JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION (JOFOC)

FOR UPGRADE ENVIRONMENTAL CONTROL SYSTEM (ECS) AT LC-39B, 80KSC020R0024

1. Federal Acquisition Regulation (FAR) 6.303-2(b)(1) – Identification of the agency and the contracting activity, and specific identification of the document as a “Justification for other than full and open competition.”

This document is a brand name justification for other than full and open competition prepared by NASA Kennedy Space Center, Florida. The procuring agency is NASA and the contracting activity is OP-CS.

2. FAR 6.303-2(b)(2) – The nature and/or description of the action being approved:

This brand name justification provides the rationale for contracting by other than full and open competition for the acquisition of the electric heaters and associated heater controllers, included in the design Data Manual Appendix R, to be procured by the awarded contractor of the Upgrade ECS at LC-39B, 80KSC020R0024.

3. FAR 6.303-2(b)(3) – A description of the supplies or services required, to meet the Agency’s needs (including the estimated value):

The scope of work includes the upgrades to the existing ECS at LC-39B that includes adding new heaters and heater controllers to two of the twelve purge air duct circuits. Each circuit duct heater consists of two redundant heaters. Therefore, there are 4 new heaters and controllers designed for this upgrade. There will be 20 existing heaters and controllers remaining in use in the other 10 duct circuits. The existing heaters are manufactured by Indeeco in Saint Louis, Missouri. The 4 new electric heaters and associated heater controllers shall be supplied by Indeeco to maintain continuity in obtaining and stocking replacement service parts, as well as maintaining O&M personnel maintenance knowledge of these types of heaters.

Based upon the existing duct heaters and controllers installed and in operation in the ECS room at Pad B, the contractor shall procure heaters and controllers manufactured by Indeeco. The purchase of these components will allow the Government to meet current program requirements while also maintaining similarity with the existing ECS heaters currently in operation at Launch Pad 39B. The purchase of these heaters will also limit capital expenditures for software integration, spare parts, service, and personnel training.

Budget costs were obtained from Indeeco for these heaters totals $70,610. This cost comprises approximately 0.5 percent of the overall project.

4. FAR 6.303-2(b)(4) – An identification of the statutory authority permitting other than full and open competition:

The statutory authority permitting other than full and open competition is 10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements.

5. FAR 6.303-2(b)(5) – A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited:

The rationale supporting the use of 10 U.S.C. 2304(c)(1) Only one responsible source and no other supplies or services will satisfy agency requirements as described below.

In addition to the proposed heaters, there are heater chambers that are designed specifically around the Indeeco heater selection dimensions. Other manufacturers could provide the heaters to meet the design requirements, but the heater chambers that house the heaters would need to be re-designed and the new heater chamber configuration would then need to be used for the AFT Arrow calculations. The aggressive construction time schedule does not allow for heater chamber redesign and re-running the AFT Arrow calculations.

6. FAR 6.303-2(b)(6) – A description of the efforts made to ensure that offers are solicited from as many potential sources as practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies:

A notice to the Government Point of Entry (GPE) website (beta.sam.gov) will be published with solicitation 80KSC0R0024 as attachment J-J, in accordance with FAR Subpart 5.2. The results of this synopsis are summarized in Section 10 below.

7. FAR 6.303-2(b)(7) – A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable:

The Contracting Officer’s (CO) signature on this document indicates the CO has determined that the anticipated cost to the government will be fair and reasonable. The CO will utilize a Lowest Price Technically Acceptable (LPTA) source selection process to make an award decision. Only one award will be made as a result of the solicitation. Award will be made to the offeror who is deemed responsible in accordance with the Federal Acquisition Regulation (FAR), who conforms to the solicitation requirements, and whose proposal, judged by an overall assessment of the evaluation criteria and other considerations specified in this solicitation, meets the technically acceptable standard for the non-price factors and provides the lowest evaluated price.

8. FAR 6.303-2(b)(8) – Description of the market research conducted, and the results, or a statement of the reasons a market research was not conducted:

For the Pad B ECS, maintaining compatibility of hardware and software with the existing heaters and controllers provides cost benefits, including commonality of hardware for reduced spares inventory, reduced training for maintenance and operations personnel, and reduced software programming costs due to common systems, therefore no additional market research was research was performed.

9. FAR 6.303-2(b)(9) – Any other facts supporting the use of other than full and open competition:

No other supporting facts are expressed.

10. FAR 6.303-2(b)(10) – A listing of the sources, if any, that expressed an interest in writing in the acquisition:

A sources sought synopsis was issued on February 5, 2020 and closed on February 20, 2020. One response was received from an interested small business, ADVON Corporation. An evaluation of their capabilities determined a low level of confidence of meeting the project criteria. Therefor the requirement has been approved for a full and open solicitation for all contractors to propose.

11. FAR 6.303-2(b)(11) – A statement of actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required:

The Agency will continue to examine the market in the future for alternative solutions or new sources before executing any subsequent acquisitions for the same requirements.
