EPA Method TO-15.
The CDM Smith representative will remain at the site one additional day following system startup to verify proper system operations. The system startup activities are expected to take two days to complete. CDM Smith will perform operation and maintenance (O&M) activities in one week following system startup. Vapor samples will be collected from the five SVE wells, and field screened with an OVA-PID. Combined influent and system effluent samples will be collected for laboratory analysis by EPA Method TO-15.
Reporting
When construction is complete, and following the first month of system operation, CDM Smith will prepare a Startup/Construction Completion Report, as described in the 2022 ISRP. The report will include as-built drawings certified by a professional engineer registered in the State of Florida. The report will summarize the construction activities, changes from the 2022 ISRP and this proposal, and describe the system startup activities and results.
Deliverables: Daily Construction Reports, Startup/Construction Completion Report
Subtask 4 – Utilities CDM Smith will provide utilities for the SVE system and assume $1,300 per month including administrative costs.

Power at the above referenced facility is: ___________________________120/230V three phase CLOSED DELTA ONLY
Please note that a system connected to an open delta electrical system can cause warranty issues. Please see Warranty disclaimer below. Warranty issues are at the discretion of PRM.
End of written proposal. Please see attached warranty disclaimer and security agreement. If your project payment schedule includes progress payments, then a security agreement may not be required. The written security agreement is intended to reserve PRM’s right of ownership of the equipment in the event of a default of payment due to bankruptcy or some other unforeseen event. A security agreement is required in order for PRM to file for a UCC for the equipment.
We have quoted prices with terms that we feel best represent the client's needs based on review of the request. PRM can offer flexible alternative payment terms on the project based on customer request with terms up to 270 days. Note that if PRM has provided progress payment terms, these terms are structured to offer the client the best overall value as we have reduced pricing and not included any financing terms for the project. Extended payment terms do incur pricing increases due to the cost of PRM internally financing projects for customers due to the cost of carrying money for these durations. If we have quoted with terms that you prefer to change, please contact your sales agent to discuss. Note that extended terms are typically offered on State or Federally funded projects where the funding structure is such that extended terms may be required.
*********IMPORTANT*********
Upon taking receipt of equipment that has physical signs of damage, it is the responsibility of the client to document that damage on the Bill of Lading at the time of receipt of the equipment. In the event that the Bill of Lading is not properly marked and the damage is visible, PRM has no ability to make a claim against the carrier and thus the recipient would become responsible for all charges of damage repairs. The client must also notify PRM Corporate headquarters in writing within 24 hours with a written description of all damage as well as digital images of the damage. PRM selects the best carriers in the nation to do our transporting however there is always potential for damage, especially on longer journeys. Our carriers all carry freight damage insurance which we can make claims against, but only if we follow the rules and the most critical rule is that the damage must be documented on the Bill of Lading at receipt of the equipment.
Loose Items Integrations - PRM typically manufactures systems complete in our facility where components or subsystems may require detachment for shipping and reassembly onsite. Unless specifically quoted in our written proposal, PRM will package loose equipment separately for that shipment. It is the onsite systems contractor or other subcontractors to un-package and reinstall these components onsite. In the event the client needs or requires for PRM to install the components, there will be a required additional charge to do so. If a clients specification states that PRM is to reassemble those components, it is understood and agreed that PRM is not including pricing to do so in our base pricing unless specifically stated by PRM. PRM ships hundreds of modular systems each year and in >99% of the cases, all of our clients have the site contractors perform the components installations. It typically may not be price competitive for PRM to perform site installation work and in many cases PRM may be banned by state requirements due to contracting licenses.
