OAK SHORE DRIVE FISHING PIER
DEP Agreement No. CN335
Task Assignment No. 5 Revised Scope of Services
Change Order No. 2
Assumptions (Updated per Change Order No. 2)
The Consultant has made several assumptions in developing this scope of services and associated fees for the Project.
The assumptions affect the proposed level of effort and associated costs. If any of the assumptions should prove incorrect, the Consultant will submit a proposal to modify its scope of services and fees accordingly.
The project does not include shoreline armoring or treatment, stormwater components, or any improvements to existing infrastructure.
Lighting components will be limited to curb or rail mounting light and navigational aids.
The project design will closely follow the conceptual design developed under separate authorization. This conceptual design is concurrent with previous (NRDA) regulatory consultations.
The project will avoid wetland and submersed resource impacts or create only temporary impacts that do not require mitigation.
The project will not require an updated natural resource survey (completed in September 2018) The lead state and federal agencies will not require wetland or natural resource verification visits following Hurricane Michael.
Based on initial regulatory consultations (May 2018), the State of Florida (DEP) requires authorization of an Individual Permit and the Department of Army requires authorization of a Standard Permit. The City of Parker will conduct any necessary local permitting (e.g., local building permits, etc.).
The DEP will pay all permit fees.
The DEP and City of Parker will be co-applicants. Consultant will serve as the Engineer of Record and Agent for the permit applications.
Consultant does not guarantee, warranty, or otherwise ensure that the agencies will authorize the permits requested.
Tasks and Deliverables
Subtask 4 – Preliminary Engineering Design (60%-complete) (Added per Change Order No. 2)
Description: The Consultant will apply data collected in Subtasks 2-3 to the conceptual design (provided April 2018) and complete the preliminary (i.e., 60%-complete) engineering design for the proposed pier.
Subtask 4.1 Kick-Off Meeting: Once the DEP Project Manager has issued the Consultant a Notice-to Proceed, the Consultant will coordinate with the DEP Project Manager and schedule a kick off meeting to include other team members. The DEP project manager will select the stakeholders for attendance. The topics of discussion during the kick-off meeting will include reviewing the status of Hurricane Michael repairs, design considerations, project construction budget, task schedule, DEP action items and information, and expected deliverables. The review will also consider design opportunities for optimized connectivity between existing access areas and the proposed Project features to enhance the visitor experience. The Consultant’s key team members, DEP, and City of Parker representatives may also discuss potential design revisions if requested.
DEP Agreement No. CN335, Task Assignment No. 5, Change Order No. 2, Page 2 of 10
The Consultant shall prepare an Agenda for the meeting and distribute it to all invited attendees at least two (2) business days prior to the meeting for review and comment. Following the meeting, the Consultant will prepare and disseminate meeting minutes to document the discussions and direction from DEP.
Deliverables Subtask 4.1: The Consultant shall provide one electronic copy (via email in .pdf format) of the Kick- Off Meeting agenda, minutes, and attendance log.
Schedule Subtask 4.1: The Consultant shall coordinate with the DEP Project Manager and schedule the Kick-Off Meeting within approximately three (3) weeks of authorization. The Consultant shall provide the deliverable(s) within one (1) week of the meeting.
Fixed Price Cost Subtask 4.1: $3,154.48
Subtask 4.2 Coastal Conditions Analyses (CCA): As realized by the impacts of Hurricane Michael to the project site, a detailed assessment of coastal conditions for engineering design is critical for the resiliency of the structure. Expanding on the estimation of coastal conditions provided during conceptual design, the Consultant will evaluate historical storm data and modify and apply a previously developed two-dimensional model to determine water levels and current speeds at the site. Consultant will determine wave heights at the site from FEMA wave model results and compare these to fetch-limited model wave heights based on ASCE 7-16 wind speeds. Consultant will develop statistical (i.e. return-period) coastal conditions for water levels, wind-speeds, and wind-driven wave heights for DEP review and direction for design condition (e.g., 50-yr storm event).
The Consultant will then apply these conditions to estimate the design hydraulic loads and scour conditions along the pier and document these results. Consultant will document tide and storm water levels, local current velocities, wind speeds, wave heights, and wave periods in a coastal conditions letter report to support engineering design subtasks.
Deliverables Sub-Task 4.2: The Consultant shall provide one (1) electronic copy (via email in .pdf format) of the Coastal Conditionals Analysis Letter Report signed and sealed by a professional engineer licensed in the state of Florida.
Schedule Sub-Task 4.2: The Consultant shall provide the deliverable within four (4) weeks of authorization.
Fixed Price Cost Subtask 4.2: $9,267.10
Subtask 4.3 Preliminary Engineering Design: Based on previously collected data and DEP direction, the Consultant will develop a preliminary engineering design for the proposed fishing pier. Preliminary engineering will consider upland and submerged site conditions, utility locations, geotechnical conditions (Subtask 3), and anticipated coastal loading conditions (Subtask 4.2). Notably, the pier and boardwalk design shall be based on the conceptual design previously approved by DEP and the City of Parker and design condition recommended by the Department. During this task, Consultant will consider potential substructure layouts that identify a constructible, cost-effective, and resilient pier and boardwalk structure design and layout. Such considerations may include varying pile design (e.g., varying pile sizes, depth, and spacing) along the shallow- and deep-water portions of the concrete pier. The Consultant will investigate alternative construction methods (e.g., top-down, over-water, trestle-based, etc.) for various structure alternatives across shallow and deep-water areas and provide a final recommendation for the project.
