About this file

This document is a Representation Regarding Certain Telecommunications and Video Surveillance Services or Equipment form (REV 11/21), which implements Section 889 of the John S. McCain National Defense Authorization Act. The form requires offerors to disclose whether they provide or use covered telecommunications equipment or services, with two key prohibitions: 1) Executive agencies are prohibited from procuring telecommunications equipment or services as a substantial component of any system after August 13, 2019, and 2) Agencies cannot contract with entities using such equipment or services after August 13, 2020.

The form mandates that offerors review the System for Award Management (SAM) for excluded parties and provide detailed disclosures about any covered telecommunications equipment or services, including the producing entity's name, unique identifier, CAGE code, equipment details (brand, model number), and an explanation of proposed use. Offerors must check boxes indicating whether they will provide or use such equipment/services and potentially provide additional information explaining the nature and permissibility of such use under the statutory prohibition.