DEP Agreement No. CN335, Task Assignment No. 5, Change Order No. 2, Page 3 of 10
The preliminary drawings will depict plan arrangement, typical cross-sections, deck elevations, anticipated pile specifications, and embedment depths. The drawings will also include pertinent information to support environmental permitting assistance (Subtask 5); including a location map, existing conditions, plan and cross-sectional views of the proposed pier and accessory boardwalk, bathymetric contours, limits of submerged aquatic vegetation, limits of the existing and proposed submerged land lease areas, and general notes summarizing required information (detailed dimensions, total preempted area, proposed SSLL area, etc.). The Consultant will also provide an updated opinion of probable costs (OPC) based on the 60%-complete level of design.
Once the preliminary engineering design is complete, Consultant will coordinate with the DEP project manager to schedule a meeting to review the preliminary design and receive comments. Consultant will make one (1) revision to the preliminary design to incorporate those comments received from DEP to the extent practical.
Deliverables Subtask 4.3: The Consultant shall provide one (1) legible paper copy at half scale (11 inch by 17 inch) and one (1) electronic copy (via email in .pdf format) of the 60% drawing set and OPC.
Schedule Subtask 4.3: The Consultant shall provide the deliverable within six (6) weeks of completion of Subtask 4.2, including receipt of written DEP recommendation for design storm condition (e.g., 50-yr event).
Fixed Price Cost Subtask 4.3: $21,596.58
Performance Measures Subtasks 4.1 – 4.3: The DEP Project Manager shall review the deliverables listed above to verify that all required elements are included and to ensure satisfactory completion of services rendered. The DEP Project Manager shall notify the Consultant of any deficiencies in the deliverable(s) and shall give the Consultant reasonable opportunity to correct noted deficiencies and provide a revised deliverable(s).
Total Fixed Price Cost Subtask 4: $34,018.16
Subtask 5 – Environmental Permitting Assistance (Added per Change Order No. 2)
Description: Consultant will assist DEP in obtaining necessary state and federal environmental permit authorizations for the proposed fishing pier.
Subtask 5.1 Permit Application and Supporting Documentation Preparation: Following DEP approval of the preliminary design, the Consultant will develop separate DEP and USACE environmental permit applications that include the information necessary for state and federal agencies to perform their technical review and public processes. The Consultant will submit applications following direction of the pre-application meetings, conducted under separate authorization in April 2018. Notably, the only upland component of the permitting effort is the timber access boardwalk, therefore stormwater permitting for this component should not be required.
In support of the application, the Consultant will prepare all narratives describing the project design, purpose, and need; previous NRDA consultation documents; project best management practices (BMPs); avoidance and minimization measures; tidal conditions; documented natural resources within the project area (wetland and submerged resource survey completed in September 2018); and construction methodology and schedule. The application will include as attachments the permit drawings, documents describing property ownership and
DEP Agreement No. CN335, Task Assignment No. 5, Change Order No. 2, Page 4 of 10 neighboring owners, 2018 natural resource survey report, and a State Historic Preservation Office Master File inquiry result.
The Consultant will submit the draft application package to the DEP for review and comment. Following receipt of DEP’s comments, the Consultant will incorporate any necessary changes to produce the final permit application packages and deliver the packages to the lead state and federal regulatory agencies. The lead agencies will review the application packages and distribute to all other appropriate commenting agencies.
Deliverables Subtask 5.1: The Consultant shall provide one (1) electronic copy (via email in .pdf format) of the draft and final permit application packages.
Schedule Subtask 5.1: The Consultant shall provide completed DEP and USACE permit applications within four
(4) weeks of acceptance of the preliminary design (i.e., 60%-complete, permit) drawings (Subtask 4.3).
Fixed Price Cost Subtask 5.1: $12,543.84
Subtask 5.2 Sovereign Submerged Land Lease Modification and Recording: Following DEP approval of the proposed sovereign submerged land lease (SSLL) boundaries presented in the permit application, the Consultant will subcontract to prepare a submerged land lease survey of the in-water project components meeting the requirements for DEP SLERP Procedures Manual.
Deliverables Subtask 5.2: The Consultant shall provide one (1) electronic copy (via email in .pdf format) of the proposed sovereign submerged land lease drawing signed and sealed by a surveyor and mapper licensed in the state of Florida.
Schedule Subtask 5.2: The Consultant shall provide the deliverable within four (4) weeks of DEP acceptance of the proposed SSLL.
Fixed Price Cost Subtask 5.2: $2,343.66
Subtask 5.3 RAI Response and Regulatory Coordination: The establishment and maintenance of a clear line of communication between the applicant and the participating agencies represents the single most important activity during the permitting process. The Consultant will actively coordinate with state and federal agencies staff during the application process. These agencies include, but are not limited to, DEP, USACE, U.S. Fish and Wildlife Service (USFWS), Florida Fish and Wildlife Conservation Commission (FWC), and National Marine Fisheries Service (NMFS).
Following submission of the permit application, the DEP and USACE will likely respond with requests for additional information (RAIs). While Consultant anticipates submittal of a complete and concise permit application package, the unique nature and prominent location of the project will likely generate review comments and RAIs from regulatory agencies and the related natural resource agencies that provide comments on permit applications. Such requests typically comprise a series of questions requiring additional explanation or clarification of environmental and engineering issues. As the DEP’s representative, Consultant will coordinate with DEP and the lead regulatory agencies to address such RAIs.
